Kochi: High court has stated that a married woman cannot claim that she was induced into sexual relations on the false promise of marriage.
The bench of Justice Bechu Kurian Thomas made the observation while granting bail to an accused in a case where he allegedly sexually assaulted a married woman on the pretext of marriage, threatened to publish her photos and videos, and borrowed a total sum of Rs 2.5 lakh.

Counsel for the petitioner/accused contended that the victim is a married woman and, therefore, there cannot be sexual intercourse based on a promise to marry. He further submitted that a reading of the FIR indicates that the case is primarily based on a financial claim and the allegation of rape on the promise of marriage has been raised only to compel the petitioner to yield to her unlawful demands.
The petitioner was arrested on June 13 and has been in custody since. Upon perusal of the records and previous decisions of the court, the bench observed that it is prima facie doubtful whether the offence under Section 69 of the Bharatiya Nyaya Sanhita (BNS) is attracted, as a promise to marry cannot arise when one of the parties is already in a subsisting marriage. Additionally, the offence under Section 84 BNS, pertaining to enticing, taking away, or detaining a married woman with the intent to have illicit intercourse, is bailable, and therefore, the continued detention of the petitioner is not warranted, the court noted.
Further, the court granted him bail on execution of a bond for Rs 50,000 with two solvent sureties each for the like amount, to the satisfaction of the court having jurisdiction.

New Delhi: Legal experts from the US and the UK are leading the efforts to file lawsuits against Boeing - the manufacturer of the aircraft that crashed on June 12 in Ahmedabad. The AI171 crash was one of the worst in recent history, in which 241 people onboard the plane were killed and only one survived. Air India had announced that it would provide an interim compensation of Rs 25 lakh or approximately GBP 21,500 to the families of each of the victims and survivors of the airline's crash to help address immediate financial needs. This, it said, is in addition to the compensation of Rs 1 crore announced by its parent company, Tata Sons. However, families of the victims have accused the Tata Group-owned airline of "forcing" them to make financial disclosures under the "threat of receiving no advance compensation", even as the carrier "categorically rejected" the allegations and said efforts are being made to process the payments. 'Nothing Wrong Has Been Done' Speaking to NDTV, James Healy-Pratt, Aviation Partner, Keystone Law, London, who is leading the legal effort, countered the claim and said, "In my view, and having spoken with a lot of British families, I can see nothing that has been done wrong by Air India or their insurers." James Healy-Pratt and Owen Hanna from UK-based Keystone Law, along with aviation experts from the US-based Wisner Law Firm, are leading the legal effort. A similar case will be filed against Air India in the High Court in London. According to Stewarts, the UK's largest litigation-only law firm, families of the victims alleged that they are being forced to fill out a questionnaire "in intense heat with no guidance on the terms and questions within it". Mr Healy-Pratt, however, said He was in contact with the London lawyers for Air India and their insurers yesterday, and I made the same point. "Look, let's concentrate on helping the families process the a non-issue. There's no point driving between families and Air India. I mean, why would one do that?" 'Focus Primarily On Air India, Boeing' "The focus is primarily on Air India and aircraft manufacturer (Boeing) has had a checkered past over the last decade," he said. Mr Healy-Pratt pointed out the whistle-blowing issues that have surrounded Boeing for several years. "The Boeing 737-Max's, the deferred prosecution in the United States and billions of dollars of more importantly, it's the consensus among the deployment of Ram Air Turbine (RAT)...Now we don't know at what point, we are assuming it was probably just past the rotation." Ram Air Turbine or RAT - a small propeller-like device is deployed automatically when there is a dual-engine failure or total electronic or hydraulic failure. He said that there are 10 reasons for the deployment of RAT if we look at the Flight Crew Operating Manual (FCOM), adding that there are three primary reasons: Double engine failure, an electric failure or a hydraulic failure. He said, "That's bad news if you've just taken the question is what caused the RAT to deploy." The legal expert said the preliminary report will provide some indication about what added that there is consensus that there was a loss of thrust. The planned lawsuits would be separate from any other efforts Tata Sons, which owns Air India, might be making to support or compensate the victims' families, including financial help. The Montreal Convention 1999 establishes airline liability in the case of death or injury to passengers, as well as in cases of delay, damage or loss of baggage and cargo. Air India would need to fully meet the compensation norms of the Montreal Convention in financially supporting the families of those who have been killed in the crash.

