Caste census gives us an opportunity to examine and reinforce affirmative action

The Centre's decision to enumerate caste in the upcoming census will play a significant role in restructuring the reservation system in India. Reservation breaks occupational homogeneity. Part III (Article 15 and 16) and Part IV (Directive Principles of State Policy) of the Constitution offer scope for introducing affirmative actions. However, even after 75 years since Independence, we are unable to achieve the intended objectives of the reservation policy. Caste-based hierarchy and discrimination are pervasive in government and private sector employment and educational institutions.
Backward Classes Commissions: Looking back
While the Constitution ensured reservation for Scheduled Castes (SC) and Scheduled Tribes (ST), the identification of backward classes was a post-Constituent Assembly phenomenon. Responding to the demands for extending reservation to Other Backward Classes (OBCs), the Congress government in 1953 set up the First Backward Classes Commission under the chairmanship of Kaka Kalelkar, to identify the 'socially and educationally backward' communities. The commission identified 2,399 castes as 'socially and educationally backward' based on their social position in the caste hierarchy, educational advancement, and representation in government services, trade, commerce and industry. As the commission considered caste as the only criterion, instead of economic status, to identify the backwardness, the then Congress government rejected the report and gave the states a free hand to identify the backward classes in their respective regions.
The Second Backward Classes Commission, popularly known as the Mandal commission, under the chairmanship of B P Mandal, was set up in 1979 by the Janata Dal government. The commission did a detailed survey based on social, educational and economic indicators and identified 3,743 castes as backward and recommended reservation in educational institutions and government sector employment. Again, due to its emphasis on caste, the Congress government didn't implement it.
The V P Singh government in 1990 issued an office memorandum for implementing the Mandal Commission Report, and in 1991, when the Congress came back to power, it added 10 per cent reservation for 'other economically backward sections of the people who are not covered by any of the existing schemes of reservation' along with 27 per cent reservation for OBCs. In Indra Sawhney vs Union of India (1992), the Supreme Court of India upheld the 27 per cent reservation for OBCs but rejected 10 per cent reservation for EWS as economic status cannot be the sole criterion for reservation without the evidence of structural discrimination. Further, it added that EWS as a reservation category cannot be created through an office memorandum. This is why the current government created EWS reservation through the 103rd Constitutional Amendment. The Supreme Court also interpreted the word 'Class' in article 16(4) as 'Social Class' and not economic status-based 'Marxist Class'.
The Court identified two important criteria for providing reservation to any social class. One is a test of backwardness, and another is a test of inadequate representation. Such interventions historically made significant changes, but we are still far away from achieving the core objectives of affirmative action.
Caste census and reservation
The All India Survey on Higher Education (2021-22) report details the representation of different social groups in government and private educational institutions in India. The dismal representation of the marginalised communities in the teaching positions of higher education institutions opens the cracks in the system. In public universities, only around 10.8 per cent of teachers are from SC community, whereas for STs, the share stands at merely 3.4 per cent, and for OBCs, it is 21 per cent. However, the general category represents around 49.3 per cent of teachers in public universities and 60.7 per cent in private universities. Across Union and state public universities, along with affiliated and constituent colleges, SC teachers represent 9.6 per cent, STs 2.6 per cent, and OBCs 34 per cent. In contrast, the Minister of State for Social Justice and Empowerment, Ramdas Athawale, during a reply in Rajya Sabha in 2021, said that 97 per cent of manual scavengers in India belong to the Dalit community.
Caste based notions are so entrenched that it becomes very difficult for the marginalised communities to get employed, even if they are well qualified. In 2007, while studying the employability of the non-general castes, Sukhdeo Thorat and his team sent out resumes to private companies in Delhi based on newspaper advertisements. All the resumes had similar qualifications and skills. But the Hindu upper caste names received more calls for interviews compared to Dalits and Muslims. Surinder Jodhka and Newman's study in 2007 also revealed how the HR managers insist on certain factors like family background and locality, instead of directly asking for the caste of the candidates.
These experiences show that we need to implement reservation even in the private sector to combat such constraints. A census that enumerates caste is an opportunity to strengthen the reservation system to create an inclusive society. But at the same time, it can strengthen the numerically dominant communities politically, which may affect the rights and opportunities for numerically non-dominant communities. We must be prepared to handle the political outcomes.

