PAR talks pharmacy bill, possible Medicaid cuts

Prescription costs and pharmacy benefit managers (PBMs) were a target at the tail end of the 2025 legislative session that ended earlier this month.
In the aftermath, three lawmakers joined the Public Affairs Research Council of Louisiana on a webinar last week to discuss the regular session: Senate President Cameron Henry, House Criminal Justice Vice Chair Vanessa LaFleur and House Appropriations Chairman Jack McFarland.
Several bills were discussed, including House Bills 264 and 358. These bills focus on PBMs, the middlemen between drug manufacturers and health insurance providers.
HB 264, which was passed by the state senate, places new restrictions on PBMs to ensure transparent practices and increase pharmaceutical savings for customers. The legislation requires PBMs to pass rebates and discounts onto customers and prohibits PBMs from sending customers to their pharmacies.
The bill, HB 358, was halted in the state senate in the last hours of the regular legislative session after the state senate opted to not introduce the legislation. HB 358 would have prohibited the Louisiana Board of Pharmacy from renewing or granting permits for pharmacies owned or operated by PBMs, ultimately banning PBMs from owning retail pharmacies in Louisiana.
HB 358's provisions would not have taken effect until Jan. 1, 2027. Henry said the long implementation period gave some lawmakers pause, stating the bill died at the state senate primarily because the bill 'didn't go through the normal legislative process.'
'There wasn't committee hearings on the senate side of the house side, no public testimony, the most basic things you need to do when you're doing something of this magnitude that's going to affect literally everyone across the state,' he explained. 'At the end, that late day, being that late in the sessions, having an implementation date that long out, members really feeling uncomfortable … let's study the effect of this.'
Proponents of the bill believe the move will lead to lower pharmaceutical drug costs. But those opposed said the closure of pharmacies in Louisiana would disrupt healthcare, worsen health outcomes and increase drug costs for patients, according to a Pharmaceutical Care Management Association release.
Gov. Jeff Landry took to social media the day after the legislative session ended to declare his plans for a special session to 'lower your drug prices.'
Henry said a special session to address HB 358 is unlikely.
The state senate did pass a resolution requiring the Louisiana Department of Health to study the potential impacts of HB 358, which must be completed before the 2026 regular legislative session in March.
Federal Medicaid Changes
However, Henry said to expect a special session if the over $90 billion cuts to Medicaid included in the 'Big Beautiful Bill' is passed with no implementation period.
Nationally, there are particular concerns about the $400 billion cut to provider taxes that fund Medicaid for 49 states. For Louisiana, the loss could total $4 billion, which would have 'devastating' effects on rural hospitals and medical providers, he said.
'We can't handle a huge drop immediately. What we'd do there would not be pleasant, but we have to do it.'
House Criminal Justice Vice Chair Vanessa LaFleur echoed Henry, stating that budget cuts would have to be made in special session if the Medicaid funding is immediately pulled.
'As much as I don't like the idea, if it happens the way we anticipate, we'll be back in special, we'll be making cuts because we have to. It's just the unknown.'
Henry has been in touch with U.S. Sen. Bill Cassidy, U.S. House Speaker Mike Johnson, and U.S. House Majority Leader Steve Scalise to warn them of the potential negative impact of Medicaid cuts on the state.
'They're aware of it, but they're also aware that the rest of the country wants changes,' he said. 'The idea of waste, fraud and abuse sounds good, but it all depends on how you define it.'
A two-to-three-year implementation period with the opportunity for amendment is 'the most realistic thing we can ask our delegation.'