The Uttar Pradesh Police busted an interstate drug-trafficking racket and arrested four people involved in smuggling high-grade marijuana. The police recovered 108 kilograms of ganja, approximately worth Rs 20-25 lakh, from Noida's Sector 88. The gang was smuggling the drugs from Odisha by hiding them inside empty inverter shells and transporting them via train, officials said. Shakti Mohan Avasthy, DCP Central Noida said, "Nearly 108 kg of marijuana has been seized. Their modus operandi was to hide around 6 kg of marijuana in each of 18 inverter bodies." In their post on X, UP Police took a dig at smugglers, acknowledging their "plan was clever, but the law was smarter." "Inverters are for power, not poison…. The police stated that Abdullah never went to school, Sovan studied until Class 5 and Shabaan and Sameer Hasan until Class 8. All four accused used to work as manual labourers to earn their livelihood. They told police during questioning that the plan for drug smuggling was hatched during a late-night drinking session when they got in touch with Ayush, a man based in Odisha, who allegedly runs a drug network. Ayush, who orchestrated the entire operation, was connected to them via WhatsApp. He arranged the plan to supply marijuana and helped conceal the drugs inside the inverter body. They would take out the inverter shells at railway stations with no or minimal security checks, according to a report. After that, they would transport it to a secure location in Noida and from there, the drugs were distributed among local dealers, who further sold them to hostel and college students across Noida. The investigation to catch the kingpin of the racket is underway.

Kolkata: The governing body of South Calcutta Law College at whose campus a student was allegedly gang raped had passed a resolution to renew the appointment of the accused, Monojit 'Mango' Mishra, in August 2024. 'Mango' Mishra has been sacked now. He had been working as a temporary employee of the college on contract. NDTV has seen a copy of the resolution to renew his contract passed by the college's governing body, whose president is Trinamool Congress MLA Ashok Deb. Mr Deb told the college's vice principal to issue an appointment letter to 'Mango' Mishra, according to the resolution. The governing body's register and the attendance log of temporary employees have been seized for investigation, Kolkata Police sources said. The governing body register has records of all communications and minutes of meetings. According to the college vice principal who is also the governing body's secretary, 'Mango' Mishra signed up as an ad-hoc staffer as per the Bar Council's rules following the increase in the number of academic subjects. He was paid a stipend of Rs 500. However, allegations have surfaced that no process was followed in appointing 'Mango' Mishra. The contract of the man, who now faces allegations of gang rape, was renewed within 45 days and not after six months as mandated by rules, from the expiry of the previous contract. This happened under the supervision of Mr Deb, the Trinamool Congress MLA. Many professors and students were upset with the decision as they knew 'Mango' Mishra had a criminal background. Two other accused in the case, Zaib Ahmed and Pramit Mukherjee, who were still studying in the college, have also been expelled. 'Mango' Mishra took admission in 2013, but was rusticated the same year for allegedly stabbing a man. He resurfaced in 2017, took readmission and graduated in 2022. He describes himself on social media as a practising criminal lawyer. "In December 2016, he was accused of leading a mob of outsiders to vandalise the college premises. FIRs and counter-FIRs were lodged at the Kasba police station in connection with the incident, but for some unknown reason, the cases got dropped," Titas Manna, a former student, told NDTV. There are at least seven first information reports (FIRs) and other complaints filed against 'Mango' Mishra with several police stations in south Kolkata, including many allegations of sex assaults. The college's governing body said it will apply for cancellation of 'Mango' Mishra's Bar Council membership.
