Prominent opposition parties have given their in-principle approval to support the motion to remove Allahabad High Court judge Yashwant Varma and the process of collecting signatures could begin soon, Union minister Kiren Rijiju said on Thursday. He said the government is yet to decide whether the motion would be brought in the Lok Sabha or Rajya Sabha. For Lok Sabha, signatures of a minimum 100 MPs is required. For the Rajya Sabha, the requirement is the support of at least 50 MPs.He said the signatures will be collected after the government decides on the House where the motion will be brought. The Monsoon session will commence from July 21 and end on August 21.According to the Judges (Inquiry) Act of 1968, once a motion to remove a judge is admitted in any of the houses, the speaker or the chairman, as the case may be, will constitute a three-member committee to investigate the grounds on which the removal (or, in popular term, impeachment) has been sought. The committee consists of the Chief Justice of India (CJI) or a Supreme Court judge, the chief justice of one of the 25 high courts and a "distinguished jurist."Rijiju said since the matter involves corruption in the judiciary, the government wants all political parties to be on board. On being asked about the report of the in-committee which proved the cash discovery incident at Justice Varma 's official residence here, he said the report of the three-judge panel had not indicted Justice Varma and was meant to recommend future course of action as Parliament can only remove a judgeA fire incident at Justice Varma's residence in the national capital in March, when he was a judge at the Delhi High Court, had led to the discovery of several burnt sacks of banknotes in the outhouse.Though the judge claimed ignorance about the cash, the Supreme Court-appointed committee indicted him after speaking to a number of witnesses and recording his statement.Then-CJI Sanjiv Khanna is believed to have prodded him to resign but Justice Varma dug in his heels. The apex court has since repatriated him to his parent court, the Allahabad High Court, where he has not been assigned any judicial work.Justice Khanna had written to the president and the prime minister, recommending the removal, which is the procedure for axing members of the higher judiciary from service.

"Final Extension": Court Extends Rape Convict Asaram's Interim Bail By A Month
Ahmedabad: The Gujarat High Court on Thursday extended self-styled godman Asaram's temporary bail by one more month, but made it clear that it would be the "final extension". Sentenced to life imprisonment in a 2013 rape case, Asaram (86), is on bail on medical grounds. The division bench of Justices Ilesh Vora and PM Raval extended Asaram's temporary bail by one more month. Before the bail granted to him by the court on March 28 expired on June 30, the court had granted him an interim extension till July 7. During a hearing on Thursday, Asaram's lawyer sought that the bail be extended for three more months. However, the HC said it would extend the bail for only one more month and that it would be the "final extension". A detailed order is awaited. Asaram had approached the high court when the interim bail granted to him by the Supreme Court till March 31 on medical grounds was coming to an end, as the apex court had directed him to do so if he needed any extension. The division bench of the high court had then delivered a split verdict, after which a third judge to whom the matter was referred granted him three-month temporary bail. In January 2023, a court in Gandhinagar had sentenced Asaram to life imprisonment after convicting him a rape case. Asaram is also serving life sentence in another case of raping a minor girl at his ashram in Rajasthan in 2013. In the present case, he was convicted for raping a woman disciple, who hailed from Surat, on several occasions from 2001 to 2006 when she was living at his ashram at Motera near Ahmedabad. He was convicted under Indian Penal Code sections 376 2 (C) (rape), 377 (unnatural offences), 342 (wrongful detention), 354 (assault or criminal force to woman with intent to outrage her modesty), 357 (assault) and 506 (criminal intimidation).

Anti-Ragging Act: Kerala HC tells govt to share copies of draft amendments with stakeholders
Kochi: High court on Thursday directed the state govt to share copies of the draft amendments to the Prohibition of Ragging (Kerala) Act and Rules with stakeholders, including the counsels for Kerala Legal Services Authority (KeLSA) and University Grants Commission (UGC), within a week. The directive was issued by the bench of Chief Justice Nitin Jamdar and Justice C Jayachandran in a petition filed by KeLSA, which sought a direction to the govt to reassess the Act and frame rules to ensure the effective eradication of ragging. During hearing, director general of prosecution (DGP) placed on record a communication from the home department additional chief secretary stating that the subcommittee constituted for preparing the draft amendments had submitted the same. It was further informed that the home department is currently seeking comments from stakeholder departments before proceeding with the finalisation of the amendments. However, HC observed that the drafts had not been placed before the bench and accordingly directed the state to furnish copies to the counsels for KeLSA and UGC to facilitate their suggestions. Meanwhile, KeLSA's counsel requested that the proposed amendment include a broad definition of 'educational institution' to curb the menace of ragging both within and beyond campus premises. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like Giao dịch CFD với công nghệ và tốc độ tốt hơn IC Markets Đăng ký Undo KeLSA had filed the public interest litigation in response to the ragging incident at the Government College of Nursing, Kottayam, where junior students were reportedly subjected to severe physical abuse, including the tying of dumbbells to their private parts. Subsequently, the court impleaded the UGC as a respondent and sought its views on the petition.
