After cops falter, Delhi man who killed woman over dog gets bail
A Mapusa court has granted bail to a Delhi man, Deepan Batra, who allegedly ran over a Mandrem woman with his four-wheeler after a dispute about a dog. The court said police did not follow the procedure of serving him with his grounds of arrest.
Batra's lawyer informed the court that Batra is a young man of 24 years, still a student, and coming from a reputed family with no criminal antecedents. He argued that Batra is experiencing incarceration as a victim of a media trial.
Bail was sought on the sole ground that he was not served with the grounds of arrest according to the mandate of law and Article 22(1) of the Constitution.
The investigating officer (IO) stated that Batra appeared at the police station along with his vehicle and parents.
After being thoroughly interrogated, Batra allegedly confessed to the crime and was placed under arrest after being informed of the grounds of arrest.
Intimation regarding his arrest was given to his father, and all Supreme Court guidelines were observed, the IO stated.
Public prosecutor R Barreto told the court that the memo of arrest bears the signatures of the accused and his father. Therefore, Section 47 of the BNSS was duly complied with, and there's no question of bail for non-compliance.
Additional Sessions Judge-2, Mapusa, Apurva R. Nagvenkar, however, held that the arrest memo 'does not contain various material details as required under the law, and therefore, it cannot be treated as communication of 'grounds of arrest' and therefore he's entitled to bail.'
The sons of the victim, Maria Fernandes, told the court that they come from a poor family and were supported by their mother, who used to sell tender coconuts at a shop.
Batra allegedly pushed one of Maria's sons, Joseph, and then assaulted Maria. Batra apparently became enraged after Joseph asked him not to bring his pet dog near their house.
Subsequently, Batra allegedly drove his car at high speed into Maria, who was standing on the road. The impact knocked her down and she was dragged some distance. But Batra didn't stop his vehicle.
Maria was declared brought dead at the Tuem health centre.

CHENNAI: Coming down heavily on the Tamil Nadu police for closing all the 124 complaints, at the preliminary stage itself, filed against former minister and senior DMK leader K Ponmudy for his alleged hate speech against women and Saivite and Vaishnavite denominations, the Madras High Court on Tuesday said the court cannot remain a mute spectator if politicians cross the limits. The AG also said BNSS allows the complainants to make appeals with the Inspector General (IG) concerned and the DGP. The investigating officers have found that the former minister had only spoken what was said 60 years ago and such speech would not fall under hate speech, the AG said.

Prisoners involved in narcotics cases outnumbered prison's capacity in Vizag
1 2 Visakhapatnam: The central prison in Visakhapatnam is facing a severe overcrowding crisis, with inmates held for narcotics-related offences — primarily ganja — far exceeding its sanctioned capacity. Designed to house 914 prisoners, including 80 women, the prison currently holds 1,764 inmates, nearly double its intended limit. Of these, 1,020 inmates are linked to narcotics cases, comprising 47 male convicts and 973 undertrial prisoners. Around 58% of the total prison population is now made up of individuals accused or convicted under the Narcotic Drugs and Psychotropic Substances (NDPS) Act. Speaking to TOI, jail superintendent M Mahesh Babu noted that over 55% of undertrial prisoners are in custody due to cannabis-related offences. He added that nearly 300 inmates from other states have been held for six months to a year, struggling to secure bail due to legal and logistical hurdles. The NDPS Act categorizes offences based on the quantity of drugs seized: up to 1 kg, between 1–20 kg, and above 20 kg. Explaining the reasons for accused in cannabis cases finding it difficult to get bail, advocate and special public prosecutor for customs, NCB and DRI, YN Srinivas said majority of the accused and inmates in narcotics related offences are linked to detection of commercial quantities of ganja (above 20 kgs ). Similarly, the accused are from other states and who do not have any connections in Vizag, because of which they cannot secure the local Sureties. Courts cannot jump to a conclusion that the accused has not committed the offence and hence courts are not granting bail in case of commercial quantity as defined in the NDPS Act. Chennai: From where did the Tamil Nadu police draw power to close all 112 complaints against former DMK minister K Ponmudy for his alleged derogatory statements against women, Shaivites, and Vaishnavites, asked Madras high court on Tuesday. In response, advocate general P S Raman submitted that all the cases were closed after following due process by conducting a preliminary inquiry under the Bharatiya Nagarik Suraksha Sanhita (BNSS). It was concluded that the speech did not amount to hate speech; therefore, the complaints were closed, the AG added. The remedy available to the complainants does not end here. Under BNSS, they have an option to appeal to the inspector general and the DGP if they are not satisfied with the findings of the investigating officer, AG said.