The Supreme Court on Friday issued notice on a fresh petition seeking enforcement of a Madhya Pradesh law providing 27% reservation to the other backward classes (OBC) in state employment but refused to pass any interim directions noticing that the matter is already pending in the top court. SC issues notice on plea seeking enforcement of 27% OBC law in MP A bench of justices PS Narasimha and R Mahadevan, sitting during the partial court working days, passed the order seeking response of the Madhya Pradesh government on a petition filed by 18 people belonging to the OBC community, led by petitioner Nishchay Sonbirse. The petition argued by advocate Varun Thakur pointed out that in 2019, the MP government brought amendment to the Madhya Pradesh Lok Seva (Anusuchit Jatiyon, Anusuchit Jan Jatiyon Aur Anya Pichhade Vargon Ke Liye Arakshan) Adhiniyam, 1994, increasing reservation benefits in jobs for OBCs from the existing 14% to 27%. Thakur said that prior to enactment of the Act, the same law was introduced by way of an Ordinance that was challenged before the MP high court by a final-year MBBS student. On her plea, an interim order was passed on March 19, 2019 directing that the counselling for NEET-PG examination of 2019 will be conducted as per the old law providing for 14% OBC reservation. He stated that despite the Ordinance becoming law, the interim order has been continued by the executive arm of the state without there being any stay or interim order passed by either the high court or the top court. The bench said, 'We are not going to grant you any interim order. Very reluctantly we are issuing notice. We will only post the matter along with the batch of matters pending before this court.' In 2022, the state of Madhya Pradesh had filed a transfer petition before the top court. Subsequently by an order of the court, all petitions pending before the high court stood transferred to the top court where the matter is still pending. Solicitor general Tushar Mehta appearing for the state opposed the petition pointing out that already the issue is under consideration in the transfer petition filed by the state. He questioned the need for adding yet another petition to the bunch of cases where the validity of the law has been challenged. Thakur pointed out that the pending batch of cases only challenge the Ordinance. However, the Act has not been challenged so far. However, lawyers appearing in the matter refuted this claim pointing out that even the 2019 Act by the state introducing 27% reservation for OBC in public employment is pending before the top court. Thakur said that the implementation of the 2019 amendment remains uncertain and sought a clarification from the court giving effect to the law. The petition filed by him said, 'The legislation has neither been struck down nor declared unconstitutional by any court of law. In fact, no interim order has been passed by this court or the high court of Madhya Pradesh for restraining enforcement of the law.' He stated that the operation of the statutory provision cannot be stultified by granting an interim order except when the court is fully convinced that the particular enactment is unconstitutional. He questioned the executive for not acting upon the legislation in the absence of any order restraining them from doing so.

Hyderabad: Telangana BJP chief N Ramchander Rao criticized the Congress regime, alleging extreme injustice toward Backwards Classes (BCs), Scheduled Castes (SCs), and Scheduled Tribes (STs). He said on Friday, Congress has effectively undermined democracy through the imposition of Emergency, and its slogans—'Jai Bapu,' 'Jai Bhim,' and 'Jai Samvidhan'—have betrayed their true meaning due to the party's actions. Congress has violated justice and constitutional values, he added. Ramchander Rao said that the Congress party continually deceives the people with empty slogans. On the other hand, its true agenda works against them. By claiming to support a 'Samajika Samara Bheri,' Congress is trying to mislead the people of Telangana once again. He asked, 'How will this government, which has failed to fulfil a single promise in its one-and-a-half-year rule, justify its actions to the public?' The State BJP chief pointed out that the Congress party, while chanting 'Jai Bapu,' has, however, weakened Gandhiji's vision of village self-government. 'Their failure to hold local body elections in the state and the pending Rs. 1,200 crore for village development work are against the spirit of Gandhiji's principles,' he said. Moreover, while asserting 'Jai Bhim,' Congress has actually taken tribal lands in areas like Lagacharla and Kondagal, sent bulldozers onto uncultivated lands, framed cases against ST farmers, and closed down Gurukuls. Before they chant 'Jai Samvidhan,' the Congress party must acknowledge its own history. The party that imposed the Emergency in 1975 and undermined democracy has no right to preach about the Constitution. Mallikarjun Kharge is visiting Telangana on Friday, as if all of this has been forgotten. The crucial question on the minds of the people is clear: 'With what face is the Congress party holding this meeting? What more is left to exploit? Karnataka, Himachal Pradesh, and Telangana have all become endless vessels for Congress's looting.' The Congress government, which announced six guarantees and thirteen promises in Telangana, has yet to fully implement any of them. Is it social justice for Congress to harm BCs under the guise of a caste census and include Muslims in the BC quota? Their promises are merely words, and this government's intention appears to be deceiving the people with false slogans. Congress is not holding this meeting for the sake of social justice but rather to undermine it. The people of Telangana will not be misled again.

The bench refused to stay the HC order but asked the UGC and the public interest litigation petitioner before the HC to respond to TN's petition in four weeks. For UGC, solicitor general Tushar Mehta said the law is palpably contrary to the UGC Regulations which empower only governors to appoint VCs to the universities. When the senior advocates pleaded that they would argue before the HC for vacation of the stay, Mehta said that in that case the TN must withdraw its petition seeking transfer of the PIL from Madras HC to the SC. 'The state cannot have both options open at the same time and be permitted to argue before the HC that the SC is considering transfer of the PIL to itself,' he said. Justices Narasimha and Mahadevan said this request would be considered by the SC during the final hearing on the TN's petition. The HC 'showed undue haste', did not even give a week's time to the state to file its counter affidavit, and passed the stay order 'for extraneous reasons', it said, adding that the impugned order is replete with personal attacks on the senior counsel who appeared for the state.
