HC seeks govt replay on plea for holding students' union polls in MP
Bhopal: The MP high court has asked the counsel of the state govt to take instructions from all the respondents in a public interest litigation (PIL), and file a reply to the petition seeking the court's direction to hold students' union elections in colleges and universities of the state. The state govt, principal secretary, commissioner of higher education, and all the universities in MP are respondents in the petition. Jabalpur-based Adnan Ansari, in his petition, prayed before the court to give directions for resuming students' union elections in the colleges and universities of the state. The petitioner argued that despite the Lyngdoh Committee recommendation and directive of the Supreme Court giving a clear mandate for conducting students' union elections in colleges and universities, elections are not being held in the colleges and universities of the state since 2017. However, Rs 250 is charged in the fee of students in the name of students' union elections. Despite representations given to authorities concerned, students' union elections are on hold, thereby leaving no option but to file a PIL in this regard. Following the initial hearing, a division bench of acting chief justice Sanjeev Sachdeva and justice Vinay Saraf asked the counsel appearing for the state govt to take instructions from all the respondents in the case and file a reply. The case will now come up for hearing on Aug 5. Senior counsel Prakash Upadhyay appeared in the case for the petitioner.

The Madhya Pradesh High Court has issued a notice to the State Government over the rules for the promotion of government employees notified last month. A Division Bench of acting Chief Justice Sanjeev Sachdeva and Justice Vinay Saraf on Monday (July 7, 2025) issued the notice while hearing a batch of petitions filed by various government employees who have challenged the constitutional legality of the Madhya Pradesh Public Service Promotion Rules, 2025. The State Government, on June 17, had approved the rules that had been pending for about nine years, with Chief Minister Mohan Yadav saying that the interests of employees from all categories, including the Scheduled Castes and Scheduled Tribes, were taken care of while framing the rules. The petitioners also sought an interim stay on the Rules. However, the Court has sought the government's response, asking it to clear its stance on the matter before the next hearing, scheduled for July 15. The court also asked the government to clarify the differences between the fresh rules and the existing rules notified in 2002. The provisions under the new rules include 20% reservation for the ST and 16% for the SC communities, while the employees from the two communities will also be eligible for promotions based on merit. MP HC seeks data on action against private hosps violating rules
Bhopal: A division bench of the Madhya Pradesh high court on Monday asked the state govt about the steps taken against private hospitals operating in contravention of rules. The bench of Justice Sanjeev Sachdeva and Justice Vinay Saraf further asked the state govt to hand over the inquiry report of a high-level committee into the fire incident at a private hospital in Jabalpur, in which eight persons were killed. The court also asked the state govt to respond to a questionnaire prepared by the petitioners in the case within two weeks. President of the Law Students' Union, Vishal Baghel, in a public interest litigation (PIL) filed in 2022, said that several hospitals were given permission to operate during the Corona pandemic in contravention of rules. The norms regarding the observance of the National Building Code, fire safety, building completion certificate, and provision of a six-metre open space for the fire brigade in the event of a fire and parking space were disregarded while giving permission to private hospitals to operate. During the pendency of the petition, eight persons were killed in a major fire incident at New Life Hospital in August 2022. A high-level committee constituted by the state govt to probe the incident held local officials of the health department responsible for allowing the hospital to run without the provision of requisite facilities, but no action followed against them. The court has now asked the state govt to inform the court about the action taken against the hospitals operating in contravention of rules and to hand over the probe report to the police for perusal.

Death of horses at Jabalpur farm: MP HC seeks detailed report from collector by Jun 25

Three horses had died at the farm in the last few days, while eight had died in May reportedly due to heat. The court issued the direction while hearing of a petition filed by Jabalpur-based animal activist Simran Issar alleging that one Sachin Tiwari brought 49 horses from HithaNet India Private Limited in Telangana capital Hyderabad and had kept them without documents pertaining to ownership, vaccination, medical history etc. 'Sachin Tiwari has been made respondent in the petition for illegally transporting horses from Hyderabad to Jabalpur in violation of provisions of Prevention of Cruelty to Animal Act. Sachin Tiwari is associated with Suresh Paladugu of HithaNet India Private Limited,' the petitioner's counsel Umesh Tripathi told PTI. HithaNet India Private Limited started an online horse racing betting venture exclusively for Philippines that it ran from Hyderabad Race Club under the title of UnThose Matchup Racing in October 2023, Tripathi said. Jabalpur collector Deepak Saxena had told reporters on June 19 that a committee had been formed under the chairmanship of the district panchayat chief executive officer to find out whether proper care was being taken of horses. HC notices on PIL over liquor sale at inflated rates
Bhopal: A division bench of Madhya Pradesh high court issued notices to respondents in a public interest litigation (PIL) over the sale of liquor at inflated rates, far beyond the MRP. The sale of liquor at prices beyond the MRP is causing financial losses to both the consumers and the state govt, said the petitioner. The department of excise is also complicit with the vendors in allowing the sale of liquor at prices decided by them and not according to the MRP printed on the bottle. A Jabalpur-based advocate, Deepanshu Sahu, in his petition, said that the vendors can't sell liquor at inflated prices without the quiet consent and collusion of the excise staff. It's causing financial losses to both the state exchequer and the consumers of liquor. No tax is paid on the excess amount that is charged from the consumers. If there is a complaint by consumers, the excise staff gets an apology written from the vendor and allows the shop to continue operating and overcharging the consumers. The excise commissioner, commercial tax commissioner of the state, district excise officer, and district collector of Jabalpur are respondents in the case. After the initial hearing, the bench of acting Chief Justice Sanjeev Sachdeva and Justice Vinay Saraf has sought reply of respondents within four weeks.
