HC to agencies: Ensure only treated water is discharged into Yamuna

has asked agencies to ensure that only treated water is discharged into the
Yamuna river
, directing them to take immediate steps in this regard.
A special bench of Justices Prathiba M Singh and Manmeet PS Arora, flagged the need to check the flow of untreated water into the river after a committee set up by it reported several shortcomings in the functioning of Sewage Treatment Plants (STPs).
"A brief perusal of the report itself would show that there is an enormous quantum of work that needs to be undertaken in order to ensure that only treated water is discharged to the Yamuna," the court observed, directing
Delhi Jal Board
, Municipal Corporation of Delhi, Delhi Pollution Control Committee and Delhi State Industrial and Infrastructure Development Corporation to take urgent steps.

HC said there are various shortcomings that need to be addressed and further elaborate steps to be taken.
It ordered a multi-agency meeting to be held with the members of the high court-appointed panel for further action.
After this, the officials may agree to hold further meetings in this regard, if necessary. Finally, DJB and MCD shall file their joint report and the action plan for addressing various shortcomings, deficiencies and improvements as pointed out by the special committee, the court further directed. It also took note of the panel's submission that most STPs have flow meters, but their efficacy remained doubtful.
The court asked DJB to file a report on this matter.
It had earlier warned DJB to get its act together on the functioning of sewage treatment plants or face contempt of court while reviewing steps taken to improve STPs' working to combat heavy pollution in the river. The court had also pulled up Delhi govt for its failure to regulate the emission of sewage and industrial waste in the Yamuna, stating that its STPs were not working according to capacity and something was "drastically wrong" with them.
The court was dealing with suo motu petitions on the water logging problem in Delhi, the issue of rainwater harvesting and easing traffic jams in the national capital during monsoon and other periods.

Citing privacy concerns, a Delhi court Saturday rejected a plea moved by an accused in the corruption case linked to the alleged Delhi excise policy scam to inspect the digital devices of two other co-accused. The court pointed out that such an 'attempt to conduct a parallel investigation' could not be allowed. The court was hearing a plea by Amandeep Singh Dhall, who is accused of conspiring in formulating the now-scrapped Delhi Excise Policy 2021-22, to inspect the digital devices of co-accused Sameer Mahendru and Arun R Pillai. The Central Bureau of Investigation (CBI), which is investigating the case, had found nothing incriminating in them, and both the co-accused objected to Dhall's demand. 'No such parallel investigation should be allowed by any accused, as this would otherwise lead to an endless cycle of such proceedings. After all, every accused in a criminal trial claims that he was prejudiced by an unfair investigation concerning him and by the omission of facts that may have favoured him,' said Special Judge Dig Vinay Singh in his order. 'Requesting inspection without a specific or justified reason, or simply hoping to find something useful, amounts to a fishing expedition. Such a broad, unfocused search without clear limits or scope amounts to a roving inquiry. It not only wastes the court's time but also risks violating privacy rights and could amount to harassment or oppression of the device owners,' the judge added. 'The reason accused 9 (Dhall) inspects others' devices is to find something that he can use to build his defence. If he is not planning to use any content from those devices, then why does he need to see them? The purpose of inspecting the devices is to find evidence that can be used to support his defence, which poses a serious risk to accused 5 (Mahendru), accused 7 (Pillai) and others,' the court said. Just because the two accused and others voluntarily disclosed their passwords to the investigating agency, they cannot be compelled to reveal them again for Dhall or anyone else, the court noted. It added that courts had to be 'especially cautious when digital devices containing sensitive, private or personal data' are examined and that such an inspection, which could violate privacy, can not be considered an 'unfettered right'. The court was dealing with a question of the fundamental rights—the right to privacy and the right to a fair trial—of two sets of people conflicting with each other. 'Since the CBI could not find anything related to the dispute in those devices, allowing a parallel inquiry would be equivalent to conducting a separate trial for each device, which could be extremely risky for a criminal court to undertake. No such pre-trial inquiry should be permitted,' the court stated. The CBI arrested Dhall in April 2023. The Delhi High Court granted Dhall bail in the money laundering case related to the alleged scam in September 2024, and later, the Supreme Court in October 2024 granted him bail in the CBI case.

