There is no legislation behind the creation of Sahyog portal, X argues in Karnataka High Court

The Karnataka High Court on Tuesday reserved its judgment on X Corp's challenge to central takedown orders issued for social media platforms under the Information Technology Act's section 79 (3) (b). In its closing arguments, X said there was no legal backing to the creation of the Sahyog portal, which it has called a 'censorship portal'.
The Digipub News India Foundation, a non-profit organisation formed by digital news outlets, also made submissions before the single-judge bench of Justice M Nagaprasanna, which has been hearing the case.
X has been arguing before the court that takedown orders against social media posts should be issued under Information Technology Act section 69A, and not section 79 (3) (b), stating that the latter section, along with certain rules, allows too much leeway for government officials to strip the 'safe harbour' provisions without a judicial process. 'Safe harbour' provisions protect intermediaries like X Corp from liability for content posted on their platforms by users.
Objections have also been raised to the Sahyog portal, which the government has referred to as a way to 'automate the process of sending notices to intermediaries' but which X Corp has called a 'censorship portal'. The Centre has also argued that X is the only such intermediary not to join the portal.
Making the last submissions for X in the case before the court, senior advocate K G Raghavan stated, 'Sahyog has no statutory backing and if there was a statutory backing, the law would have provided for it… upon consideration of the structure of the IT Act, it does not appear so.' He argued that section 26(2) of the IT Act indicated the circumstances in which such a website would be created, which was not found in the subsections of section 79 of the IT Act.
He had also raised the possibility of conflict between the existing provisions, stating, 'Let us take a situation where one officer says 'I will use 79 (3) (b)'. Another officer says 'no, I should go under 69(A)' and all the procedure takes place – and the authority comes to the conclusion that it is not something we want to block… Direct conflict. This is exactly what should be prevented. 69(A) can be overridden by an officer sitting in any remote corner of the country.'
Arguing on behalf of Digipub, senior advocate Aditya Sondhi stated, 'Even a subtle effort by the State….the right of a media house to hold land etc have all been found to be indirect methods of scuttling rights.The esteemed Solicitor General had placed some extreme examples of phishing, deepfakes etc to drive home the need for this sort of regulation. Extreme examples can make bad law.'
He added, 'We need to deal with these, it cannot be disputed. But the use of the phrase 'unlawful act' in the rules being as vague…it is bereft of definition. If there is a need to fill a vacuum, it needs to be done legislatively and not in a roundabout manner.'
The court subsequently reserved its judgment in the matter.

Powerful perpetrators are rarely made accountable for their actions, and in that backdrop, the conviction and life sentencing of Prajwal Revanna, former Janata Dal (Secular) Member of Parliament and grandson of former Prime Minister H.D. Deve Gowda, for a heinous crime comes as a relief. This is the first of the four cases of rape and sexual harassment against the 34-year-old Gowda scion. The former Member of Parliament had raped a 48-year-old domestic worker twice at the family's homes in Hassan and Bengaluru in 2021, and recorded it on his mobile phone. In April 2024, ahead of the general election, explicit clips of his sexual misdemeanours were leaked through pen drives strewn across public places in Hassan, the Gowda home town. In the videos, Revanna's face is not visible, only the women's, a gross violation of their safety and privacy. The former help and other women came forward with their complaints but their agony was far from over. Using political muscle, and aided by his parents, former Minister H.D. Revanna and Bhavani Revanna, he did his best to arm twist the system, threatening a survivor, trying to stop her from testifying. But a Special Investigation Team (SIT) worked with alacrity and he was finally arrested in May 2024. The SIT filed the first charge sheet in August 2024. The video, where the domestic worker is seen pleading with Prajwal Revanna to spare her, DNA analysis and her testimony formed key evidence in the trial which began in May this year. The Special Court of Sessions to hear criminal cases against former and present Members of Parliament and MLAs pronounced the verdict on August 1. The speedy trial and conviction will give hope to other survivors battling for justice in sexual assault cases. The court convicted Revanna on all charges framed against him, including under Sections 376(2)(n) (repeated rape on the same woman), 506 (criminal intimidation), 201 (disappearance of evidence) of the Indian Penal Code (IPC) and 66E (violation of privacy) of the Information Technology Act, 2000. Section 376(2) of the IPC states that a person convicted under it 'shall be punished with rigorous imprisonment for a term which shall not be less than 10 years, but which may extend to imprisonment for life....' Often, even when multiple complaints are raised, leaders with political clout get away. The laws are in place. All that the government machinery needs to do is act swiftly and sensitively, and create a safe space so that survivors of sexual abuse can come forward without fear.

PRAYARGRAJ: The Allahabad High Court has directed that status quo be maintained with regards to the demolition notices issued by Ghaziabad Development Authority ( GDA ) over alleged illegal properties built on public land. Hearing a writ petition, a division bench comprising Justice Mahesh Chandra Tripathi and Justice Prashant Kumar granted time to the district administration and GDA to place on record how they intend to rehabilitate the old inhabitants of the properties. The court also restrained the petitioners from creating any third-party interests or undertaking any development on the disputed property. The court also observed, "In the facts and circumstances of the case, we also find that it is not in dispute that the petitioners have been occupying the place for the last 40-50 years." "At this stage, we find that some indulgence and reprieve is to be accorded to the inhabitants who belong to the weaker sections of society and we further direct the authorities to ensure the formulation and implementation of a rehabilitation scheme for such persons," it said. The bench said the rehabilitation scheme shall be provided by the district administration and the GDA in the next hearing. The next hearing is listed for August 22. The petitioners filed the present writ petition for quashing the demolition notice dated June 16, 2025, issued by the GDA under section 26-A of the UP Urban Planning and Development Act, 1973. The GDA initially issued notice to 172 illegal occupants of public land on September 6, 2024, which is earmarked in the master plan. Consequently, 89 persons filed their objections which were considered and the impugned order (order under challenge) was passed. During the course of hearing, the counsel for the petitioner submitted that the petitioners are old inhabitants and in absence of any rehabilitation scheme as per the law, the old inhabitants, who are occupying small pieces of land for their shelter and admittedly belong to the lower sections of society, will suffer irreparable loss, if uprooted. After hearing both sides, the court in its order dated July 31 passed the above directives and observed, "It is informed that in response to the earlier court's order, till date the GDA has not taken any remedial measures to rehabilitate the persons who were in illegal occupation for the last 40 years."
