Kuching man gets 12 years, four lashes for incest with 13-year-old niece
KUCHING, July 1 — A 42-year-old man was today sentenced by the Sessions' Court here to 12 years' imprisonment and four strokes of the cane, for committing incest with his 13-year-old niece. Judge Saiful Bahari Adzmi handed down the sentence after the man pleaded guilty to a charge under Section 376B(1) of the Penal Code (PC), read together with Section 16 of the Sexual Offences Against Children Act (SOACA) 2017. Section 376B(1) of the PC provides for a prison term of not less than 10 years and not more than 30 years, along with whipping, upon conviction. Meanwhile, Section 16 of the SOACA provides for imprisonment not exceeding five years, along with a minimum of two strokes of whipping upon conviction. The offence was committed at house in Petra Jaya here at around 2am on April 4, 2025. According to case facts, the victim disclosed the incident to her mother some time later through a phone call, prompting the latter to lodge a police report that led to the accused's arrest on May 30, 2025. The accused is the mother's elder brother. A medical examination revealed old tears on the victim's hymen. Deputy public prosecutor Umi Syukriah Harun appeared for the prosecution, while the accused was unrepresented by legal counsel. For the record, the accused is currently serving a sentence for repeated drug abuse offences. — The Borneo Post

Study casts doubt over theory that Stone Age Ireland was ruled by incestuous ‘god-kings'
Stone Age Ireland was likely not ruled over by incestuous 'god-kings' 5500 years ago, as previously thought, a team of archaeologists has found. A skull fragment unearthed in the tomb chamber of the Stone Age Newgrange monument was previously claimed to have come from a man who was the product of either a brother-sister or parent-child pairing. Coupled with the identification of remains from relatives of this man in other nearby tombs, researchers earlier theorised that incestuous elites ruled Neolithic Ireland. These elites were compared with royal dynasties or "god-kings" who practised incest in other parts of the world, such as the pharaohs of ancient Egypt and leaders of the Inca Empire. Now, a new study published in the journal Antiquity casts doubt on this earlier belief that the kings and other dignitaries unearthed here represented a dynasty that practised incest. Archaeologists from University College Dublin point out that no other incestuous unions have been identified in Neolithic Ireland and Britain, with a lack of evidence for inbreeding across prehistoric Europe. The Newgrange monument is older than Stonehenge and the Pyramids of Giza, and is believed to have been built by a farming community that prospered in the Boyne Valley, County Meath, 5,000 years ago. Analysis of a skull fragment found in the monument, dating to between 3340BC and 3020 BC, revealed a rare case of incest, which led to widespread claims in 2020 that the individual was a high-status ruler, dubbed a 'god-king'. However, researchers now argue that there is no evidence yet found at the site suggesting the existence of a 'king' of Newgrange or any hereditary dynasty. 'People were definitely being selected for burial in passage tombs – the whole community does not end up in these monuments,' archaeologist Jessica Smyth said. 'However, we don't know the reasons behind this selection, and why they were thought to be special.' Researchers say the previous conclusions made in 2020 relied heavily on unsuitable comparisons with hierarchical societies where incest was limited to ruling families, such as in ancient Egypt, ignoring the possibility of incest in non-elite communities. 'A one-off example of incest is a shaky foundation on which to reconstruct an elite, let alone a specific social [hierarchy],' scientists wrote. The tombs clustered in the passages of Newgrange were most likely of people with distant biological relationships rather than close familial ties, researchers say. Based on this, scientists say the burial practices were not strictly determined by lineage. 'We now have some really great examples of monuments elsewhere in Europe that contain people with very close biological ties – parents, children, grandparents etc. This sort of aDNA (ancient DNA) evidence is much closer to the idea of a lineage or dynasty,' Dr Smyth said. 'We do not see this evidence in Irish passage tombs,' she explained. Archaeologists call for more studies to understand the social structures and activities of the communities that built and used the monument. '[It] doesn't make sense to continue to focus so exclusively on forms of stable, individual rule, in Neolithic Ireland and elsewhere, when the evidence is insufficient to support such claims,' researchers said. 'Doing so perpetuates the myth that only important individual males were socially active, and downplays the contribution made by collective action in the prehistoric past,' they added.

