Man charged with sexually assaulting own daughters
SEREMBAN: A 45-year-old man claimed trial at the Sessions Court here to three counts of commiting physical sexual assault against his two young daughters. The accused, who works as a shop assistant, pleaded not guilty after the charges were read to him before Judge Surita Budin on Wednesday (July 9). For the first two counts, he was charged with committing the offences against his elder daughter when she was 12 in 2022 and again the following year. He allegedly committed the offences at their rented flat in Senawang between 1am and 2am. For the third charge, he allegedly committed a similar act against his 10-year-old daughter at the same place at around 1am early this year. The accused was charged under Section 14(a) and (b) of the Sexual Offences Against Children Act 2017 which carries a jail term of up to 20 years and whipping upon conviction. Deputy Public Prosecutor Nurul Balkis Zunaidi then offered the accused bail of RM20,000 for each charge pending mention. She also asked that the accused be ordered to stay away from the victims, to report at the nearest police station once every month till the case is disposed of and to surrender his passport to the court, if he had one. She said the alleged victims were now under the care of their mother in Johor. The couple split in 2018. The accused who was unrepresented asked for a low bail as he could not raise the proposed amount. He also told the court he was bankrupt and had defaulted on rent and utility bills. Judge Surita then allowed bail of RM39,000 for all three charges and fixed Aug 11 for mention and to allow the accused to appoint counsel.

Five family members granted bail in teenage kidnapping case, lawyer tells court
SEREMBAN: The High Court has granted bail to five family members charged with kidnapping a 16-year-old girl. Defence lawyer T. Harpal Singh informed Sessions Court judge Surita Budin of the decision when the case was mentioned. Harpal said the High Court allowed each accused to be released on RM15,000 bail with two sureties, both of whom must be family members. He added that the accused were also ordered to surrender their passports (if any), stay away from the victim and prosecution witnesses, obtain a court order before leaving the district, and report to the nearest police station once a month until the case is concluded. On May 14, the Sessions Court had initially denied them bail. D. Sasveena, 31, T. Boharaj, 32, Farhin Muhamad Ariffin, 23, and siblings P. K. Koshenn Kumar, 21, and P. K. Siveeshinaa, 23, had all claimed trial when they were charged on April 24. They are jointly accused of kidnapping the teenager to demand a RM2 million ransom. The alleged offence took place in front of a hair salon on Jalan S2 B10, Uptown Avenue, Seremban 2, at about 5.45pm on April 10. They were charged under Section 3(1) of the Kidnapping Act 1961, read together with Section 34 of the Penal Code. If convicted, they face a minimum of 30 years in prison and whipping. During proceedings today, deputy public prosecutor Norazhiah Asmuni told the court that the prosecution had handed over all relevant documents to the defence, except the forensic CCTV report, the victim's medical report, and the mobile phone reports of the accused. Judge Surita then fixed Aug 5 for the submission of the remaining documents. On April 14, police shot dead a man in Bandar Bukit Tinggi, Klang, Selangor, believed to be involved in the kidnapping.

Lorry driver claims trial to sexual assaulting 12-year-old daughter
SEREMBAN: A 46-year-old lorry driver claimed trial at the Sessions Court here to three counts of committing physical sexual assault against his 12-year-old daughter. The accused pleaded not guilty to all charges after they were read to him before judge Surita Budin. For the first charge, he was accused of committing the offence against the victim at a house in Port Dickson around 9pm in February this year. For the second and third charges, he allegedly sexually assaulted the victim twice around 9pm on May 16 at the same place and time. He was charged under sections 14(a) and 14(d) of the Sexual Offences Against Children Act 2017 read together with sections 16 and 16(1) of the same legislation. Offenders can be jailed up to 20 years and whipped upon conviction. Deputy public prosecutor Nurul Balkis Zunanid then told the court that her team was not offering the accused any bail. However, she said if the court were to allow it, the amount offered should be set at RM50,000 for each charge. Nurul Balkis said the accused should also report to the nearest police station once every month until the case is disposed of, to stay away from the victim and witnesses and to surrender his passport to the court. In pleading for bail, defence lawyer V Segaran said the accused no longer lived in the same house with the accused and that he was not a flight risk as he had surrendered to the police upon receiving news that he was wanted by them. He said the accused only earned about RM3,000 a month, had a family to provide for and would be bailed by his brother-in-law. Judge Surita then fixed bail at RM10,000 for each charge and allowed the other applications by the prosecution. The court fixed Aug 15 for remention.

Teacher ordered to enter defence for sexual assault of student
SEREMBAN: A 47-year-old teacher has been ordered to enter his defence in a charge of committing physical sexual assault against a 13-year-old female student nearly three years ago. Sessions judge Surita Budin ruled here on Monday (June 30) that the prosecution had successfully established a prima facie case against Farid Azhar Nawi. "Based on evidence from prosecution witnesses, exhibits before the court and upon making a maximum evaluation, the court finds that a prima facie case has been established against the accused. "The accused is hereby ordered to enter his defence to the charge," she said. The accused was charged with committing the offence at around 5.30pm on Aug 4, 2022 in the surau of a school in Senawang. He was charged under section 14(a) of the Sexual Offences Against Children Act 2017, read together with Section 16(c). Offenders can be jailed for up to 20 years and caned upon conviction. Surita then fixed July 18 for next mention and Aug 1 and 14 for trial.

Sexual assault case against Seremban teacher fixed for mention on June 17
SEREMBAN: The Sessions Court here has fixed June 17 to mention the case of a 45-year-old counselling teacher facing charges of committing physical sexual assault against two pupils and a third charge for having pornographic material in his laptop. Judge Surita Budin made the decision on Wednesday (May 21) after deputy public prosecutor Nurul Balkis Zunaidi told the court the related medical reports were not ready. "The case will be mentioned on June 17 and bail is hereby extended," she said. On Feb 2, the accused had claimed trial to all three charges. For the first and second charges, he was accused of committing the offences against two 11-year-old boys at a school in Seremban 2. The alleged offences took place in the counselling room in Sept and May 2023. The accused was charged under Section 14(a) of the Sexual Offences Against Children Act 2017, read together with Section 16 of the same law. Offenders can be jailed for up to 20 years and whipped upon conviction. For the third, he was charged with having 180 photographs and clips of children being sexually abused on his laptop. He was charged with allegedly committing the offence at a house in Taman Warisan Puteri on Dec 12, 2023. He was charged under Section 10 of the same Act, which carries a penalty of up to five years' imprisonment, a fine of up to RM10,000, or both, upon conviction. The accused is out on a RM30,000 bail.
