
No reprieve for ex-lorry driver as Federal Court dismisses final appeal in 2016 culpable homicide
A three-member bench consisting of Justices Datuk Zabariah Mohd Yusof, Datuk Nordin Hassan and Datuk Vazeer Alam Mydin Meera unanimously dismissed R. Kamaraj's final appeal against his conviction and sentence.
'We do not find any reason to disturb the findings of the courts below, both in terms of the conviction and sentence,' said Justice Zabariah, affirming the Court of Appeal's decision, which upheld the Seremban High Court's ruling.
Kamaraj, 35, was found guilty by the High Court for causing the death of M. Selvam, 39, in a school compound in Senawang, Negeri Sembilan, at 8pm on November 27, 2016.
He had initially been charged with two others – S. Kumaravelan and P. Tanabalan – for murder.
Tanabalan, 42, passed away before the trial started.
On December 29, 2021, the High Court convicted both Kamaraj and Kumaravelan, 31, for culpable homicide not amounting to murder. Kamaraj was sentenced to 18 years' imprisonment, while Kumaravelan received a 13-year jail term.
Kamaraj appealed to the Court of Appeal, but his appeal was dismissed on April 29, last year. He then brought his case to the Federal Court.
Kumaravelan, meanwhile, withdrew his appeal at the Court of Appeal.
During the trial, a florist testified that Selvam, her employee, was taken by three men, including the appellant, from her stall following a dispute involving money she had entrusted to Selvam.
The woman told the court that Kamaraj became enraged when Selvam admitted to spending part of the money and requested more time to repay it. She testified she had been in a relationship with the appellant (Kamaraj) at that time and had saved the money for their intended marriage.
Selvam was subsequently assaulted and was hospitalised. He later died from his injuries. — Bernama

Police: Bikers in deadly Seremban convoy pile-up hit themselves
KUALA LUMPUR, July 24 — A crash among three front-riding motorcycles triggered a massive 15-bike pile-up involving a car and a lorry that killed three riders early this morning, police said. Seremban district police chief ACP Mohamad Hatta Che Din said the accident occurred around 2.30am at KM 262.5 on the northbound lane of the North-South Expressway in Seremban. All 15 motorcycles had been travelling together in a group from Senawang towards Kuala Lumpur. The first collision caused the riders to fall on the highway, leading to a domino effect behind them. Twelve motorcycles failed to avoid the crash site and collided into the fallen bikes. Some of the motorcycles also struck the rear and right side of a passing car and a lorry. 'The accident led to the deaths of both riders of the Yamaha NVX motorcycles and one rider of an unidentified motorcycle model, who were all confirmed dead at the scene,' the police official said. Twelve others were taken to Hospital Tuanku Ja'afar, with two admitted to intensive care. Police said such incidents show the serious risks of riding in large, fast-moving groups on highways. They are now investigating the crash under Section 41(1) of the Road Transport Act 1987.

Anwar, govt cleared as court strikes their names from Mukhriz Mahathir's RM5m tax challenge
KUALA LUMPUR, July 24 — Datuk Seri Anwar Ibrahim and the government succeeded today in having their names removed from a judicial review application filed by Datuk Seri Mukhriz Mahathir. Mukhriz is challenging the Inland Revenue Board's (IRB) issuance of additional tax assessment notices for the years 2017 to 2019, demanding payment of over RM5 million. High Court Judge Datuk Amarjeet Singh allowed the application by Anwar, in his capacity as Finance Minister, and the government to strike out their names as respondents in the judicial review proceedings. However, the court dismissed their bid to expunge several paragraphs in Mukhriz's affidavit that made reference to both respondents, and fixed December 16 for the hearing of the substantive judicial review application. On January 2, Judge Amarjeet granted leave for Mukhriz to commence judicial review proceedings, having found that the case raised arguable grounds. Earlier, senior federal counsel Nur Irmawatie Daud, representing both the second and third respondents, argued that the additional assessment notices were issued by the first respondent, the Inland Revenue's chief executive officer or director-general. 'The judicial review application is scandalous, frivolous and an abuse of court process,' she submitted. However, Mukhriz's counsel, Syed Afiq Syed Albakri, contended that the second respondent had influenced the first respondent in the issuance of the said notices against his client. Mukhriz, 60, filed the judicial review application on December 20 last year, naming the IRB's CEO or Director-General, Anwar and the government as the first to third respondents respectively. The businessman sought an order to quash the decision of the first respondent to issue additional assessment notices for the years 2017 to 2019, amounting to RM5,020,707.18, on the grounds that the decision was unlawful and unreasonable. The Pejuang president also sought a declaration that the imposition of penalties under Section 113(2) of the Income Tax Act 1967 was null and void, as well as ultra vires. The former Kedah Menteri Besar further sought a declaration that the second respondent (Anwar) had abused his powers in causing the first respondent (the government) to issue the said notices. Finally, he sought a declaration that the second respondent had similarly abused his powers in directing the issuance of a certificate under subsection 104(1) of the Income Tax Act 1967. — Bernama

‘Planned on WhatsApp': Mara denies link to 15-bike convoy crash that killed three near Seremban
KUALA LUMPUR, July 24 — Majlis Amanah Rakyat (Mara) has denied organising the motorcycle convoy that led to a fatal crash involving 16 students from its affiliated institutions. The agency said the ride was a casual plan by the students and not an official event. 'Based on initial investigations, the convoy activity was an informal initiative casually organised by the students themselves through discussions in a WhatsApp group, without any official involvement from the institution or Mara,' it said in a statement. Three students from Kolej Poly-Tech Mara (KPTM) Bangi died in the crash, while nine others were injured and three escaped unharmed. One student from the German-Malaysian Institute (GMI) suffered minor injuries and is being treated at Hospital Tuanku Ja'afar in Seremban. The incident took place around 2.30am on the North-South Expressway near KM 262 as students returned from a late-night gathering in Seremban. Police believe the first crash occurred when a motorcycle lost control, causing a chain reaction among the group of 15 bikes travelling together. A second crash then took place when a lorry and a car stopped near the scene and another group of students tried to overtake them, colliding with the vehicles. Mara said the three deceased students were Haris Azib Sulaiman, Afkar Fitri Affendi, and Aliff Syahmi Abdul Hakim, whose bodies have been sent to their respective hometowns. The agency said it had channelled RM1,500 in condolence aid to the families and is processing insurance claims of up to RM38,000 for each victim, subject to policy terms. Mara expressed sadness over the tragedy and pledged continued support, including emotional and psychosocial assistance for the affected families and students. It also called for public patience as investigations continue, promising full cooperation with the authorities and a transparent follow-up process.
