Court rules Isham's remarks on Najib's trial not contemptuous

KUALA LUMPUR: Former Umno information chief Isham Jalil's statements criticising Datuk Seri Najib Razak's corruption trials involving 1Malaysia Development Bhd (1MDB) did not undermine public confidence in the judiciary.
High Court judge K. Muniandy made the ruling after dismissing committal proceedings initiated by the Attorney-General's Chambers (A-GC) against Isham today.
The court said that the contempt alleged did not have a direct bearing on the specific courts in which the 1MDB and SRC International Bhd cases had been heard and decided.
"The cases were already determined by that courts. Therefore, what could be regarded as scandalous or interfering with the course of justice earlier may not be so today.
"The vague allegation that the respondent (Isham) has scandalised the judiciary by making the impugned statements, when seen in the light of the facts and context of the publication, the statements do not pose real risk of undermining public confidence in administration of justice," said the judge.
Muniandy said the object of the law of contempt was not to protect judges and their dignity but to protect the rights of the public by ensuring that the administration of justice was not obstructed.
"With the advent of social media, criticisms against a judge and his decision is commonplace, as replied by the respondent in his reply to the show cause.
"As a judge, our duty demands that we adjudicate cases with absolute independence, unwavering impartiality, and unassailable integrity.
"This is not always easy, as we must stand resilient in the face of adversity and criticism, for the scales of justice must never be swayed by external pressures or the clamour of public opinion," he said.
Muniandy said the judgments in corruption cases involving 1MDB and SRC International were clearly based on facts and the law, rather than emotion or public pressure.
"It shows that the ebb and flow of administration of justice is guided by legal principles, not by the shifting tides of public opinion or scurrilous attacks."
Muniandy said while freedom of speech was a cornerstone of democracy, its exercise must respect the vital function of the judiciary.
He said the power of contempt of court was a necessary tool to prevent genuine obstruction or subversion of justice.
"However, its use should be reserved for cases where there is a real risk of undermining the administration of justice, not merely to suppress uncomfortable or even critical opinions.
"The most effective way for the judiciary to dispel unwarranted criticism and defend its integrity is through undeniably fair and just judgments," he added.
A-GC filed the contempt application on Dec 28, 2023, following Isham's remarks in an interview titled "Townhall For Justice: Keadilan Sebenarnya Untuk Siapa?" (Justice: Who Is It Really For?)
In his remarks, Isham had criticised the corruption trial and appeal involving his former boss, Datuk Seri Najib Razak, in relation to the 1Malaysia Development Bhd (1MDB) and SRC International Sdn Bhd cases.
The recorded interview, which discussed the trial and appeal proceedings in the SRC and 1MDB cases, was posted on the Facebook page of "The Malaya Post" on Sept 30, 2023.

