Rehabilitation of homeless with psychosocial disabilities sensitive issue: SC
New Delhi, Jul 25 (PTI) The Supreme Court on Friday said the rehabilitation of homeless persons suffering from psychosocial disabilities was a sensitive issue and directed the Centre to take it up 'very seriously".
The Centre informed a bench of Justices Vikram Nath and Sandeep Mehta that authorities were already deliberating the matter with meetings being underway.
The government counsel sought eight weeks' time to update the court on the progress achieved.
'You need to take it very seriously and as less time as possible," the bench said.
The apex court was hearing a plea filed by advocate Gaurav Kumar Bansal for directions to formulate and implement a policy for the homeless suffering from psychosocial disabilities.
The top court had in April sought responses from the Centre and others on the plea.
Psychosocial disabilities refers to the challenges people with mental health issues face due to discrimination, lack of support, among others.
On Friday, Bansal said the Centre had filed a counter affidavit in the matter.
The bench noted a brief reply was on record.
'We are already deliberating. Meetings are going on. I am praying for eight weeks time to place on record the progress so far," the Centre's counsel said.
Bansal said the homeless were 'literally becoming football" and the police ought to do something for their rehabilitation under the law.
He said women were among several homeless persons and there was negativity from the police side in such cases, especially due to the lack of a proper rehabilitation programme.
'We are expecting response of the government on all these issues. Let them come back and then we will monitor it. We will try and take it to a logical end," the bench said.
When the Centre's counsel referred to the Mental Healthcare Act, 2017, the bench observed, 'Acts are there. Where is the execution, where is the compliance".
The top court posted the matter on September 22.
The plea has sought directions to frame and implement the standard operating procedures for key stakeholders, including departments of law enforcement (police department) and medical health, to ensure the humane and effective handling of homeless persons with psychosocial disabilities.
The plea highlighted the issue faced by homeless persons with psychosocial disability who instead of being provided with appropriate care are often subjected to neglect, social isolation, and physical and sexual abuses.
'Despite existing legal and policy frameworks, including the Mental Healthcare Act, 2017 and National Mental Health Policy, 2014, respondents have failed to operationalise the provisions intended to protect and assist homeless individuals suffering from mental illness," it added.
The petitioner said the lack of a structured national policy on homelessness and mental illness has resulted in a 'complete breakdown of the system, leaving thousands of individuals to fend for themselves" without access to medical care, shelter, or social entitlements. PTI ABA ABA AMK AMK

Bhagwant Mann (PTI) Punjab chief minister Bhagwant Mann on Sunday said his government will open 200 new Aam Aadmi Clinics in the state, taking the total number of such healthcare centres to 1,081. Earlier, Mann launched a WhatsApp chatbot for the clinics. "It is a historic day in the healthcare sector of Punjab as a total of 881 Aam Aadmi Clinics across the state have been connected to a WhatsApp chatbot," said Mann. These clinics cater to nearly 70,000 patients daily, and in today's digital age, the chatbot will be most beneficial for patients, said Mann. Mann said the initiative is expected to bring revolutionary changes in healthcare services as approximately 90 per cent of Punjabis own a smartphone, and they can now be directly reached through WhatsApp. "Patients will receive complete health-related information via WhatsApp, and doctors' prescription slips will be accessible through the chatbot," said Mann. Diagnostic test reports will also be shared, and patients will receive reminders about their next consultation dates from the doctor, he said. Regular WhatsApp updates will be provided on care for elderly people with diabetes or blood pressure, pregnant women, and newborns, Mann said, adding that it will eliminate the need for patients to physically store prescriptions or medications, as they can access the information anytime on the messaging platform. Most importantly, Mann said patients can instantly share their reports with family members or consult another doctor through WhatsApp. The chief minister said the health department will also maintain a digital database of patients, their ailments, and treatments. "Punjab will soon be launching 200 more Aam Aadmi Clinics to ensure quality healthcare services for all," he said, adding that the state government is committed to providing free medical treatment to every citizen. Punjab is also the first state in the country to implement the 'Mukhya Mantri Sehat Yojana', which provides medical treatment of up to Rs 10 lakh per family, he further said. Targeting the previous governments, Mann said in the poll manifestos, there was no mention of the health sector, due to which people were left to fend for themselves. He said the situation had deteriorated to the point where patients suffering from serious illnesses in villages did not even want to seek treatment because the high cost made them hesitant to push their families into debt. It is the duty of governments to provide quality health services free of cost, and they are fulfilling this responsibility with dedication, said Mann. Stating that the Punjab government is making significant efforts to turn the state into a medical hub, he informed that approval has been given for the establishment of four new medical colleges in Kapurthala, Hoshiarpur, Sangrur, and Nawanshahr. He claimed that due to several "pro-people' decisions, the people's trust in government institutions is increasing. Many children have shifted from private schools to the 'Schools of Eminence', he said, adding that this year, 208 students from government schools have cleared the prestigious JEE Advanced exam, and over 800 students have successfully passed the NEET exam. Calling the Road Safety Force (RSF) a life-saving force, Mann said hundreds of lives have been saved since its inception. He said when he was a member of Parliament, data indicated that more than 5,000 lives were lost annually in road accidents in Punjab. The formation of the RSF has led to a 48 per cent reduction in such deaths, setting an example for other states as well, he said, adding that the force consists of specially recruited and trained personnel, including women, and is equipped with 144 modern vehicles.

Activists and experts hail Supreme Court focus on mental health
Kolkata: Mental health activists and experts have welcomed the Supreme Court's explicit recognition of mental health as an integral part of the constitutional Right to Life under Article 21. The SC recognised the right to mental health as an integral component of the right to life under Article 21 while laying down binding guidelines for educational institutions and coaching centres across India. The observation was made in a case related to the death of a 17-year-old student undergoing coaching for the NEET examination. The apex court set aside orders of the Andhra Pradesh HC to allow transfer of the investigation into the death under suspicious circumstances to CBI. Mental health activist Ratnaboli Ray, who is the founder of Anjali, a rights-based organisation, said the order moves mental health from the realm of welfare or charity into the domain of legal and constitutional rights. "This means that the state and institutions are no longer simply encouraged but obligated to ensure mental health protections as part of their duty under the Constitution," said Ray, a psychologist by training. Ray also pointed out that by issuing guidelines for students' welfare in the context of mental health, the court has acknowledged the growing mental health crisis in educational spaces — ranging from anxiety and depression to suicide. This makes schools and universities potentially accountable for creating psychologically safe environments. Advocate Arush Sengupta said embedding mental health under Article 21 makes it justiciable. This also strengthens the implementation of the Mental Healthcare Act, 2017, which already defines access to mental health services as a right, but until now lacked the direct constitutional force to ensure consistent and widespread enforcement," he said. Psychiatrist Aniruddha Deb felt the ruling has the potential to transform institutional accountability, public funding, and societal attitudes in India. "This is a landmark judgment. Till now, mental illness was perceived as a disability, a dysfunction and looked down upon. People with mental illness were relegated to second-class citizens. They were even denied right to vote. Being of unsound mind precluded them from holding any office. All that will change now," said Deb. Ray added that the moment demands bold, rights-affirming governance, not piecemeal or tokenistic gestures. "The judiciary has spoken. It is now the executive's responsibility to institutionalise this vision into everyday governance so that mental health is not only constitutionally protected, but meaningfully lived," she added.
