HC orders probe by senior cop into Kochi job fraud charge
Kochi: The Kerala high court has directed that a senior police officer, above the rank of station house officer (SHO), be deputed to investigate the case in which Genius Overseas and Consulting Agency, based at Palarivattom, Ernakulam, allegedly defrauded jobseekers of large sums of money by offering employment opportunities abroad. Justice P V Kunhikrishnan issued the order in response to a petition filed by Libin M Ali of Ernakulam, seeking a comprehensive and time-bound investigation by the crime branch or a special investigation team. The petitioner alleged that he, along with 78 other job aspirants, was defrauded of over Rs 5 crore by the agency, promising overseas employment. He expressed dissatisfaction with the ongoing investigation by the Palarivattom police. The public prosecutor submitted that the probe was proceeding smoothly, noting that the first accused was already arrested and the relevant bank accounts were frozen. However, the petitioner countered this by pointing out that six other accused persons were yet to be apprehended.. TNN

Kerala high court sets aside order barring juvenile from driving until age 25

Justice P V Kunhikrishnan issued the order on a petition filed by a 22-year-old man from Kozhikode, challenging the direction issued by the magistrate court. The prosecution's case was that, in 2020, the magistrate court had convicted the petitioner's father and sentenced him to pay a fine of Rs 26,200 under sections 269 and 336 of the IPC, and section 5 of the Kerala Epidemic Diseases Ordinance (KEDO), 2021, along with imprisonment till the rising of the court, for an offence related to the petitioner, then a juvenile, illegally operating a motor vehicle during the pandemic. The magistrate court also ordered that the juvenile shall not be granted a driving licence until he reached 25 years of age, a direction that was challenged before the HC. Karuvannur bank scam: Kerala HC declines to order CBI probe
Kochi: High court on Wednesday declined to order a CBI probe into the Karuvannur Co-operative Bank scam case in Irinjalakuda. However, the bench of Justice P V Kunhikrishnan disposed of the petition filed by M V Suresh, a former employee of the bank, who had sought the investigation. HC observed that the investigating officer must take necessary steps to ensure that the real culprits are brought before the court for trial. Suresh had sought a CBI probe into the alleged Rs 100 crore fraud, citing the involvement of individuals affiliated with the ruling party, CPM. The case is also under investigation by the Enforcement Directorate (ED) under the Prevention of Money Laundering Act (PMLA). In an earlier hearing, HC had strongly criticised the crime branch investigating officer for failing to complete the investigation, noting that the case was initially registered at the Irinjalakuda police station on July 14, 2021. The court had also directed the officer to probe the involvement of all accused persons, including the politicians named by ED in the ECIR. When the matter was considered on Wednesday, the investigating officer submitted details on the progress of the probe. He stated that in addition to the main case, 21 other cases had been registered in connection with the fraud. The order was issued on June 10 by Justice P V Kunhikrishnan. The mother of the child had approached the prison authorities to secure the parole. However, it was denied citing lack of provisions. Following this, she approached the high court. The child had scored an outstanding six A+ and two A grades in the SSLC examination. The court directed that the mark list be produced and observed that it could not 'shut its eyes to the request of such a bright kid who is seeking the help of his father to get admission to higher studies after arranging fees and other things". 'The basic rights of the convict include the right of a father to ensure good education for his child," the court said. 'A father's presence plays a vital role in a child's higher education journey by offering emotional support, guidance and mentorship." Justice Kunhikrishnan noted that while convicts lose certain rights during imprisonment, their children should not be deprived of parental support during crucial educational transitions. 'The basic rights of the convict include the right of a father to get good education to his child.
