Odisha government seeks change in leased land's status
BHUBANESWAR: Government land leased out to individuals or organisations for non-agricultural, commercial and industrial purposes with 'sthitiban' status in the record-of-rights (RoR) now stand to lose the tag. The state government has instructed all collectors to change the status of the leasehold properties to 'pattadar' in the RoR in a time-bound manner and report compliance with the Revenue and Disaster Management department. The move to rectify 'sattva' (status) in RoR of leasehold government land came in the wake of misuse of such land causing legal issues and increased litigations. 'It has come to the notice of the government that in some cases, lease of government land sanctioned in favour of various organisations, entrepreneurs, industrial and commercial concerns, public sector undertaking, corporation and local authorities for non-agricultural purposes have been wrongly and illegally recorded in 'sthitiban' status in the RoR. This wrong recording of leasehold land is a serious illegality and irregularity and causing serious problems,' the June 19 order of Revenue department said. 'Sthitiban' status is accorded in the RoR only when government land is leased out for agriculture process. However, at the time of execution of lease deed of government land for non-agricultural purposes, the status of the land is recorded as 'pattadar' and not as 'sthitiban'. In such cases, a lease deed is executed by laying down the terms and conditions of the lease and use of the land is governed by such terms, the order issued to all collectors said. 'In order to ensure the integrity of the land records and protect the government land, it is imperative to undertake a careful scrutiny of RoRs relating to leasehold properties of government and rectify those wrong recordings, wherever detected,' additional chief secretary, Revenue DK Singh said in the letter. The collectors have been asked to instruct all tehsildars to verify RoRs of leasehold government land and rectify the records to 'pattadar' status. The additional district magistrate (revenue) will lead this effort and provide a certificate of completion with countersignature of the collector concerned. They have been asked to submit action taken report within a month.

‘e-Registration' mobile app launched by CM Majhi
BHUBANESWAR: In a move to streamline registration process of landed property online and in a transparent manner, the state government on Wednesday launched the 'e-Registration' application which offers a wide range of services from anywhere without having to visit the sub-registrar's office. Launching the Android-based mobile application developed by the Revenue and Disaster Management department at Lok Seva Bhawan here, Chief Minister Mohan Charan Majhi said this is a significant milestone in the state government's digital service delivery. 'Through this mobile application, users can book slots for registration deeds, apply for certified copies, encumbrance certificates, check benchmark land values and a range of other services from the comfort of their homes. The app also provides complete information about the nearest sub-registrar office, details of the property including land description, area, valuation and ownership status of a particular property,' he added. He further said the application will provide all information about applicable stamp duty and registration fees based on the property details. The user can make online payments without visiting the sub-registrar office or taking assistance of any revenue officials or middlemen, he added. With the app making the system paperless and cashless, the CM said people will no longer have to queue up or make multiple visits to the sub-registrar's office. 'The e-Registration app is now available in the Google play store for download and efforts are on to make the app available for iPhone users soon,' Majhi added. Releasing a booklet highlighting the achievements of the Revenue department in the first year, the chief minister said land pattas have been provided to 16,727 homeless individuals through Basundhara scheme and permanent record of rights (RoRs) issued to 20,385 government schools and colleges.

Orissa High Court issues notice to SJTA on Patabola Seva row
CUTTACK: The Orissa High Court has issued notice to the chief administrator of Shree Jagannath Temple Administration (SJTA) in response to a petition challenging its decision to allowing two persons, who are not descendants of original Record of Rights (RoR) holders to perform the sacred Patabola Seva at the 12th century shrine in Puri. Justice RK Pattanaik issued the notice on Wednesday on the petition filed by Santosh Kumar Patra and seven others seeking the court's intervention against the order issued by the chief administrator on June 12, 2025. The petitioners claimed they are Patara Bishoyi Sevaks and descendants of the original RoR holders, who were specifically assigned to look after the Patabola Seva in the temple. According to the petition, Patabola Seva is a ritual service traditionally reserved for hereditary sevaks. It is a sacred secret service whose knowledge is transferred from generation to generation, and the outsiders have no scope to acquire such knowledge. Sevak means any person who is recorded as such in RoRs. During the hearing, advocate Avijit Patnaik, representing the petitioners, argued that allowing the two persons to take part in the Patabola Seva is contrary to section I21 (2) (1) of the Shree Jagannath Temple Act, 1955. The temple administration has encroached upon the religious practice and rights of sevaks, Patnaik contended. In the order on Wednesday, Justice Pattanaik said, 'Considering the facts pleaded on record and plea advanced by the petitioners, the court is inclined to have the response of Shree Jagannath Temple Administration in particular.' The judge issued notice to chief administrator and directed to list the matter on June 25.

Addl commissioner of Revision Court flags land scam, urges action against illegal RoR changes by tehsildars
BHUBANESWAR: The land administration system in the state, particularly in the most sought after capital region, seems to have fallen into a vice like grip of the land mafia and real estate operators with tehsildars playing the role of obliging facilitators. The extent of corruption has been exposed by the additional commissioner of the Additional Revision Court, Bhubaneswar, Pradeep Kumar Nayak highlighting how tehsildars in Khurda district have illegally effected mutations and corrected record of rights (RoRs) by undermining and subverting the law. In a letter (accessed by The New Indian Express) to the additional chief secretary (ACS) of Revenue and Disaster Management (R&DM) department, the additional commissioner of Court-I, II and IV has flagged serious concerns over illegal land mutations and arbitrary corrections in RoRs by the tehsildars of Bhubaneswar and Jatni in connivance with real estate operators and land mafia. 'During hearings in the court, it was found that the tehsildars of Bhubaneswar and Jatni have corrected RoRs involving transaction of the suit land in Sabik (old) RoRs, which is illegal and arbitrary. This undermines the authority of the Board of Revenue and the R&DM department as the illegal mutation is not tenable in the eyes of law and they have clearly guided by pecuniary/extraneous considerations,' the letter stated. Stating that the illegal mutations by tehsildars is nothing but a blatant violation of the Orissa High Court's judgment in Harihar Mohapatra vs Commissioner of Land Records and Survey (OJC No. 9621/1996) case, the additional commissioner said, the judgment clearly prohibits tehsildars from admitting mutation applications related to pre-settlement land transfer transactions that occurred before the final publication of Sabik RoRs. Acting on the verdict, the state government had issued an order in May 1999, restricting revenue officers from entertaining such mutation requests. 'It is a corrupt and criminal practice as there have been cases of illegal settlements/RoR corrections of government land/deity land/common property resources. This amounts to disrespect to law abiding citizens fighting their cases in revision courts and it is a case of criminal conspiracy by tehsildars and builders/land mafia by bypassing Revision Courts,' the letter state.
