Delhi High Court reduces convict's jail term from 30 to 20 years in rape case

NEW DELHI: The Delhi High Court has reduced the 30-year jail term handed to a man convicted of raping a 12-year-old girl, cutting it down to 20 years after considering his good conduct in prison.
Justice Amit Sharma, in an order dated July 11, noted that the man had been in custody since April 6, 2015, and had served as a safai sahayak (cleaning assistant) while maintaining an overall satisfactory jail record.
'The trial court while sentencing the present appellant for a period of 30 years under Sections 376(2)(i) and (n) of the IPC has recorded that the offence committed by the appellant was heinous in nature and, therefore, the sentence awarded was justified.
There is no doubt that the offence committed by the present appellant is extremely grave,' the Court observed, while allowing partial modification of the sentence. The man had approached the High Court challenging the 2013 judgment of the trial court that found him guilty of repeatedly raping a minor girl, who lived in his neighbourhood.
The incident came to light when the girl, along with her mother, approached police on April 4, 2015.
The girl told police that in December 2014, when no one else was home, the accused came to her house, offered her food, showed her obscene images on his phone and sexually assaulted her. She also alleged that he slapped and threatened her with dire consequences if she revealed the abuse.
Later, when the minor experienced stomach pain, her mother took her to a doctor. Medical examination revealed she was pregnant. Doctors advised a medical termination of pregnancy. DNA samples were collected and sent to the forensic science laboratory.
Following investigation, the man was convicted under Sections 376(2)(i) and 376(2)(n) (repeated rape of a minor), Section 450 (house trespass), and Section 506 (criminal intimidation) of the Indian Penal Code. He was also held guilty under Sections 3 and 4 of the Protection of Children from Sexual Offences (POCSO) Act, relating to penetrative sexual assault. However, he was acquitted of the charge of sexual harassment.

A 17-year-old boy accused in a bank robbery case in Cheruvathur was arrested by the Chandera police and later released to his father's custody, as per the Juvenile Justice (Care and Protection of Children) Act. The boy was nabbed in connection with a break-in at the ESAF Bank near Pakkanar theatre in the early hours of June 29. He allegedly broke the lock, entered the premises, and attempted to breach the strongroom but failed. He then targeted a nearby hotel and a petrol pump, stealing ₹7,000 and a mobile phone. The police said that the boy was already wanted in several theft cases under the limits of Hosdurg, Kannur Town, Chandera, Nileswaram, Ambalathara and Bekal stations. As per the Juvenile Justice Act, a minor committing an offence for the first time must be released to the custody of a guardian. In line with this provision, the boy was produced before the court and released to his father.

The Delhi High Court on Wednesday asked the Centre, Delhi government and Delhi Police to respond to a plea alleging traffic violations by e-commerce delivery riders. A Bench of Chief Justice D.K. Upadhyaya and Justice Tushar Rao Gedela ordered the Ministry of Road Transport and Highways, Delhi Transport Department and Commissioner of Delhi Police to file their replies and posted the matter for hearing on October 8. Advocate Shashank Shri Tripathi in his petition alleged 'widespread, continued and unchecked' violations of the Motor Vehicles Act and the Central Motor Vehicles Rules by delivery partners of quick commerce and e-commerce platforms in the Capital. The counsel for the Delhi government informed the court that the government had already introduced a policy for two-wheelers – the Delhi Motor Vehicle Aggregator and Delivery Service Provider Scheme, 2023 – and had notified it on November 21, 2023. The scheme aims to license and regulate aggregators operating in the Delhi region. The court then asked the Delhi government to place on record the policy and for the authorities concerned to provide detailed information about the action taken against the violators. The plea alleged that delivery workers employed or contracted by various platforms routinely use two-wheelers to transport 'oversized, bulky and excessively heavy items,' including industrial toolkits, foldable furniture, and commercial-sized delivery boxes. 'These loads often exceed the permissible dimensions and weight limits under Indian traffic regulations, compromise the stability of vehicles, obstruct the vision of riders and endanger public safety,' it said. 'The continued tolerance of these unsafe delivery practices will create a dangerous precedent that encourages other commercial entities to disregard safety regulations, thereby potentially leading to a complete breakdown of vehicular discipline and road safety standards across Delhi and other urban centers, which would result in irreparable harm to public safety and the rule of law,' the petition said. The plea sought directions for framing and implementing binding regulatory guidelines governing delivery operations in the gig economy. Urbanclap Technologies India Pvt. Ltd.