Senate, House GOP poised for clash on green energy tax credits

The Senate's more flexible approach to rolling back green energy subsidies is putting the upper chamber on a collision course with the conservative House Freedom Caucus. The Freedom Caucus, a powerful right wing bloc, has said it will 'not accept' any changes that 'water down' the dramatic cuts to the tax credits passed by the House. And while draft legislation from the Senate this week does still deliver significant reductions in these subsidies, at least one key Freedom Caucus leader is already saying it's not good enough. 'Yeah, I will not vote for this,' wrote Rep. Chip Roy (R-Texas) in a post on X, referring to the Senate bill's tax credit provisions. On a call with reporters on Tuesday afternoon, Roy indicated that he was willing to play hardball. 'They either fix it or they don't have my vote,' he said. 'The president rightly campaigned on terminating the Green New Scam subsidies. It's destroying our grid. It's subsidizing China.' He added that he wants to end 'not just the solar and wind credits, but all of them,' including credits for emerging technologies such as carbon capture and sequestration. Roy did say he'd be open to a 'possible exception' for nuclear, given the level of regulation faced by that industry. 'The only reason I voted for the House bill in the end was that we got those significant wins on the Inflation Reduction Act Green New Scam subsidies. You take those away and water those down, and I'm out,' Roy said. With the House version of the bill passing by just a one-vote margin, any further fractures in the lower chamber could jeopardize the bill's future. Both Senate and House moderates have argued that the House bill goes too far in its repeal of the Biden-era tax credits for climate-friendly energy sources. Despite the push from House moderates, Roy and his Freedom Caucus colleagues successfully pushed the bill rightward in the lower chamber. It's not entirely clear who would win out between the House conservatives and the Senate moderates who have themselves warned against a 'full scale' repeal of the credits. The issue is one of several that threatens to hold up passage of President Trump's 'big, beautiful bill.' GOP gulfs over Medicaid and federal tax deductions in areas with high state and local rates also persist. The House took a sledgehammer to the green energy tax credits, including by stating that only renewable projects that begin construction within 60 days of the bill's passage would remain eligible. The Senate version extends this timeline, allowing projects that begin construction this year to get full credit while projects that start construction next year would get 60 percent. It also axes House language that would have required energy projects to start producing electricity by the end of2028 to get the credit. Freedom Caucus member Rep. Josh Brecheen (R-Okla.), also raised concerns about the changes in a text to The Hill. He cited analysis from fossil fuel advocate Alex Epstein, who said on X that basing the credit solely around a project's construction rather than energy production could mean that companies are able to claim the credit for years longer, including after President Trump's term is up. Brecheen said he's 'hopeful those in [the] Senate and the American people realize over 10 different times since 1992 …Congress promised to phase out the Production Tax Credit, and every time Congress has not kept [its] word,' referring to one of the tax credits for low-carbon energy sources. 'We have to ensure we do this while President Trump is president to ensure it happens. Any promise to end beyond his term as president will turn out to be a mirage,' he added. While conservative Republicans have sought as drastic as possible cuts to the incentives for climate-friendly energy sources, their more moderate counterparts have argued that doing so could be disruptive for U.S. companies that are trying to make investments in domestic energy production. Sen. Thom Tillis, who was part of the group that called for a 'targeted, pragmatic approach to the credits,' told E&E News this week that he was 'generally satisfied' with what the Senate put together. The language in the Senate bill is still expected to represent a massive cut to green subsidies, just not as dramatic a cut as in the House. 'The Senate Republican bill does almost 90 percent…as much damage as the House proposal did,' said Sen. Ron Wyden (D-Ore.), the architect of the tax credits Republicans are now seeking to dismantle, during a Tuesday webinar. 'Let's not get too serious about this new Senate bill being a kinder, gentler approach,' he said. 'Projects all over the country are being canceled.' Trade groups representing renewable energy companies also said that the legislation would still significantly harm the renewables sector. 