Court upholds death sentence for ex-military doctor in Kevin Morais murder case

PUTRAJAYA : The Federal Court has upheld the death sentence imposed on former military doctor R Kunaseegaran over the murder of deputy public prosecutor Kevin Morais eight years ago.
Two others – S Nimalan, 32; and S Ravi Chandran, 54 – were sentenced to 35 years and 40 years in prison, respectively.
Nimalan was also ordered to receive 12 strokes of the rotan, while Ravi Chandran was spared caning due to his age.
Chief Justice Tengku Maimum Tuan Mat, who led a three-member panel, said Kunaseegaran's death sentence remained as he had withdrawn his appeal against the sentence.
The court acquitted three others – R Dinishwaran, 33; AK Thinesh Kumar, 32; and M Vishwanath – after ruling that the prosecution had failed to establish a prima facie case against them.
Justice Abang Iskandar Abang Hashim, who delivered the broad grounds of judgment, said the prosecution relied on circumstantial evidence to convict Kunaseegaran, Nimalan and Ravi Chandran.
'On the totality of evidence, we find it was credible and compelling.
'We considered the defence of the three and they have not created doubt in the prosecution's case,' said Abang Iskandar, who is also the Court of Appeal president.
The other judge on the bench was Justice Rhodzariah Bujang.
Abang Iskandar said Dinishwaran, Thinesh Kumar and Vishwanath should have been acquitted without being ordered to enter their defence.
'We allow their appeals and hereby set aside their conviction for murder,' he added.
Lawyer N Sivananthan, representing Kunaseegaran, informed the court that his client had instructed him to withdraw his appeal against the death penalty imposed by the High Court and affirmed by the Court of Appeal.
Lawyer Amer Hamzah Arshad, representing Nimalan, and counsel Kitson Foong, appearing for Ravi Chandran, mitigated a jail term given the court's discretionary power following amendments to the penal laws two years ago.
'My client was 22 years old at the time of the incident. He deserves a second chance to turn over a new leaf,' Amer said in the courtroom.
Foong conceded that the murder of Morais was gruesome, but pleaded for a jail term of between 30 and 40 years.
Deputy public prosecutor Fairuz Johari, however, pressed for the death sentence to be maintained as the crime had been committed on a civil servant.
'The body was in a drum filled with cement to be disposed of,' he said, adding that the crime of abducting the deceased was committed in broad daylight.
Other defence lawyers present were Y Sheelan Samuagan for Dinishwaran, Burhanudeen Abdul Wahid for Thinesh Kumar, and Afifuddin Ahmad Hafifi for Vishwanath.
Deputy public prosecutors Fuad Abdul Aziz and Yusaini Abdul Karim also appeared for the prosecution.
The High Court sentenced all of the accused to death on July 10, 2020, after finding them guilty of murdering Morais on Sept 4, 2015, somewhere between Sentul, Kuala Lumpur, and Subang Jaya in Selangor.
Morais, 55, was reported missing on Sept 4, 2015, and was last seen leaving his apartment at Menara Duta in Kuala Lumpur in his official car. His body was found in an oil drum filled with cement in Subang Jaya 12 days later.
The prosecution contends that some of the accused in a car staged an accident with the vehicle driven by Morais to abduct him as he was leaving his home.

Amirudin said there was no reason to restart the entire process, which had already involved 212 witnesses, Utusan Malaysia reported. 'There's no need to start another investigation from A to Z. We don't need to spend another eight months on this, right?' he was quoted as saying after an event in Cyberjaya today. He also said the state government was not involved in the probe and had only acted as a witness, alongside local authorities, nearby developers, a security guard, an excavator operator, and Petronas officers. Amirudin was responding to the Kampung Kuala Sungai Baru Residents' Welfare Association, which expressed dissatisfaction with the outcome of the investigation and called for a review of the findings. Selangor police chief Hussein Omar Khan said the explosion and fire on April 1 had been classified as requiring no further action after investigators found no evidence of negligence or sabotage. He said the case could be reopened if new evidence emerged. Amirudin said the full report would be made public once clearance is obtained from the relevant authorities. 'Those who are unhappy can review the report themselves and identify who was responsible. It provides a picture of the responsible parties. (Bernama pic) PUTRAJAYA : The Federal Court today allowed bail for two businessmen charged with a security offence pending the outcome of their trial with several conditions attached. Justice Nallini Pathmanathan, leading a three-member bench, said the majority was of the view that N Nithiyan, 40, and S Hemanathan, 32, had made out a case primarily due to their health conditions. 'This is coupled with the inability of the prison system to attend to or care for prisoners who need special medical attention,' she said. Justice Hanipah Farikullah concurred with Nallini, while Justice Abu Bakar Jais dissented. Nallini said the assurances given by the Sungai Buloh prison doctor – as raised by their counsel and not disputed by the prosecution – were no guarantee. 'We take note of the number of prisoners there at 6,000 when it could accommodate only 2,500. 'With those numbers, it is difficult for the prison authorities to cope with fairly seriously ill prisoners who require regular medical monitoring. The resources at the prison are insufficient to meet these needs,' she added. Nallini said the two men were also not flight risks. '(In granting bail), we are exercising our powers under Section 13(2) of the Security Offences (Special Measures) Act (Sosma) as well as Section 388 of the Criminal Procedure Code,' she said in her broad grounds. Hemanathan, who is wheelchair-bound, and Nithiyan were allowed bail of RM50,000 each with two sureties. They will be confined to their home compounds and are to be fitted with an electronic monitoring device each. They are also to report to the police station nearest to their homes once in two weeks, and cannot travel outside of their residential home without police consent. 'They may travel to hospital for the treatment of their medical conditions with the permission of the police, which should not be unreasonably withheld,' Nallini said. Hemanathan and Nithiyan were charged under Section 130V(1) of the Penal Code with being members of Gang TR, an organised criminal group. The offence was allegedly committed at a seafood restaurant in Jeram, Kuala Selangor, over a period of five years between 2019 and 2024. If convicted, they face imprisonment of between five and 20 years. The men were detained under Section 13 of Sosma as the Penal Code offence is deemed to be a security offence. Under the provision, bail is not permitted except to those aged below 18, women, and those who are sick or infirm. The High Court and Court of Appeal dismissed their bail applications. Earlier, lawyer Rajpal Singh submitted that bail should be allowed as their trial is only scheduled to begin on Oct 5 next year. 'The court has the discretion to offer bail as it is a bailable offence,' said Rajpal, who was assisted by Jay Moy and Jayarubbiny Jayaraj. He said Nithiyan was suffering from unstable angina after going through angioplasty at a private hospital before he was charged. The lawyer also said that Hemanathan is a diabetic and has had a heart ailment since his remand. He also suffers from high blood pressure and high cholesterol. Deputy public prosecutor Ng Siew Wee opposed bail, claiming that reports issued by Sungai Buloh Hospital and a medical officer at the prison clinic indicated that their health conditions did not qualify them for bail.
