
Beaten up at police station in Ghaziabad, says man; cops claim drunk driving
A subsequent medical examination confirmed that the man had consumed liquor, police said.
In a video shared on social media, Hariom, a resident of Bulandshahr, claimed that he was stopped by police officers shortly after picking up a friend, who was coming from Delhi with cancer medication. He alleged that despite showing the necessary documents, the cops misbehaved with him and his friend.
ACP (Modinagar) Gyan Prakash Rai said a complaint was received via social media from Hariom. Upon investigation, it was found that on June 28, a campaign was underway against public drinking and drunk driving. When the police enquired about the documents, the person failed to provide them and began misbehaving. Police added that their bike had a modified horn. Therefore, the vehicle was seized under relevant sections of the Motor Vehicles Act and they were booked under Section 34 of the Police Act, later released as per procedure.

Delhi man shot dead near Gurgaon's Kherki Daula Toll Plaza; second shooting incident in SPR area in 3 weeks
A Delhi resident was shot dead in Gurgaon Monday night in what is the second incident involving a shooting in public in the Southern Peripheral Road (SPR) area in three weeks. The deceased has been identified as Rohit Shokeen, 39, son of Mahaveer Singh, a resident of Kamruddin Nagar in Delhi's Nangloi, which comes under the Nihal Vihar police station limits. He was gunned down off the SPR Road close to Kherki Daula Toll Plaza in Sector 77 at around 9 pm, the police said. 'The incident is believed to have stemmed from a long-standing property dispute,' a spokesperson for the Gurgaon police said early on Tuesday. 'A detailed investigation is underway to ascertain the circumstances behind the murder. A First Information Report (FIR) will be registered, and further action will be taken based on the evidence collected,' the spokesperson added. According to the police, Shokeen sustained three gunshot wounds. He was rushed to a nearby hospital after Virender Saini, Assistant Commissioner of Police (ACP), Manesar, and multiple police teams reached the site after receiving information about a wounded man. Shokeen was declared dead on arrival at the hospital, sources indicated. Authorities have yet to make any arrests in this connection, but police teams remained at the site until at least midnight. The development comes a little over a fortnight after Haryanvi singer-rapper Rahul Fazilpuria, 35, was shot at in the Southern Peripheral Road section near Badshahpur in Gurgaon's Sector 71. He had escaped unhurt in the incident. Fazilpuria was allegedly standing near his SUV when the attackers arrived in another car and opened fire. Soon after, the singer got into his car and sped away. The attacker could not chase him due to the traffic, and he reportedly managed to escape. According to Fazilpuria, the attackers fired at him multiple times, but he was not injured and his vehicle was not damaged. Soon, the police arrested a Sonepat resident who allegedly carried out the recce for the shooting. Later, a post surfaced on social media in which a person claimed responsibility for the shooting and said it was the fallout of a financial dispute involving Rs 5 crore that the singer had allegedly not repaid. CCTV footage had also emerged of a Tata Punch car following the singer prior to the shooting.

In motor accidents, claims not restricted to third party in Supreme Court
Motor vehicle insurance protects a policyholder against claims made by a third party for damages due to the policyholder's actions, but what about a claim against injury/death of policyholder in an accident? Holding that family members of such a policyholder can also claim compensation, the Supreme Court has referred the issue to a larger bench given contradictory prior judgments on the matter. While hearing the compensation plea of a minor girl who lost both parents in a car accident, the SC said section 163A of Motor Vehicles Act could be invoked for such a claim, as it is a special provision which overrides not only the rest of the Act but also any other law in force. The minor had been awarded payout by the insurance company for the death of her mother but not for her father as he was himself the insured party. The insurance company held that the petitioner, legal heir of deceased vehicle owner, cannot at the same time be the liability holder and recipient of compensation. The bench said: '… Section 163A is not restricted to third party claim; without any requirement of establishing negligence, if death or permanent disability is caused by reason of motor accident'. 'It would override Sections 147 & 149 along with other provisions of the Act and the law regulating insurance as also the terms of the policy. This according to us is the intention of incorporating the non-obstante clause under Section 163A providing for no-fault liability claims '.

Merc belonging to bizman runs over sweeper near Chowpatty, driver arrested
MUMBAI: A sweeper sleeping on a footpath near Girgaum Chowpatty was run over by a Mercedes E 200 owned by a leading industrialist who manufactures and distributes food products and edible oil. According to the Gamdevi police, the chauffeur, who was allegedly driving at the time, did not notice the man asleep in front of a shop, and fled from the spot after the accident. It was only after checking CCTV footage that the vehicle was identified, traced and the accused was arrested. Dharavi resident and BMC worker Jadish lost his life when a Mercedes car hit him while he was sleeping near the Oriental Club in Mumbai.(HT Photo) On Friday morning, the police were informed that a man sleeping near the BMC's Babulnath Chowki—just outside the Oriental Club gate near Girgaon Chowpatty—was lying motionless. The gate is common to the club and Noor Mansion, where the industrialist stays. 'The call was from Sanjay Gohil, a contractor of the club,' said a police officer. 'When the man was rushed to Nair Hospital in Mumbai Central, the doctors informed us that he was dead due to shock and haemorrhage after suffering multiple fractures in his ribs.' The police then began their investigation and went through the CCTV footage of the locality. 'By then, the club staff and the society workers identified the man as Jagdish, who lived in Dharavi and worked with Parvati Kaliyan (39), a BMC sweeper,' said the police officer. 'Parvati has a job in D Ward for the last 25 years, and farmed out work to the deceased right from then. Originally from Uttar Pradesh, he was well known in Bhuleshwar, as he would sweep the area with Parvati.' The police officer said that after checking the CCTV footage, they found that a Mercedes that was going towards the club/Noor Mansion gate had run over him while taking a turn. 'We identified the car registration number from the footage and contacted its owner,' said the police. 'He claimed that the vehicle was being driven by their chauffeur Kamlesh Tripathi Jha (39) at the time. Jha stays in a slum pocket near the Mahalaxmi temple.' The officer said that offences had been registered against Jha under Sections 106 (1) (causing death by negligence) of the Bharatiya Nyaya Sanhita and 134 (duty of driver in case of accident and injury to a person) of the Motor Vehicles Act. 'He was arrested and was later granted bail by the court,' he added. Parvati said that Jagdish had worked with her for the last 25 years. 'He was like a brother to me,' she said. 'I carried out his last rites, as we don't know where his family lives in Uttar Pradesh, nor do we have any phone numbers. He used to drink and sleep on the footpath. Jaggu was well known in Bhuleshwar.' The police said they had seized the Mercedes involved in the incident.