'Despite modest improvements on several provisions, this legislation does not go far enough to remove the threat to one of the greatest economic success stories in American history. As drafted by the Senate Finance Committee, this proposal would pull the plug on homegrown solar energy and decimate the American manufacturing renaissance,' said Abigail Ross Hopper, president and CEO of the Solar Energy Industries Association, in a written statement. —Mychael Schnell contributed to this post, which was last updated at 5:03 p.m. EDT. Sen. Lisa Murkowski (R-Alaska) labeled the process that brought her to vote for the GOP's gargantuan tax and spending package 'agonizing' and said she hopes more is done to improve the bill, including through both the Senate and House going to conference to finalize it. Murkowski told reporters after the vote that she 'struggled mightily' with the impact cuts to Medicaid and the Supplemental Nutrition Assistance Program (SNAP) could have on vulnerable populations. 'Reconciliation is never a very dignified process. We all get that,' she said. 'This is probably the most difficult and agonizing legislative 24-hour period that I have encountered, and I've been here quite a while and you know I've got a few battle scars underneath me,' she added. The moderate Alaskan emerged as a crucial 50th vote for Republicans and was at the center of negotiations throughout Monday night into Tuesday morning. GOP leaders worked to rewrite sections of the legislation important to Murkowski — including carve-outs for Alaska in Medicaid and SNAP funding cuts — to pass muster with the Senate parliamentarian and ultimately agreed to double the rural hospital fund to $50 billion. Murkowski ultimately handed Republicans the crucial vote, allowing Vice President Vance to break the tie. Despite the bill's passage, the Alaska Republican believes it still can be improved. 'I had to look on balance, because the people in my state are the ones that I put first. We do not have a perfect bill by any stretch of the imagination,' she told reporters. 'My hope is that the House is going to look at this and recognize that we're not there yet.' When pressed to explain her decision to vote for the sprawling bill, Murkowski cited a number of items in the bill she won for her state, along with the potential end-of-year tax hike. 'Kill it and it's gone and there is a tax impact coming forward. That's going to hurt the people in my state. Kill it, and the provisions that are going to be very helpful for economic development in my state would no longer be available. Kill it, and the things we got to soften the impact on Medicaid recipients, our hospitals … that would all be gone,' she said. 'There is more that needs to be done, and I'm not done,' she added. Senate Republicans on Tuesday jammed through a major package advancing President Trump's tax priorities, paid for by a host of cuts to the social safety net, including Medicaid and food assistance. The bill also slashes green energy and includes changes to student loan programs. The nearly 1,000-page package, released Friday, has undergone notable changes since initial pieces of the plan first came into view weeks ago. Republicans have also sought to make several tweaks to the bill in the past several days. The expansive bill now awaits consideration in the House, where leaders hope to push it across the finish line before a self-imposed July 4 deadline. Live updates: Senate sends tax bill to House; Trump visits 'Alligator Alcatraz' Here are some of the most significant changes that made the cut through a frenzied 27-hour debate — and what didn't. A centerpiece of the legislation is making permanent the expiring provisions in Trump's signature tax law — which nonpartisan scorers and think tanks estimate would cost trillions of dollars over the next decade. One of the most costly proposals is extending the individual rate reductions in the 2017 law. The bill would also seek to cement existing federal tax brackets, boost the standard deduction and maintain the termination of personal exemptions. It also seeks to deliver on several key promises the president made on the campaign trail last year. That includes deductions for taxes on tips, overtime pay and car loan interest. However, the measures are not fully deductible. Republicans setting up tax cliff at end of Donald Trump's term The final version of the legislation includes restrictions on Medicaid, the joint state-federal program that provides health care for more than 70 million low-income and disabled Americans. Like the House-passed version, the Senate bill will require beneficiaries to prove they are working or in school at least 80 hours a month to keep their health insurance starting Dec. 31, 2026. The Senate version extends the work requirement to low-income parents of children older than 14, in addition to childless adults without disabilities. It also requires more frequent eligibility checks. But the Senate parliamentarian said a measure cutting federal funds to states that use their own money to provide health care coverage to immigrants lacking permanent legal status, along with a provision banning Medicaid from covering gender transition services, weren't in compliance with Senate rules. The steep cuts to taxes levied by Medicaid expansion states on hospitals and other providers remained in the bill despite objections by some Republicans in the Senate and House, though they will now be delayed by a