Dublin man (23) charged with stalking woman in city centre hotel

Judge Gerard Jones adjourned the case at Dublin District Court. Photo Collins Courts News in 90 Seconds - Monday July 14th Detective Garda Eamon Leen of the divisional protective services unit at Kevin Street station told Judge Jones he arrested the accused for the purpose of charging him at 9.02am today. He made no reply to the charge after caution and was handed a copy of the charge sheet. The Director of Public Prosecutions consented to summary disposal of the case, Det Gda Leen said. This means if a judge accepts jurisdiction, it can be heard at district court level instead of being sent forward to the district court, which has tougher sentencing powers. There were no objections to bail subject to a condition requested by the garda. Judge Jones granted bail on condition that the man does not engage with or research the woman online, and has no contact with her. There was no application for free legal aid by his lawyer and the judge remanded the accused on bail to appear in court again on September 8. The man was not required to address the court during the brief hearing and has not yet entered a plea to the charge, which is under Section 10 of the Non Fatal Offences Against the Person Act. The offence carries a maximum potential sentence of 12 months in prison at district court level or 10 years on indictment in the circuit court.

Clare man who allegedly assaulted judge now charged with stealing beer from shop
A COUNTY CLARE man charged in connection with the street assault of a retired district court judge was today further charged. Today at Ennis District Court, Jamie O'Connor (44) of Laurel Lodge, Clare Rd, Ennis was charged with stealing three cans of beer valued at €11.40 from Dunnes Stores, O'Connell Street, Ennis, on 15 June. The alleged theft occurred one day after Mr O'Connor is alleged to have assaulted retired district court judge, Joseph Mangan on Saturday, 14 June. Mr O'Connor has been in custody since 18 June after Judge Alec Gabbett refused an application for bail. Sgt Frank O'Grady told the court today that directions from the Director of Public Prosecutions (DPP) are outstanding. Judge Gabbett said that he would further remand Mr O'Connor in custody to 23 July and told Sgt O'Grady that he would require a medical report on that date to help him decide on the issue of court jurisdiction for the hearing of the case. Judge Gabbett said: 'We need to know where the file is by 23 July. Time is passing and we will nearly be into the fifth week by that point.' In connection with the alleged assault, it is alleged that Mr O'Connor – who was appearing via video link from Limerick prison today – told the former judge 'you put me in jail for nothing' before allegedly punching him outside an Ennis cafe. Sgt Burke said that it will be alleged that Mr O'Connor approached Mr Mangan 'and told him aggressively 'you put me in jail for nothing'. Sgt Burke said: 'Following a brief interaction it is alleged that Mr O'Connor stood up and punched Mr Mangan.' Sgt Burke said that Mr O'Connor then fled the scene in the direction of O'Connell Street. He said that Mr Mangan went to the local injuries unit in Ennis where he was treated for possible concussion and dizziness. Sgt Burke said that Mr Mangan made a statement to local Gardai. Sgt Burke said that Mr O'Connor was later arrested where he made no admissions 'and blamed alcohol for his memory loss'.

Man appears in court charged over death of Mircea Rostas in Balbriggan
He is charged with intentionally or recklessly causing serious harm to the alleged victim at Railway Street on June 23. Daniel Rostas has been charged in connection with the fatal hit-and-run. A MAN has been charged following the death of a father-of-three who was struck by a car as he stood on a footpath in north county Dublin earlier this week. Daniel Rostas (41) appeared in Dublin District Court today accused of causing serious harm to Mircea Rostas (33) who died after a collision in Balbriggan on Monday night. He was remanded in custody for DPP directions after no bail application was made on his behalf. Mr Rostas, with an address at Hastings Green, Balbriggan is charged with intentionally or recklessly causing serious harm to the alleged victim at Railway Street on June 23. Mircea Rostas Detective Garda John Delaney told Judge Michele Finan he arrested the accused for the purpose of charging him at Balbriggan station at 1.12am this morning. He made no reply after caution and was handed a copy of the charge sheet. Det Gda Delaney said he would be objecting to bail but defence solicitor Sandra Frayne said the accused was not making a bail application today. Daniel Rostas has been charged in connection with the fatal hit-and-run. News in 90 Seconds - June 26th 'I will be applying for bail in the future,' she said, adding that she would notify the gardai in advance. Judge Finan granted free legal aid at the request of the defence after hearing the accused was 'not a man of means' and was in receipt of disability allowance. Ms Frayne handed a statement of her client's financial means in to court. Judge Finan asked if the accused wished to make his next court appearance by video link but Ms Frayne asked if it could be 'in person, if that's alright.' The judge also recommended the accused should receive appropriate medical care while in custody. Mr Rostas, wearing a black and grey North Face jacket, light grey tracksuit bottoms and black and white runners, was assisted by a Romanian interpreter and the court heard he had 'very limited English.' He was not required to address the court during the brief hearing and has not yet entered a plea to the charge, which is under Section 4 of the Non Fatal Offences Against the Person Act. He was remanded in custody to appear in Cloverhill District Court on July 3. Gardai have said Mircea Rostas was struck by a car as he stood on a footpath on Monday night. Emergency services were alerted to reports of a road traffic collision and found him seriously injured on the ground. He was treated by paramedics at the scene, but died a short time later. Gardaí have appealed for witnesses and any dashcam footage. They also asked people not to share a graphic video showing the immediate aftermath of the collision. The footage, posted online, shows Mr Rostas lying motionless on the ground while a bystander attempts CPR. Family members are seen becoming distressed after arriving on the scene.

At Ennis District Court, Jamie O'Connor of Laurel Lodge, Clare Rd, Ennis appeared in connection with the alleged assault of retired district court judge, Joseph Mangan, last Saturday afternoon. The retired judge – now in his early 80s – served as a judge for 27 years and was the assigned district court judge for Clare from 2001 to October 2011 when he retired at the age of 67. In the case, Mr O'Connor is charged with the assault causing harm of Joseph Mangan at Barrack Court, Ennis contrary to Section 3 of the Non Fatal Offences Against the Person Act on 14 June. Judge Alec Gabbett said: 'This is an extremely serious alleged offence where a retired district court judge now into his 80s was allegedly assaulted for carrying out a public duty when he was a judge.' Judge Gabbett said: 'There is a possibility of other charges to follow here.' Sergeant Burke also confirmed that Gardai were opposing bail and said that the original Garda position of consenting to bail for Mr O'Connor on stringent conditions was based on the length of time the case will take before the court. Judge Gabbett said that he was refusing bail based on the seriousness of the charge before the court. He said: 'The allegation here is that a retired member of the judiciary was punched on the street.' He said that 'the facts of the case are very straightforward'. Judge Gabbett granted legal aid to solicitor, Stiofan Fitzpatrick to represent Mr O'Connor. Mr Fitzpatrick asked that bail be granted as it will take a number of months for directions to be made in the case. Judge Gabbett remanded Mr O'Connor in custody to appear via video-link from Limerick prison in court next Wednesday, 25 June.
