HUMAN RIGHTS TRIBUNAL FEASIBILITY STUDY TO BE COMPLETED IN OCTOBER – KULASEGARAN KUALA LUMPUR: The feasibility study on the proposed establishment of a Human Rights Tribunal in Malaysia is expected to be completed by October this year, said Deputy Minister in the Prime Minister's Department (Law and Institutional Reform) M. Kulasegaran. He said the study was conducted by the Feasibility Study Committee on the Human Rights Tribunal(JKKTHAM), which was established in June, and involved examining various perspectives and inputs relevant to the tribunal's proposed formation. 'This effort began with an initial meeting that I chaired on Nov 21, 2024, to discuss the proposal to establish the tribunal. Following that, JKKTHAM was set up to conduct a comprehensive feasibility study,' he said. Kulasegaran said this in response to a question from Teresa Kok Suh Sim (PH-Seputeh) who asked about the latest status of the government's plan to establish a Human Rights Tribunal during the oral question-and-answer session in the Dewan Rakyat today. 2,812 RKAT UNITS COMPLETED, OVER 3,000 MORE UNDER CONSTRUCTION NATIONWIDE The Ministry of Defence (MINDEF) has completed six Armed Forces Family Housing (RKAT) projects nationwide, comprising a total of 2,812 units since 2022. Defence Minister Datuk Seri Mohamed Khaled Nordin said 10 more RKAT projects involving 3,206 units, implemented under the 12th Malaysia Plan (12MP) at a cost of RM1.002 billion, were currently under construction and scheduled for completion by 2026. 'Eight new RKAT construction projects involving 2,456 units are still in the procurement phase, with an estimated cost of RM1.4 billion,' he said in reply to a question from Manndzri Nasib (BN-Tenggara) on the status of military housing nationwide during the oral question-and-answer session in the Dewan Rakyat today. He said under the MADANI Government, the RKAT maintenance allocation had increased to RM426.5 million in 2025, up 6.62 per cent compared to RM400 million in 2024 and RM236.7 million in 2023. TASK FORCE SET UP TO DEVELOP COMMON BAR COURSE CURRICULUM The Legal Profession Qualifying Board has formed a task force to design the curriculum, training methods, pedagogy and standards of the Common Bar Course (CBC), which will replace the Certificate of Legal Practice (CLP), said Deputy Minister in the Prime Minister's Department (Law and Institutional Reform) M. Kulasegaran. He said the decision was made at a meeting on July 23 after taking into account and agreeing to a proposal paper by the CBC Curriculum Committee titled 'Study on the Development of Curriculum, the Method and Practice of Training (Pedagogy) and Standards of the Common Bar Course to Replace the Certificate of Legal Practice'. 'This CBC Task Force comprises experts from public and private higher education institutions, as well as representatives from the Bar Council. 'It will begin conducting the study and developing the CBC on Aug 1, 2025, and the work is expected to be completed within eight months, by March 31, 2026,' he in response to a question from S. Kesavan (PH–Sungai Siput) on the latest status of the implementation of the CBC by the Legal Profession Qualifying Board during the oral question-and-answer session at the Dewan Rakyat today. - Bernama

KUALA LUMPUR: The accounts of the Legal Profession Qualifying Board (LPQB) are currently being audited by the Auditor General — the first public audit in 17 years. Deputy Minister in the Prime Minister's Department (Law and Institutional Reform) M. Kulasegaran acknowledged the lapse and confirmed that the audit was now underway. "I admit that for 17 years, the LPQB's accounts were not audited. This is a serious matter. "At the end of last year, we amended the Act to empower the Auditor General to carry out the audit. I have been informed that the process is in progress and all related matters will be made known soon," he said. He was responding to concerns raised by Abd Ghani Ahmad (PN–Jerlun), who highlighted the board's trust accounts, which reportedly manage a fund worth RM20 million. Kulasegaran also said that the Certificate in Legal Practice (CLP) would be revamped, and a new Common Bar Course (CBC) introduced. "The CLP, which is currently entirely written-based, will be enhanced to include assessment components involving practical skills training such as criminal litigation, advocacy, and professional ethics," he said during Minister's Question Time in the Dewan Rakyat. In response to a separate question from S. Kesavan (PH–Sungai Siput), Kulasegaran said further study was required into the syllabus, curriculum, assessment methods, course providers, trainers, and administrative and management structures. He added that a committee and taskforce had been formed to examine the development of the CBC's curriculum and standards. "The CBC taskforce will commence its study on Aug 1, with completion targeted within eight months, by March 31, 2026," he said. KUALA LUMPUR: The government has formally set up a feasibility study committee to explore the establishment of a Human Rights Tribunal in Malaysia, with findings expected to be finalised by October. Deputy Minister in the Prime Minister's Department (Law and Institutional