
Delhi Court Convicts Man For Using Vulgar Language, Outraging Woman's Modesty
In a verdict reinforcing the right of women to live with dignity and without fear, a Delhi court has convicted a man under Sections 506 (Part II) and 509 of the Indian Penal Code for criminal intimidation and using obscene and abusive language intended to outrage a woman's modesty.
The incident involved the accused sending a series of highly vulgar and threatening messages to the complainant. Some of the messages included: "Darwaza khol de mujhe tere saath s** karna hai", "R** tujhe main bataunga, bahut samajhdar apne aap ko samajhti hai", and "R* darwaza khol de, nahi to main tujhe chhodunga nahi".
The court observed that such language goes far beyond casual abuse and directly targets the woman's character and dignity. "The word 'R**' is not a simple insult; it is loaded with sexual connotations, casting aspersions on the woman's morality and loyalty. These words are capable of shocking the conscience of any reasonable person," the court noted.
Citing multiple precedents, including Rupan Deol Bajaj v. KPS Gill and State of Punjab v. Major Singh, the court reiterated that the modesty of a woman is intrinsically linked to her gender, and words or acts that degrade her in this regard are punishable under law. "To constitute an offence under Section 509 IPC, it must be shown that the act or speech was intended to insult the modesty of a woman. In this case, that threshold is clearly met," the judge ruled.
The complainant had also alleged that the accused threatened her with rape and murder if she didn't comply with his demands. Statements such as "Darwaza nahi khola toh goli maar dunga" were held to constitute criminal intimidation under Section 503 IPC. The court held that these were not hollow threats but grave intimidations that created fear and terror in the mind of the woman.
The court noted that the accused, while testifying in his own defence, admitted that the messages originated from his mobile number. Although he claimed the messages stemmed from a rent dispute, he did not deny their vulgar content. His admission was taken on record under Section 58 of the Indian Evidence Act, which states that admitted facts need not be further proved.
The defence raised procedural objections, such as the absence of a Call Detail Record (CDR) analysis or IMEI number verification.
However, the court rejected these arguments, noting that the WhatsApp messages -- the main evidence -- had already been admitted by the accused himself. "Minor lapses in investigation do not affect the core of the prosecution's case, especially when the evidence is independently corroborated by the victim's testimony and the accused's own admission," the court said.
The court further discussed the legal contours of Section 509 IPC, clarifying that not all insults amount to an insult to modesty. However, when the words used are capable of "shocking the sense of decency of a woman," they fall squarely within the purview of this section. The court also explained that "modesty" as envisaged under law is not defined in the IPC but is broadly understood as "womanly propriety of behaviour."
Quoting Rupan Deol Bajaj, the court held that, "The ultimate test is whether the words or actions of the accused could be perceived as capable of outraging the modesty of a woman." Given the nature and content of the language used, the court held that this legal standard was clearly met.
The Court held that the prosecution had proven its case beyond a reasonable doubt, and the court convicted the accused under Section 506 (Part II) for criminal intimidation and Section 509 IPC for using words intended to insult the modesty of a woman.

Maradu police launch probe into faulty construction of Chander Kunj Army Towers
Kochi: Maradu police have registered one more FIR and begun an investigation into the alleged faulty construction of Chander Kunj Army Towers at Silver Sand Island, Vyttila. The FIR was registered under Sections 420 (cheating and dishonestly inducing delivery of property) and 34 (common intention) of the IPC. The FIR was registered on July 21, based on a court directive after Colonel (retd) Ciby George, a resident of the Army towers, filed a private complaint before Ernakulam judicial first-class magistrate court-VIII. The FIR states that the crime was committed with the intention of making excessive profits by cheating the complainant and others. The three towers of the apartment complex were constructed under the ownership of Army Welfare Housing Organisation, without obtaining necessary sanctions from govt departments and by using low-quality materials. The complainant purchased one of the flats in the building on May 31, 2018, but the flat started developing damages and became uninhabitable. The accused committed the crime by overseeing the construction at various stages and at other times. The FIR was registered after the petition filed before the court was forwarded to the station, the FIR states. Maradu station house officer (SHO) filed a report before the court on July 15 stating that the case was of a serious nature and there was a need for a special unit of police to investigate it. The case diary was submitted to higher-ups so that the probe could be transferred to crime branch. Further procedures were in process regarding the same, the report stated. Maradu police are also investigating three other cases registered in connection with the issue. Earlier, the high court on June 16 declined to order a CBI investigation into the alleged corruption behind the dilapidated condition of towers B and C on a petition filed by George.

Man sentenced to one year imprisonment for misbehaving with woman on bus
Kochi: A 43-year-old man was sentenced to one year of imprisonment in the case of misconduct towards a female passenger on a bus. A fine of Rs 10,000 was also imposed on the convict. The case pertains to the assault which happened on July 26, 2022. The sentence was awarded to Shoby C Joseph of Thodupuzha, Idukki, on Friday. He was found guilty under Section 354 of the IPC (Assault or criminal force to woman with intent to outrage her modesty). Judicial first-class magistrate court II in Ernakulam awarded the punishment. Assistant public prosecutor Honey Jacob represented the prosecution, while inspector Xavier Lalu registered the FIR. Sub-inspector B Sabu submitted the chargesheet to the court.

Interfaith marriages without religious conversion illegal: Alld HC
Prayagraj: The Allahabad high court ruled that interfaith marriages without religious conversion are illegal and refused to quash criminal proceedings against a man accused of marrying a minor at an Arya Samaj temple, reports Rajesh Kumar Pandey. The Allahabad High Court directed the state home secretary to investigate how Arya Samaj temples are issuing marriage certificates without following rules and submit a compliance report. The court declined to set aside the criminal proceedings against the man who married a minor after allegedly kidnapping her. In his order dated July 24, Justice Prasant Kumar made it clear that the investigation has to be made by an officer not below the rank of deputy commissioner of police. Before passing the above directions, the court found that the applicant and the victim belong to different religions. "There is averment in the application that they have solemnized marriage in Arya Samaj Mandir at Prayagraj. However, the same could not have been done without proper conversion as per the existing law," added the court. With these observations and directives, the court dismissed the petition filed by one Sonu alias Shahnur, who had moved the court to quash summoning order dated September 12, 2024 issued against him as well as the entire proceedings of criminal case going on against him under section 363 (punishment), 366 (kidnapping a woman to compel her to marry) 376 (rape) of IPC and sections 3/4 of the Protection of Children from Sexual Offence (Pocso) Act at Nichlaul police station of Maharajganj district. During the course of hearing, the counsel for the applicant submitted that Shahnur had solemnized marriage with the victim on February 14, 2020. He further submitted that since the girl was minor, she was sent to Nari Niketan and when she became an adult, she started living with the applicant. On other hand, the government counsel submitted that the girl is minor as per her high school certificate and she could not have solemnized marriage with the applicant. He submitted that the applicant and the victim come from different religions, as such, their marriage cannot be considered valid until and unless proper conversion is carried out in accordance with the provisions of the UP Prohibition of Unlawful Conversion of Religion Act, 2021. He further submitted that the marriage certificate has been issued by Arya Samaj Mandir, which seems to be a fabricated document. In support of his arguments, the state counsel quoted an earlier order passed by this court, in which the court pointed out that certain people who claim themselves of Arya Samaj and are getting marriages solemnized illegally with mala fide intentions without even verifying the age of the couple. The court will hear the case next on August 29.
