After laying criminal charge against Mchunu, DA to also submit formal complaint to Parly ethics committee
CAPE TOWN - The Democratic Alliance (DA) says it will simultaneously submit a formal ethics complaint against Police Minister Senzo Mchunu after laying criminal charges with the police on Thursday. The party's deputy chief whip, Bax Nodada, said that Parliament's joint committee on ethics and members' interests will be approached following Minister Mchunu's contradictory statements about his relationship with politically connected businessman, Brown Mogotsi. Mogotsi was named by KwaZulu-Natal (KZN) Police Commissioner Nhlanhla Mkhwanazi as an individual reportedly linked to serious criminal syndicates and political interference in the police service. In March this year, Mchunu denied knowing Mogotsi, but in a public statement on Wednesday, he admitted that he does in fact know him, calling him a "comrade". Nodada said this reversal directly contradicted his earlier denial and raised grave concerns about whether he deliberately misled Parliament. He said this was a criminal act in terms of the Powers, Privileges and Immunities of Parliament and Provincial Legislatures Act. "This is a criminal offence under both common law and parliamentary legislation. Today, the DA laid a charge of fraud against Minister Mchunu at the Cape Town Central police station. Simultaneously, we will submit a formal complaint to parliament's joint committee on ethics and members' interests." Nodada said that President Cyril Ramaphosa's "continued inaction" also raised alarming questions about his willingness to confront corruption and protect the credibility of his government. Charges laid against Mchunu, pressure mounts for Ramaphosa to break act amid national security concerns
Ramaphosa is expected to meet with both Mchunu and Mkhawanazi before the end of the week. The political noose seems to be getting tighter and tighter around the neck of Police Minister Senzo Mchunu. On Thursday, the DA laid criminal charges against him at the Cape Town police station for allegedly misleading parliament. Mchunu is accused of lying to the portfolio committee of police after he initially denied knowing Brown Mogotsi, a man accused of playing a role in capturing the South African Police Service (Saps). In March this year, Mchunu denied knowing Mogotsi. Yet, in a public statement on 9 July, the minister admitted that he does in fact know Mogotsi, describing him as 'a comrade'. DA deputy Chief Whip, Baxolile Nodada, said Mchunu's contradictory remarks raise grave concerns about his misleading of parliament. 'It is a criminal act to mislead parliament in terms of the Powers, Privileges and Immunities of Parliament and Provincial Legislatures Act. 'The minister committed fraud by knowingly making a false statement with the intent to mislead parliament,' said Nodada. Nodada said Mchunu has violated the Powers and Privileges Act, which criminalises any attempt to mislead or obstruct parliament or its committees. 'It is simply unacceptable for a sitting minister to evade accountability while surrounded by allegations of corruption, links to criminal syndicates, and efforts to shield politically connected individuals from scrutiny,' he said. Where is the president? He criticised President Cyril Ramaphosa's inaction in the face of this growing scandal. 'It is indefensible. Four days after the explosive revelations by KwaZulu-Natal's provincial police commissioner, the president has neither acted against Minister Mchunu nor initiated any credible investigation,' he said. MK party lays criminal charges against Mchunu The uMkhonto weSizwe (MK) party also laid criminal charges against Mchunu for the same matter. 'We have opened criminal cases against Minister Mchunu, who is charged with obstructing and defeating the course of justice, abuse of power and criminal conspiracy aimed at undermining lawful investigations,' said party spokesperson Nhlamulo Ndhlela. The party has also opened a case against Mchunu for unlawfully issuing executive instructions to disband the Political Killings Task Team and using intimidation tactics against whistleblowers and law enforcement officers. ALSO READ: Ramaphosa urged to act fast amid explosive Saps feud EFF initiates Parliamentary disciplinary processes Meanwhile, the EFF has submitted an official affidavit to Parliament's Ethics Committee accusing Mchunu of breaching the Executive Members' Ethics Act and the 2014 Parliamentary Code of Conduct. 'The complaint, filed by EFF Chief Whip Nontando Nolutshungu, calls for a full investigation and accountability at the highest level of executive office,' said the party in a statement. Powers and Privileges Committee acts on Visvin Reddy's conduct, referring him to the Disciplinary Committee. He was was ejected from the National Assembly after leading chants for Minister Majodina's resignation amid national water concerns. The Powers and Privileges Committee has referred MK Party Member of Parliament (MP) Visvin Reddy to Parliament's Disciplinary Committee following his conduct during a heated National Assembly (NA) sitting on March 4, 2025. This comes after Reddy was ordered to leave the chamber for repeatedly shouting, 'Pemmy must go,' in a call for Water Minister Pemmy Majodina's removal amid a worsening national water crisis. The committee, chaired by Weziwe Tikana-Gxotiwe, said that while Reddy's conduct did not constitute contempt of Parliament under Section 12 of the Powers, Privileges and Immunities of Parliament and Provincial Legislatures Act, it did amount to misconduct. Tikana-Gxotiwe said the matter was referred to the committee by the Speaker of the National Assembly (NA) in terms of rule 214 of the NA Rules. ' 'The committee will table its report to the NA for consideration.''
