
Why do police conduct psychiatric tests on accused?
The teacher has been booked under the sections of the Protection of Children from Sexual Offences (POCSO) Act, and the Bharatiya Nyaya Sanhita (BNS).
According to the police, the test was conducted to evaluate the teacher's mental condition to determine her mental health.
Speaking to The Indian Express, a police official has said these tests are conducted on the accused while they are in police custody. The test is executed in the presence of medical experts.
Police usually conduct a psychiatric test to check if the accused was mentally stable at the time of the alleged offence, according to the official.
Section 30 of the POCSO Act defines 'presumption of culpable mental state' as intention, motive, knowledge of a fact and the belief in, or reason to believe, a fact. While it is worded in a way to denote 'mental state', the section presumes that the accused was in a mental state or had the intent to commit the alleged offence. The Act puts the onus on the accused to prove that there was no sexual intent or mental state to commit the offence.
This is the opposite of the basic presumption under criminal law which states that a person is innocent until proven guilty of a particular. The burden, in law, is on the investigating agency, or the prosecution to prove the person's guilt beyond reasonable doubt by bringing evidence before the court.
Legal experts argue that since the POCSO Act deals with children, putting the burden on them to understand the intent of the abuser can be challenging. Therefore, the presumption of the culpability of the accused's intent, or mental state, is in the favour of the victims under this law.
However, this does not mean that the accused can be held guilty on presumption alone. When the prosecution has cogent evidence, the onus is on the accused to prove the contrary to show their innocence. For instance, if a child deposes that a person touched them inappropriately with sexual intent, the court will presume so, unless the accused can show evidence proving otherwise.

Delhi: Two arrested in eve-teasing case involving minor girl
New Delhi [India] July 4 (ANI): Two accused have been arrested in connection with an eve-teasing incident reported on June 30 at PS Nand Nagri. The accused, identified as Afnan (19) and Sameer (22), according to the police. The complaint, filed by a 15-year-old girl, alleged that on March 4, while walking near SK Garg Clothing Shop on Shani Bazaar Road, she and her friend were followed by four individuals--two on a motorcycle and two on a scooty. When confronted, the accused abused her, and one of them spat on her face before fleeing the spot. Accordingly, a case under Section 79 of the BNS and Section 12 of the POCSO Act was registered at PS Nand Nagri, and an investigation was initiated. The team conducted extensive investigations and gathered crucial leads and clues from various sources. Based on the collected evidence, one of the accused was identified and arrested. He was identified as Afnan, aged 19 years. Initially, the accused attempted to mislead the police but, during sustained interrogation, admitted to his involvement and disclosed details about his accomplices. Following his disclosure, another accused, identified as Sameer, aged 22 years, was also arrested. A scooty, used in the commission of the crime, was seized from their possession. Efforts are ongoing to trace and apprehend the remaining accused. Further investigation into the case is underway. Earlier in another operation, the West District Police team of Delhi cracked a staged robbery case within 10 hours. Accused persons, namely Subhash Chand (aged 22) and Vijaypal (aged 26), have been arrested. The complainant, Subhash Chand, himself was the mastermind behind the staged robbery July 3, 2025, a call was received at PS Moti Nagar reporting a robbery of 13 lakhs. The complainant, Subhash Chand, alleged that after withdrawing 13 lakhs from the Bank, he was robbed by six unknown persons on a flyover. He further alleged that the robbers had arrived on three bikes and fled with the cash after stabbing him with a the investigation, CCTV cameras were analysed, but no suspicious bikes were seen chasing the complainant. Further inquiry revealed that the complainant's injuries appeared superficial and inconsistent with his claims of being stabbed by a knife. Upon sustained interrogation, Subhash Chand broke down and confessed to the crime. (ANI)

Man assaulted by shop owner ropes in UBT MP, slaps accused at his office
Thane: A shop owner and his two staffers beat up Thane-resident Kiran Jadhav following a dispute over mobile recharge on Tuesday night which took a political colour after he complained to former Shiv Sena (UBT) MP Rajan Vichare. Naupada police have booked the trader and his associates under relevant sections of the BNS. The accused later appeared at Vichare's office, where they were filmed apologising to Jadhav. In the viral video, Jadhav is seen slapping the accused before accepting their apology. Jadhav submitted a letter to Naupada police requesting to withdraw his complaint, stating the matter was "sorted", but police clarified that since the case was already registered, it could only be withdrawn through the court according to legal procedures. 5 Booked For Rs1.28 Cr Job Scam Fraud
Nagpur: A woman has accused her maternal uncle and four others of committing a fraud of Rs1.28 crore by promising jobs and a prestigious position in an institution. Based on the woman's complaint, Hudkeshwar police have registered a case against the five individuals. The accused have been identified as Nilkanth Dahikar (60), his wife Savita (52), their children Ashu (30) and Rahul (35), along with Gulab Dahikar (45), all residents of Desaiganj, Gadchiroli. The fraud was allegedly orchestrated spanning from 2011 to 2024. The complainant, Bharti Harkande (50), a resident of Manewada, alleged that the accused, associated with Shantivan Apang Niradhar Adivasi Vikas Shikshan Sanstha, lured her with the promise of appointing her as president of the institution. The accused allegedly extracted Rs48 lakh from her, Rs45 lakh from her sister's husband, and Rs15 lakh from her husband, along with additional amounts from other relatives, under the pretext of securing jobs. Despite collecting Rs1.28 crore collectively from all these individuals, the accused failed to deliver on their promises. When pressed for a refund, they issued a cheque of Rs48 lakh, which bounced. Following Bharti's complaint, Hudkeshwar police have registered a case under BNS sections 406 (criminal breach of trust), 420 (cheating), 506 (criminal intimidation), and 34 (common intention). Further investigation is on.
