Stem cell transplant: Insurance company told to reimburse Rs 4 lakh to liver cirrhosis patient
Surat: The consumer commission in Valsad has ordered an insurance company to pay a Rs four lakh claim for stem cell therapy administered to a liver cirrhosis patient, stating that it was a life-saving treatment. The company rejected the claim citing the policy clause, which did not cover stem cell therapy except in certain conditions. However, the Valsad Consumer Disputes Redressal Commission (CDRC) ruled that the insurer misinterpreted the clause to avoid payment. According to details, the Valsad resident was employed as a mutual fund advisor at a private asset management company. He purchased a group health insurance policy covering him and his family for a sum of Rs four lakh for a year starting September 7, 2022. The policyholder was admitted to a private hospital in Ahmedabad for stem cell treatment on May 19, 2023, and underwent a stem cell transplant for liver cirrhosis. On August 18, 2023, the company rejected the claim under clause 28, which states that stem cell therapy surgery is allowed only in haemopoietic stem cells for bone marrow transplant in haematological conditions. The policyholder approached the consumer commission on November 20, 2023. During the hearing, the company's advocate argued that the exclusion clause clearly stated that such treatment claims were ineligible under the policy terms, and the application should be rejected. Conversely, the complainant's advocate contended that the insurer misinterpreted the clause in rejecting the claim. The complainant received treatment as an indoor patient as directed by the doctor, and the letter regarding the treatment was submitted to the insurance company on September 13, 2023. The letter stated: 'Diabetes and liver cirrhosis were treated with stem cell therapy for his serious health condition, and diabetic condition occurred after corona. .. Reports indicate liver cirrhosis." However, the company did not accept the letter. After considering the arguments and documents, the commission observed: "The specific exclusions (28) mention – treatment for alopecia, baldness, wigs or toupees and all related treatments." However, the transplant was done to save his life, the commission noted. The forum also noted that the insurance firm failed to provide any expert opinion on the complainant's treatment. "Reviewing the documents, it appears that the firm wrongfully rejected the claim to avoid payment." Consequently, the commission ordered the firm to pay Rs 4 lakhs with 8% interest from January 2023 and Rs 3,000 for harassment.

Mumbai's St George's Hospital gets licence to perform affordable liver transplants
Mumbai: State-run St George's Hospital near CSMT, on Thursday, received a licence from the health department to perform liver transplants. The hospital will offer liver transplants, considered one of the most complex surgeries, at an affordable cost. "There is a meeting to finalise the costs next week," said St George's Hospital Medical Superintendent Dr Vinayak Sawardekar. Incidentally, the transplants will be conducted by a joint team of doctors from the public hospital, as well as a team led by Dr Ravi Mohanka from H N Reliance hospital applied for the state licence last year and now awaits registration with the various transplant committees. "As soon as we get the registrations done and receive a cadaver donation, we will be able to start on the transplant programme," Dr Sawardekar added.

Post-HC directions, Chandigarh drafts Rs 10,000 monthly aid scheme for disabled acid attack survivors
In response to the Punjab and Haryana High Court's directions for ensuring meaningful rehabilitation of acid attack survivors, the Chandigarh Administration has submitted that it has framed a scheme, SAHAS – Support and Assistance for Healing Acid Survivors, to provide Rs 10,000 per month as financial aid to survivors who have been rendered disabled. According to the draft scheme, only residents of Chandigarh will be eligible for this aid. The affidavit was filed by Anuradha S Chagti, Secretary (Social Welfare), Women and Child Development Department, stating that the scheme has been finalised and sent for approval to the competent authority. 'The concurrence from the Finance Department has been received and the funds are available under the state budget to extend the necessary support,' the administration said. SAHAS provides for a monthly financial assistance of Rs 10,000 sent to beneficiaries' bank accounts through Aadhaar-based direct benefit transfer (DBT). The affidavit was submitted in response to a contempt petition filed by advocate H C Arora, who had sought implementation of long-pending court directions for victim support. Submitting its response to the court, the administration concluded: 'The deponent has the highest regard for this Hon'ble High Court and cannot ever think of disobeying its orders.' It requested dismissal of the contempt petition in the light of the steps taken. The administration stated that medical aid and interim relief are already available for survivors under an earlier scheme notified by the home department, and SAHAS is an additional initiative. Applicants must provide a disability certificate or a Unique Disability Identity Card (UDID) confirming the disability was caused by an acid attack. Applications can be submitted by the survivor or, in cases of severe disability, by a family member or legal heir. Other required documents include a copy of the FIR, Aadhaar card, proof of residence, bank account details, and an annual life certificate. The administration said all applications will be processed within a month, and the payments will begin from the first day of the following month. The scheme also allows for appeals in case an application is rejected. Aggrieved persons can approach the secretary of the social welfare department for redressal.
