MPAJ department head charged with accepting RM30,000 bribes
Ahmad Alhairi Mohamed Yusuf, 47, who is the director of MPAJ's Building and Architecture Department pleaded not guilty to both charges when they were read before Judge Meor Sulaiman Ahmad Tarmizi.
For the first charge, he is accused of accepting RM20,000 in cash through his personal bank account from Nazman Puteh, 64, who is known to have connections to the accused's official duties.
On the second charge, he allegedly received RM10,000, also through his Maybank account, from Nazman via Song Teik Sun, 61, and Wong Huey Peng, 37.
Both offences were allegedly committed at a Maybank branch in Taiping, within the Larut, Matang and Selama district, on Nov 2, 2023.
The charges were brought under Section 165 of the Penal Code, which carries a maximum sentence of two years' imprisonment, a fine, or both upon conviction.
Deputy public prosecutors Asmaa' Zamri and Muaz Ahmad Khairuddin led the prosecution, while the accused was represented by lawyer Khairul Nizam Abd Razak.
Asmaa' offered bail of RM15,000 for both charges, along with additional conditions.
These were the surrender of the accused's international passport and monthly reporting to the Malaysian Anti-Corruption Commission Selangor office in Shah Alam on the first Saturday of every month until the case concludes.
While agreeing to the additional conditions, Khairul appealed for the bail amount to be reduced to RM10,000, citing his client's ongoing service at MPAJ and consistent cooperation with the MACC since the investigation began a year ago.
The court granted bail at RM10,000 with one surety and imposed the two additional conditions.
Mention of the case has been set for Aug 19.

RM150,000 worth of elephant tusks seized; two detained
KUALA LUMPUR: Two men have been arrested for hiding elephant tusks worth more than RM150,000 in a house at Bandar Botanic. The suspects, aged 37 and 38, were detained during a raid by the police's Wildlife Crime Bureau and the Wildlife and National Parks Department (Perhilitan) at 8.30am on Tuesday. The raid was part of Op Bersepadu Khazanah (OBK) following intelligence gathering by authorities. Abuse of position: Ex-assistant civil engineer to know fate August 20

Kota Kinabalu: A former assistant civil engineer, who appealed against the 12 months' jail sentence and RM20,000 fine on two counts for abusing his position in awarding a road maintenance project to his sister's company, will know the outcome of his appeal on Aug 20. High Court Judge Datuk Celestina Stuel Galid on Thursday fixed the date for appellant Herwan Malik after hearing his appeal against the Sessions Court's decision and submissions from the prosecution as the respondent. Advertisement Herwan, 40, who was challenging both his conviction and sentence, appealed to set aside the decision made by the trial judge. On Aug 29, 2023 he was convicted and sentenced to 12 months' jail and RM10,000 fine in default three months' jail on the first count for misusing his position as the committee member in making a decision on Kota Marudu District Office quotation to select Pemborong Sri Tassha which belonged to his sister Rozanah Malik, 32, to carry out the road maintenance project along Jalan Pertanian in Kg Sungai Laut, Kota Marudu. The offence took place between 8am and 5pm on Feb 28, 2013 at the Kota Marudu District Office. On the second count, Herwan was jailed another 12 months plus RM10,000 fine, or three months' jail for misusing his position to award the road maintenance project in Kg Pendawar, Kota Marudu, to the same company at the same place at 3pm on April 30, 2014. The offence under Section 23(1) of the Malaysian Anti-Corruption Commission (MACC) Act 2009 is punishable under Section 24 of the same Act, which provides for a jail term of up to 20 years,and a fine of not less than five times the amount involved or RM10,000, whichever is higher. Herwan was ordered to serve the jail sentence concurrently but he managed to obtain a stay of execution pending an appeal to the High Court. Counsel Shahlan Jufri, representing the appellant, raised 10 grounds of appeal, which summarised that the trial judge failed to properly evaluate all the evidence adduced during the trial and did not fairly or justly assess the defence. He further argued that the Sessions Court judge erred in law and in fact by concluding that his defence was an afterthought, a bare denial, and a fabrication of evidence. He also claimed the judge failed to draw an adverse inference under Section 114(g) of the Evidence Act 1950 against the prosecution, and erred in finding that he had failed to rebut the presumption under Section 23(2) of the Malaysian Anti-Corruption Commission Act (MACC) 2009. Deputy Public Prosecutor Haresh Prakash Somiah urged the court to uphold the Sessions Court judge's findings and dismiss the appeal. He submitted that the evidence before the court had been tested for its truthfulness, and the credibility of all the respondent's witnesses remained intact and that the appellant's evidence, on the other hand, was shown to suffer from contradictions and bare denials. RM587,004 committing Criminal Breach of Trust: Woman charged

Kota Kinabalu: A 32-year-old woman was charged with three counts of committing criminal breach of trust involving RM587,004. Rabiahtul Adawiah Pastor pleaded not guilty to all the charges against her before Sessions Court Judge Amir Shah Amir Hassan, on Thursday. Advertisement On the first count, Rabiahtul, as accountant and finance executive of Syarikat Yaza Communications Sdn Bhd which entrusted her with the money amounting to RM273,802.64 belonging to the company, allegedly breached the trust by misusing the company property by transferring the money into the Tropika Ujana Enterprise's bank account. The offence allegedly took place between Jan 6, 2022 and Oct 30, 2023 at the Syarikat Yaza Communications Sdn Bhd in Pusat Dagangan Putatan. On the second count, she is accused of committing the offence by transferring money amounting RM263,758.50 to Mah Group's bank account at the same place between Jan 14, 2022 and Oct 27, 2023. On the third count, she allegedly committed the offence by transferring money amounting to RM49,330 to a bank account belonged to Kasturi Indah Enterprise at the same place between Nov 30, 2022 and Oct 27, 2023. The offence under Section 408 of the Penal Code carries a jail term of between one and 14 years, whipping and liable to a fine, on conviction. The court set Aug 5 this year for case management and Rabiahtul was released on bail of RM5,000 in two local sureties.
