Comelec lifts proclamation suspension vs. Manila councilor
According to a ruling dated June 18, this is in compliance with a temporary restraining order (TRO) the Supreme Court (SC) issued against the Comelec decision in May.
'In compliance with the TRO issued by the SC on 22 May 2025 enjoining the Commission on Elections from implementing the Resolution of the Commission (Second Division) and the Commission (En Banc) in SPA No. 24-263 (DC) promulgated on 21 March 2025 and 05 May 2025, respectively, the Order of the Commission (En Banc) dated 12 May 2025 insofar as the Respondent Darwin B. Sia is concerned, is hereby lifted, effective immediately,' the ruling reads.
'The City Board of Canvassers of the 2nd District of Manila, are hereby directed to reconvene within five days from the receipt of this Order for the purpose of proceeding with the proclamation of Respondent as a winning candidate for the position of Member, Sangguniang Panglungsod in the 2nd District of the City of Manila,' it added.
Sia was disqualified for material misrepresentation when he filed his candidacy despite being convicted of electricity pilferage, which, according to the Comelec, constitutes moral turpitude.
Under the Omnibus Election Code, an individual is disqualified to be a candidate for an elective position and to hold any office if such a person has been sentenced by a final judgment for a crime involving moral turpitude.
The Comelec en banc upheld the decision to cancel his COC earlier this month.
Despite the Comelec's decision, Sia garnered the highest number of votes for councilor in Manila's second district in the May 12 elections. —LDF, GMA Integrated News

The Commission on Elections (Comelec) en banc has issued a certificate of finality and entry of judgment on the disqualification of Joey Chua, clearing the way for the proclamation of his rival, Benny Abante, as the duly-elected Representative of the 6th District of Manila in Eleksyon 2025. On Monday, the en banc said the decision junking the motion for reconsideration (MR) filed by Uy against the June 18 resolution that voided his certificate of candidacy (COC) became final and executory after the Supreme Court (SC) did not issue a temporary restraining order (TRO) against the ruling within the five-day reglementary period. 'The records show that no restraining order has been issued by the SC with five days from receipt of the parties of the Resolution that would preclude the June 30, 2025 resolution of this Commission (En Banc) from being final and executory,' the certificate of finality reads. 'Now therefore, in view of the foregoing, the Resolution of the Commission (En Banc) promulgated on 30 June 2025 is hereby declared immediately executory in accordance with the Comelec Rules of Procedure,' it added. The Manila City board of canvassers were likewise directed to reconvene and proclaim Abante as the Manila 6th District representative. The poll body en banc last week upheld a resolution declaring Abante as the winner of the congressional race for Manila's 6th district in the recent May 12 midterm elections. Poll chief George Erwin Garcia previously said that based on Comelec rules, a local poll body office should first issue a notice of meeting of the BOC to inform all parties that they will convene and discuss the details for the proclamation. Businessman Chalie 'Atong' Ang said he gave Julie 'Dondon' Patidongan P12 million for his mayoral campaign in the last elections. According to John Consulta's report on '24 Oras,' Ang said Patidongan asked for money from the other members of their group after he lost. It also showed that Patidongan was a member of the PFP. Partido Federal ng Pilipinas president Reynaldo Tamayo Jr. confirmed to GMA News Online that one Julie ''Dondon'' Patidongan ran for mayor of Barobo, Surigao del Sur in the recent midterm elections. Tamayo, however, did not know Patidongan personally as he was only introduced by the party's provincial chairman. President Ferdinand 'Bongbong' Marcos Jr. is the chairman of the PFP. Asked if the President knows Patidongan, Castro said there is no information yet on the matter. 'Sa ngayon, wala pa pong nakakarating sa atin patungkol sa ganyang issue,' she said. The project was funded by the Japanese government through a grant worth ¥234 million, or over P91 million, and will be part of the preparations for the Bangsamoro elections. Kaya lang kung dito, napakaganda ng recording,' said Garcia. (We hope that in the elections to come, candidates will use Project SURI to submit SOCEs.) Candidates who will not file SOCEs will be charged with an administrative offense and will be liable to pay a fine ranging from P1,000 to P30,000.00 at the discretion of the poll body, with the exception of aspirants at the barangay level. For winning bets or political parties, failure to comply may also withhold their assumption of office. Section 13 of RA 7166 provides the limitation of authorized expenses of candidates and political parties. It states that candidates vying for the presidency and vice-presidency shall spend P10 for every voter currently registered in the constituency where they filed their certificate of candidacy. Aspirants with political parties will be allowed to spend P3 for every voter while independent candidates will be allowed up to P5. Political parties, for their part, are allowed up to P5 for every voter currently registered in the constituency or constituencies where it has official candidates. 'Gagawin natin yan di lang as Bangsamoro pero all elections to come. Ito na ang ating magiging standard — iinstitutionalize na natin ang online submission bagamat may mags-submit pa rin ng personal,' said Garcia.