FORMER UMNO supreme council member Isham Jalil is on the look-out for lawyers who would assist him to draft letters of demand (LOD) for Madani cybertroopers who accused him of acting as an adviser to incarcerated former premier Datuk Seri Najib Razak in his 2017 negotiation with Donald Trump who was the then US president. Isham who was once a special officer to Najib claimed that the cybertroopers had slandered him given he was 'never directly involved in the Boeing acquisition negotiations nor was he part of Najib's delegation to the US'. 'I like it when PH (Pakatan Harapan) politicians and their 20-sen walanon gang (hardcore PMX supporters) do this kind of work. Because I have the opportunity to sue them and make millions,' he penned on his Facebook page. 'When I win the suit, I will buy a motorbike.' Setting the record straight, Isham clarified that Najib did not buy the 25 Boeing planes as claimed by detractors but in fact, he had 'signed a non-binding MOU (memorandum of understanding' instead. 'We didn't buy but leased 16 from the international leasing firm that bought the aircraft with terms depending on the current market conditions,' revealed the former UMNO information chief who was expelled from the party on Dec 7, 2023 for opposing the party's collaborations with DAP in elections. 'The then Malaysia Airlines CEO can confirm this.' Isham who has in recent times become a harsh critic of Prime Minister Datuk Seri Anwar Ibrahim further took a swipe at the Madani government 'for directly buying 80 aircraft through government-linked company (GLC) Malaysia Aviation Group Bhd (MAG) by incurring a debt exceeding RM100 bil'.' For the record, MAG had in 2016 placed an initial order for 25 Boeing 737-8 MAX aircraft with 13 planes having been received since November 2023 while the remainder are to be delivered progressively until 2027. However, MAG had on March 20 this year finalised an additional order for 30 Boeing 737 MAX aircraft with deliveries expected to take place from 2025 to 2035, according to Investment, Trade and Industry Minister Tengku Datuk Seri Zafrul Abdul Aziz. Although only 30 planes were originally planned, critics believe that the recent order for another 30 appear to be a last-minute add-on which is likely to please Washington in order to unlock tariff relief from 25% to 19% – a dangerous precedent where strategic assets are used for political appeasement. 'The current total fleet of MAS is approximately 80 aircraft with many years left before the expiration date,' he justified. 'You want to buy twice as many aircraft and double the fleet size with hundreds of billions in debt even though your profit has dropped to only RM54 mil?' Added Isham' Our airline's record is not good and always loses. Moreover, the aviation industry is both instable and full of risks. 'And yet you still want to take on debts amounting to more than 10% of the country's total accumulated debt because you want to buy 80 more aircraft? SHAH ALAM – The possibility of former prime minister Datuk Seri Najib Razak being granted house arrest is a matter of "when, not if" and is likely to occur next year once he has served a sufficient portion of his sentence, according to political analyst James Chin. The analyst from University of Tasmania's Asia Institute attributed this impending move to "too strong" pressure from Umno grassroots. Any decision would require the consent of the Yang di-Pertuan Agong and adherence to due process. - Bernama photo Chin said the shift towards house arrest could be traced to the former king, Al-Sultan Abdullah Ri'ayatuddin Al-Mustafa Billah Shah's, addendum to Najib's royal pardon. "Yes, it will happen, when it will happen is a different issue, but it will happen, probably next year, when Najib has served the required minimum time before eligibility for house arrest. It will happen because the pressure from Umno grassroots is too strong," he told Sinar Daily. Chin warned that the political consequences could be significant, as many Pakatan Harapan supporters and Malaysians concerned about the 1Malaysia Development Berhad (1MDB) scandal are likely to view the move as evidence of preferential treatment for Najib. "Pakatan Harapan supporters and those who are very concerned about 1MDB will see this as a very negative move because it will be perceived as Najib being given special treatment,' he said. He added that Prime Minister Datuk Seri Anwar Ibrahim would likely deflect blame. 'Anwar will say this is out of his hands, that it was the decision of the former King. "Once you invoke the King's name, it becomes challenging for people to criticise without it being seen as seditious," he said. Chin also stated that while Najib's case could be raised during the upcoming Sabah state election, it is unlikely to be a decisive factor. 'The major issue in Sabah is still the 'Sabah for Sabahans' sentiment,' he said. Meanwhile, political analyst Associate Prof Dr Syaza Shukri offered a more cautious take, suggesting that Najib's release remains politically risky for the government. 'I don't think the government would allow his release because there would be many angry Malaysians. "Those calling for Najib's release are only Umno members and supporters. They don't represent the entire country, but they are using political pressure,' she said. She added that any decision would require the consent of the Yang di-Pertuan Agong and adherence to due process. 'If they allow Najib's release, it would be political suicide for PH. Their supporters will be furious. And if he is released, Perikatan Nasional (PN) will use it as evidence that PH is not serious about fighting corruption,' she said. Commenting further, O2 Research head Anis Anwar said the speculation places Anwar in a politically delicate position. He said any decision related to Najib's sentence will have to balance two equally high-stakes calculations. "On one hand, there is the need to preserve the fragile cooperation with Umno, a key pillar of the unity government. "On the other hand, there is the risk of alienating Pakatan Harapan's own voter base, many of whom have held firm expectations around judicial accountability and institutional reform since GE14," he said. Anis stressed that the government's best strategy is to frame any leniency towards Najib as a legal or constitutional obligation, rather than a political concession. 'If this framing works, Umno can claim institutional vindication while PH can maintain its stance that it was merely upholding due process. "Until this pathway is available, the government will delay any final decision, allowing legal institutions to absorb political pressure,' he added.

PUTRAJAYA: The Agriculture and Food Security Ministry (KPKM) has recommended that the Department of Statistics Malaysia (DOSM) conduct short-term agricultural censuses every two to four years to ensure timely data updates for improved policy coordination. KPKM secretary-general Datuk Seri Isham Ishak highlighted the importance of frequent data collection following the findings of the 2024 Agriculture Census, which provides detailed insights at both national and district levels. 'We have discussed with DOSM how future censuses can be implemented. For federal-level policymaking, we need long-term statistics over five to 10 years. However, for state and district-level execution, data must be refreshed more often. Smaller-scale censuses would be cost-effective,' he said during a press conference. The 2024 census offers granular data on farming demographics, crop types, land ownership, and mechanisation adoption. 'We now have hyperlocal data. In Senaling, Kuala Pilah, for instance, we know the number of farmers, their crops, and production levels. This helps state governments and village leaders make informed decisions to boost yields,' Isham explained. Deputy Prime Minister Datuk Seri Fadillah Yusof previously announced that short-term agricultural surveys would begin in 2026 to enhance sector monitoring. Additionally, KPKM plans to introduce a cooperative-based farm management model to consolidate smallholders and landowners, improving productivity through collective government assistance. 'With over 220,000 padi farmers nationwide averaging two hectares each, grouping them could enhance efficiency and income,' Isham noted. The success of this model depends on accurate data and strong federal-state collaboration with local farming communities. - Bernama