year, to start in 2028. The bill also requires people above the poverty line to pay out-of-pocket copays for most Medicaid services, like lab tests or doctor visits. States will be allowed to charge up to 5 percent of a person's income per year, though some Democratic-led states may opt for a smaller amount. The Senate made sweeping cuts to climate-friendly energy tax credits — especially for wind and solar — that were passed as part of the 2022 Inflation Reduction Act. The final legislation does not allow a project to get the tax credit if it does not begin producing electricity by 2028. This is stricter than an earlier Senate version, which would have allowed projects that begin construction in the next few years to qualify for the credits. The bill would require some states for the first time to cover a share of the cost of Supplemental Nutrition Assistance Program (SNAP) benefits — which are currently completely funded by the federal government — if they have a payment error rate above 6 percent. If the error rate is 6 percent or higher, states would be subject to a sliding scale that could see their share of allotments rise to a range of between 5 percent and 15 percent. The proposal in the megabill would also allow states with rates below that level to continue paying zero percent. Republicans say the proposal is aimed at incentivizing states to get their payment error rates down, while Democrats have argued the measure could lead to states having to cut benefits. However, last-minute changes have been made to the plan that would allow for delayed implementation for states with the highest payment error rates after concerns from Republican senators in Alaska, which had the highest rate in fiscal 2024. The final bill would introduce numerous changes to student loans, including limits on borrowing and consolidation into only two repayment plans. Republicans want to cap graduate-level federal student loans at $20,500 a year, at $50,000 for law or medical school government loans, and at$20,000 for Parent PLUS loans for undergraduate students. If passed, student loan borrowers will have two repayment options: a new standard plan and a new income-driven repayment plan. Under the latter, starting in 2028, borrowers will have access to the Repayment Assistance Plan and the income-based repayment option. It would also eliminate economic hardship and unemployment deferments. The bill does allow loans to be rehabilitated twice, up from once before. Pell Grants would get additional funding in 2026 and exclude students who received full-ride scholarships to a school. It also establishes workforce Pell Grants offering help to students who enroll in short-term work programs that don't end with a college degree. The bill would add $5 trillion the nation's debt limit, which caps how much money the Treasury Department can owe to pay the country's bills. Congress last acted on the debt limit in 2023 as part of a deal that suspended the ceiling through 2024. Since January, the Treasury Department has been implementing 'extraordinary measures' to buy time for lawmakers to raise or suspend the debt limit and stave off the threat of a national default. The national debt stands at more than $36 trillion. Republicans passed a tax credit refund that would go to individuals or companies that donate to organizations that provide K-12 school choice scholarships. The provision is a major win for the school choice movement, as it will create a national program to bypass Democratic states that have been resistant to school choice initiatives. Sen. Mike Lee (R-Utah) had been pushing for a provision that would have required the sale of hundreds of thousands of acres of public land, but he abandoned that effort over the weekend. In a post on social platform X, he said, 'Because of the strict constraints of the budget reconciliation process, I was unable to secure clear, enforceable safeguards to guarantee that these lands would be sold only to American families — not to China, not to Blackrock and not to any foreign interests.' 'For that reason, I've decided to withdraw the federal land sales provision from the bill,' he added. Lee had originally proposed to sell up to 3.3 million acres of land owned by the Bureau of Land Management (BLM) and Forest Service, but he later revised his proposal to pertain to up to 1.2 million acres of the BLM land. He said he was pushing the measure to build more affordable housing. He received opposition from not only Democrats but also members of his own party, some of whom said they would vote against the bill if it contained public land sales. The legislation omits a contentious change that floated over the weekend — an excise tax on new solar and wind projects if they contain Chinese components. This surprise provision met pushback from moderate lawmakers who did not want to add an additional tax on these industries. The Senate stripped a provision barring states from regulating artificial intelligence (AI). The most recent version of the provision would have barred states from regulating AI for five years if they wanted access to $500 million in AI infrastructure and deployment funding.