Reform), M. Kulasegaran, said the Feasibility Study Committee on the Human Rights Tribunal (JKKTHAM) was established in June, following an initial meeting chaired by him on Nov 21, last year to discuss the proposal. He said five JKKTHAM meetings have been held, and the research team presented its preliminary findings to the committee earlier this month. These findings include the conceptual and theoretical framework, an analysis of existing human rights mechanisms in Malaysia, a comparative study of international practices, and a proposed model for a Malaysian Human Rights Tribunal. "A focus group discussion (FGD) involving stakeholders was held on July 17 in Kuala Lumpur and will be followed by zonal FGDs, including sessions in Sabah and Sarawak. "The proposal to establish a Human Rights Tribunal is part of the Madani government's institutional reform efforts, aimed at creating a body that provides a more accessible alternative mechanism for victims of human rights violations to seek justice," he said. He also assured that the establishment of the tribunal would be aligned with the Federal Constitution and would also take into account input from syariah (Islamic law). Kulasegaran said the committee is chaired by former Court of Appeal judge Datuk Mah Weng Kwai and includes representatives from the Asean Intergovernmental Commission on Human Rights, Suhakam, the Malaysian Bar Council, academia, legal practitioners, relevant government agencies, and civil society organisations. He was responding to a question from Teresa Kok (PH–Seputeh) on the update of the establishment of the tribunal and how the government would ensure Suhakam's recommendations are enforced through the proposed tribunal, given that many human rights violations are also criminal offences. She also cited the case of Teoh Beng Hock, who died at the Malaysian Anti-Corruption Commission (MACC) premises and whose case was eventually marked as No Further Action, questioning whether his family could bring the matter to the tribunal once it is set up. Kulasegarran said the tribunal may serve as an alternative and accessible justice mechanism for victims of human rights violations, potentially hearing cases such as those involving Teoh Beng Hock, though the specific framework and jurisdiction are still under discussion. "I believe that cases involving human rights violations could fall within the scope of the tribunal once it is established. "However, it is still too early to say definitively, as the basic framework and parameters have yet to be finalised, which is why stakeholder engagement is ongoing. "But I concur with you that such matters can be investigated and further action can be taken, as is the practice in other countries with functioning human rights tribunals," he said. He added that they are also examining the implementation of Suhakam's recommendations or findings through the proposed Human Rights Tribunal, particularly in terms of feasibility and legal implications.

"This effort marks a significant step in institutional reform under the Madani government. "The feasibility committee has been tasked with studying the practicality of setting up a Human Rights Tribunal and is now actively conducting the study," he told the Dewan Rakyat on Wednesday (July 30). Kulasegaran mentioned that the committee is chaired by former Court of Appeal judge Datuk Mah Weng Kwai and includes representatives from the Asean Intergovernmental Commission on Human Rights, Suhakam, the Malaysian Bar Council, academia, legal practitioners, relevant government agencies, and civil society organisations. "As of July 2025, the committee has convened five meetings, with preliminary findings presented by the research team on July 9. "These covered the conceptual and theoretical framework, analysis of Malaysia's existing human rights mechanisms, international comparative practices, and a proposed model for Malaysia's own tribunal," he said. A focus group discussion (FGD) with stakeholders was also held on July 17 in Kuala Lumpur, with more FGDs planned across the country, including in Sabah and Sarawak, he added. Kulasegaran emphasised the government's commitment to ensure that the tribunal, if established, complies with the Federal Constitution, particularly Article 3, which upholds Islam as the religion of the Federation. "To this end, we have included representatives from the Syariah Judiciary Department Malaysia and the Islamic Development Department (Jakim) in the committee, to ensure that any proposal is not in conflict with the Constitution," he said. He noted that the tribunal may serve as an alternative and accessible justice mechanism for victims of human rights violations, potentially hearing cases such as those involving Teoh Beng Hock, Muhammad Adib, and baby Zara, though the specific framework and jurisdiction are still under discussion. Kulasegaran also acknowledged concerns that Suhakam's recommendations have often been non-binding, saying this issue is being carefully examined. "It is important that Suhakam's recommendations are not ignored but implemented meaningfully. "This is being considered as part of the feasibility and legal review being conducted by the committee," he said.