New Delhi: The Delhi High Court ordered a stay on the derecognition of 660 Teacher Education Institutions (TEIs), out of the 2,962 derecognised by the National Council for Teacher Education (NCTE) for failing to submit online Performance Appraisal Reports (PARs) for 2021–22 and 2022–23. After issuing show-cause notices, the NCTE derecognised 2,962 non-compliant institutions in April and May. (File Photo) The court's order allows these institutions to participate in counselling and admit students for the 2025–26 academic session, the NCTE said in notices—containing the names of the institutes—issued between July 23 and August 1. NCTE had set a final deadline of December 30, 2024, for Performance Appraisal Report (PAR) submissions after two extensions, requiring institutions to provide faculty details, financial statements, and geo-tagged documents. In February 2025, it formed a five-member panel headed by Harish Chandra Singh Rathore of the NCTE's northern regional committee to recommend action against defaulters. After issuing show-cause notices, the NCTE derecognised 2,962 non-compliant institutions in April and May. Rathore declined to comment on the development. India's TEIs are grouped into four regions. The highest number of derecognitions were in the northern region (1,225), followed by the southern (960), western (748), and eastern (29) regions. Among the 660 TEIs that have secured an interim stay on derecognition, the maximum—467—are from the Northern region, followed by 115 in the Western region, 71 in the Southern region, and 7 in the eastern region. '...the Hon'ble High Court of Delhi, while staying the operation of the impugned withdrawal orders till the next date of hearing, has also permitted the Petitioner institutions to participate in counselling and admit students for the academic session 2025–2026,' the NCTE said in its notices. The next hearing in the matter is scheduled for the third week of August 2025. The court, in its order on July 14, had asked the NCTE to issue public notices and upload the list of institutions on its website whose derecognition order has been stayed and which are permitted to admit students in the academic session 2025–26. NCTE officials refused to comment on the development, stating that the 'matter is sub judice.' As per the latest data available on the NCTE website, India has a total of 20,454 recognised TEIs, with the highest concentration in the northern region (8,120 TEIs), followed by the western region (4,928), southern region (4,757), and eastern region (2,649).

Kochi: Apartment complexes that were served disconnection notices by Kerala State Electricity Board (KSEB) for failing to install sewage treatment plants (STPs) received temporary relief, as pollution control board (PCB) decided to grant them more time to comply. KSEB issued disconnection notices to 71 residential apartment complexes across the city for failing to install STPs in compliance with PCB guidelines. The decision, which threatened to cut off electricity to over 1,500 households within a week, sparked widespread concern among residents. When high court considered the suo motu case regarding the pollution of Thevara – Perandoor Canal, it also took into account the impleading petitions filed by different associations of affected apartment complexes and asked PCB to consider granting the petitioners reasonable time. "Considering the main purpose of initiating suo motu petition is to address the environmental hazards caused by the accumulation of filth and garbage in the canal, as regards the grievance of the applicant noticees concerning the short time given by pollution control board for compliance, we direct that if an undertaking (along with resolutions in case of companies/societies) is submitted by the noticees (even other than the applicants) seeking reasonable time for compliance, the pollution control board will consider granting such reasonable time, provided the undertaking expresses a genuine intention of compliance," said the court order. In the backdrop of the court order, the Consortium of Flat and Villa Owners Association, Kerala will convene a meeting of the affected families residing in 71 apartment complexes soon and each family will approach PCB with an affidavit or seek time for installing STPs. "Only three or four affected parties approached court. But the order is applicable to all. So, we have decided to approach PCB seeking extension of time. A senior official of KSPCB told TOI that they decided to accept undertakings from affected parties and KSPCB would grant proper time after examining conditions given in the undertakings. HC will consider the case at the next hearing on Sept 11, and the consortium is planning to sort out the issues by submitting the undertakings to PCB before the date. T J Vinod, MLA, strongly criticised KSEB, PCB and the municipality for issuing the notice. He said that he would bring the issue to the notice of chief minister. "PCB does not even have a list of approved agencies to establish STPs. Some flats received notice last month and are in the process of setting up sewage treatment systems, which could take up to 12 months to complete," said the MLA. All the flats that received the notice were built when these regulations were not in place. The municipality's action of leaving these residents, who trusted the occupancy certificate provided by the municipality and started living in the flats, was unacceptable, stated the MLA.