Brother jailed for 'depraved' violent sexual abuse committed against sisters over several years
Depraved and violent torture is how an ACT Supreme Court judge has described the actions of a brother found guilty of sexually abusing his two sisters over several years, as he was sentenced to 16-and-a-half years in jail. In December last year a jury found the offender guilty of more than 20 charges including incest, acts of indecency, unlawful confinement and rape. But before the trial even began there were pleas of guilty to at least 10 other similar charges, which included offences against a child under 10 and others against a child under 16, bringing the total number of convictions to 32. Details of the abuse have been suppressed, but Justice Belinda Baker has described the offences as degrading and of the utmost gravity, having a life-long impact on the victims. "They spent their childhoods being abused, or fearing imminent abuse, at the hands of their brother," Justice Baker said. "They both suffer, and will continue to suffer, immensely from the offender's actions. One sister was under 10 for most of the offending, the other under 12. The offender was between 14 and 18. Justice Baker noted a "number of the offences were accompanied by threats and derogatory insults". She said while it was true all sexual offences involve a degree of violence, the offences against particularly the younger sister "involved significant additional physical violence of a depraved nature". In her sentencing remarks Justice Baker also noted any motivation for the offending remained obscure, which was "deeply troubling". The court heard the offences began before the offender was 14, and before he was criminally responsible. In other evidence it was revealed he'd been exposed to pornography, when unsupervised, at a young age, and also suffered mental health issues. "The escalation of the offending to include offences with significant physical violence distinguishes it from cases in which the sexual conduct can be explained by the immaturity of the offender." Justice Baker found that the offender knew what he was doing was wrong by the time he was 14, and continued to offend for years, escalating the violence against particularly his younger sister. Justice Baker sentenced the offender to 13-and-a-half years for offences against one sister, and five years and eleven months for the crimes against his other sister. The sentence is to be suspended after 10 years.

Woman sexually abused daughter to satisfy husband, Perth court told

A woman has gone on trial in Perth for allegedly sexually abusing her daughter in a case her own lawyer has described as "confronting" and "disturbing". The mother, who is now 41, allegedly engaged in sexual acts with her prepubescent daughter along with her husband, who had expressed an interest in incest at an early stage in their relationship. Prosecutor Sean Stocks said the girl, who is now a teenager, was a "sexual plaything" for the mother and her husband, with abuse occurring several times a week after they arrived in Australia. The District Court heard the mother, who lived in another country with her eight-year-old daughter, started communicating with the Perth man online in 2016. Prosecutor Sean Stocks said the mother took photos of her child engaged in sexual acts, and used live-streaming "to satisfy his sexual fantasies". As the complainant grew up, the court heard, the man asked his partner: "What do you think about me liking our daughter the way I do?" "I like that I'm different," he allegedly told her. "I love child incest and child sex". Around this time the mother accepted the man's marriage proposal and she and her daughter moved to Perth. The prosecutor said sexual acts involving the girl started when the man visited the pair in their home country, and continued in Perth. "Two to three times a week for three years," Mr Stocks told the court, with the man eventually using a condom to guard against pregnancy. The mother recorded some of these events, the court heard. The stepfather would tell the girl "how brave she was" when they had sex, the court heard. But the girl had started telling him she was unwell or had homework, in order to avoid being abused. Mr Stocks said she would also try to eat her dinner as slowly as she could, knowing what was to happen after. Police arrested the man in 2021 over an unrelated matter and seized electronic devices, at which point they found an explicit handwritten note from the daughter. The court was told the mother and her daughter moved away from the man, to another suburb in Perth, but the woman still sent intimate photos of the teenager to him. She told police she had sent the photos because he threatened to cancel her visa and send her back to her home country. He also suggested he would commit suicide if she did not comply. "The content of this trial is disturbing and confronting," the woman's lawyer Simon Freitag told the court, describing the stepfather's offending as "evil and persistent". However, he said his client did not accept she had "physically offended" against the girl. He said it would be up to the judge to determine if she was a "willing and conscious party" to the offending. The woman has pleaded not guilty to possessing child exploitation material, producing child exploitation material, sexual penetration of a child under 13 and persistently engaging in sexual conduct with a child under 16. The trial is continuing.
