11/7 acquittal: HC slams prosecution's failure to establish type of bombs used to hit Mumbai trains

Mumbai: The prosecution failed to even establish the type of bombs used in the crime, the Bombay High Court said on Monday castigating the shoddy probe that resulted in the acquittal of 12 accused in the 2006 Mumbai train blasts.
"The prosecution has utterly failed to establish the offence beyond the reasonable doubt against the accused on each count, it is unsafe to reach the satisfaction that the Appellants/Accused have committed the offences for which they have been convicted and sentenced," said a bench of Justices Anil Kilor and Justice S. Chandak.
On July 11, 2006, seven bomb serial blasts in packed Mumbai local trains brought the maximum city on its knees within 11 minutes.
The terror attack left 189 dead and 800 injured.
Out of the 12 people convicted by the trial court, five were handed death sentences and others were given life imprisonment.
The High Court's acquittal order is a major blow to the investigation agencies which, according to Justices Kilor and Chandak, failed to even present evidence on the type of bombs used in the serial blasts.
"The circuit boards recovered from Mohd. Faisal Shaikh and Mohammad Sajid Margub Ansari are of no help to the prosecution to establish the present offence as the prosecution failed to bring any evidence on record and to establish the type of bombs used in the present crime," the High Court said.
Justices Kilor and Chandak said, "Though the prosecution brought on record the technical report of the expert about the circuit board, it failed to establish the type of bombs used in the present crime. Thus, the said recovery is not relevant."
On Monday, the 12 accused -- incarcerated for 19 years -- also succeeded to establish in the High Court the fact of torture inflicted on them to extort confessional statements.
As a result, the High Court held the statements inadmissible saying, "On all the tests relating to voluntariness and truthfulness of the confessional statements, the prosecution failed."
The prosecution case against the accused was weakened further when it failed to share with the defence the Call Detail Record -- which were relied upon heavily to file charges.
In 2015, a special court had convicted 12 accused in the case -- sentenced five of them to death and seven others to life imprisonment.
Faisal Shaikh, Asif Khan, Kamal Ansari, Ehtesham Siddiqui, and Naveed Khan were sentenced to death. They had challenged this sentence in the High Court.
The prosecution had argued that the attack was planned by Pakistan's intelligence agency, ISI, and carried out by operatives of Pakistan-based militant group Lashkar-e-Toiba with help from the Students' Islamic Movement of India, a banned Indian group.

Gurugram, Jul 23 (PTI) The Directorate of Enforcement (ED) on Wednesday secured two-day custody of Sandeep Yadav and Arvind Walia, promoters of Haryana-based realty company Ramprastha Group, in connection with a money laundering probe linked to an alleged Rs 1,100 crore fraud with homebuyers. The two were arrested on Monday after the Gurugram zonal office of the federal probe agency raided three premises in Delhi and Gurugram, including those of the directors, early morning on that day. Yadav and Walia are directors and majority shareholders in Ramprastha Promoters and Developers Pvt Ltd (RPDPL). They were taken into custody under the Prevention of Money Laundering Act (PMLA). The federal probe agency produced the two in the court of an additional session judge, following which the ED secured their custody. The agency conducted a survey against the group in September 2024. It is alleged that the RPDPL collected about Rs 1,100 crore from more than 2,000 homebuyers for various housing schemes like Project Edge, Project Skyz, Project Rise and Ramprastha City (plotted colony project) in various sectors of Gurugram during 2008-11. The possession of the flats or plots is yet to be given, even after 15-20 years, the sources said. Earlier this month, the agency attached colonies and plots spread across more than 1,900 acres and worth over Rs 681.54 crore of the group in Gurugram as part of this investigation. The money laundering case stems from multiple FIRs filed by the Economic Offences Wing (EOW) of the Delhi and Haryana Police based on complaints of numerous homebuyers against RPDPL and its promoters, like Yadav, Walia and Balwant Chaudhary for their 'failure" to deliver promised flats and plots within the promised timeframes, the ED had said in a statement. The company and its promoters 'diverted" the funds sources from buyers of these projects to its group companies as advances for the purchase of land parcels, instead of using them for completion of promised homes, it had said. All about Harshvardhan Jain Harshvardhan Jain is said to be the son of a Ghaziabad-based businessman with ancestral marble mines in Rajasthan. According to a report of India Today, he has an MBA degree from the London College of Applied Science and ITS College, Ghaziabad. Jain allegedly had ties with controversial godman Chandraswami and international arms dealer Adnan Khashoggi. This wasn't, however, Jain's first encounter with law enforcement. In 2011, he was arrested for possessing an illegal satellite phone. His background reveals a pattern of high-level deception and fraudulent activity: Live Events The Fake Embassy Racket For nearly seven years, Jain ran what he called the 'West Arctic Embassy,' luring people in with promises of overseas employment, diplomatic perks, and high-level contacts. He regularly introduced himself as the Consul or Ambassador of non-existent micronations and even issued forged diplomatic documents to create an aura of legitimacy. According to reports, Jain digitally edited photographs of himself with political leaders, including PM Narendra Modi and former President Dr. APJ Abdul Kalam to boost his credibility. He would often be seen traveling in vehicles bearing fake diplomatic plates — further helping him pass off as a legitimate diplomat. SSP STF Sushil Ghule revealed that Jain also used morphed images with well-known dignitaries and operated shell companies to facilitate hawala transactions. He had created an elaborate system to gain people's trust and extract money under the guise of foreign job offers, business deals, and diplomatic benefits. An FIR has been registered at the Kavi Nagar police station, and a deeper probe is underway to expose the full extent of Jain's operations and possible accomplices. Authorities are also investigating the scope of his connections with other international entities.
