Supreme Court allows M3M's plea to substitute attached land with commercial units

The Supreme Court has allowed realty developer M3M's plea to substitute land attached under the Prevention of Money Laundering Act (PMLA), with other commercial property of similar value so that the developer can monetise the land. In it's order on June 30, the SC has said the order 'shall not be treated as precedent'. In July 2024, Directorate of Enforcement (ED), had provisionally attached immovable properties, spanning 88.29 acres and valued at Rs 300.11 crore belonging to M3M India in an ongoing case. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like War Thunder - Register now for free and play against over 75 Million real Players War Thunder Play Now Undo 'While the SC has allowed the substitution of land by the order, the Court has made it categorically clear that this decision would not considered as a precedent. In cases where there is a fact specific adjudication by the SC, it is a usual practice to make it clear for the subordinate Courts that facts of each case would be considered on its own merits and the judgment would not be a binding precedent,' said Ashish K Singh, Managing Partner, Capstone Legal. M3M has given details of 317 commercial units valuing Rs 317 crore which will be attached. Live Events In order to assess the fair market value of the said commercial units, this Directorate engaged valuator registered with Income Tax Department. 'While the land can be monetised and project can offer 10 times revenue than the land value, the value or commercial units are not likely to increase further. The decision will improve M3M's revenue and cash flow and will also help in business continuity,' said a real estate expert. The substitution is subjected to developer following conditions put by ED, which include, submission of no encumbrance certificate, undertaking not to alienate, submission of title documents, indemnity bond, undertaking to safeguard the third party rights created for other commercial units of the project, consent to hand over possession of alternate assets, disclosure of source of acquisition funds, cooperation with investigation and no prejudice to ongoing investigation or trial. 'This is a progressive order and will positively influence other ongoing matters of a similar nature. Notably, the substitution mechanism does not dilute enforcement power under PMLA. Rather, it strengthens procedural fairness and reflects a maturing jurisprudence that understands the real-world implications of criminal law on business continuity,' said Parimal Tripathi of Sutradhar Associates.

Amid caste conflict in region, black flags to greet Akhilesh

1 2 Varanasi: As caste conflict raises its head in the wake of incident related to Bhagwat 'katha vachaks' in Etawah, some Brahmin groups are threatening to show black flags to Samajwadi Party chief Akhilesh when he comes there to open his party office-cum-residence in Azamgarh on Thursday. Vishwa Hindu Mahasabha's Harivansh Mishra said the SP supremo was capable of calling both groups in Etawah and resolving their issues, but unfortunately, he chose politics instead of remembering how leaders like late Janeshwar Mishra contributed to the rise of SP. He said that due to the role of the SP chief in this episode, Brahmins were going to display black flags at their homes on Thursday when Akhilesh arrived in Azamgarh. In another development, a group of members of Scheduled Caste allegedly constructed a wall on the route leading to the temple of Lord Hanuman in Chandapur village. As the priest of the temple locked the 200 years old temple and warned to halt prayers till the wall was removed, a large number of Bajrang Dal activists and villagers set up a front. In response, the SC group reached district headquarters to meet officials to ensure the wall was not removed. In view of the tense situation in the village, PAC and RAF forces were rushed in and remained deployed even on Tuesday. Varanasi police commissioner Mohit Agrawal said both groups failed to resolve the issue. The district magistrate formed a committee to check the status of the land of the temple and road in revenue records and till the time the committee filed investigation report, both groups were directed to maintain status quo. Agrawal said forces would remain deployed till the issue was resolved. Before the administration and police could douse the flames of this dispute, another attempt to fan caste clashes was made in Chandapur on Jun 29, when a local, Ramkishan, called Cholapur police station in charge and claimed that some Brahmins in the village were vandalising an Ambedkar statue. To investigate the matter, sub-inspector Abhijit Singh, reached the spot and found the statue undisturbed. FIR was lodged against the caller on charges of attempting to incite a clash between Brahmins and SC members. Jaunpur police also had to rush to Takha Purab village under Shahganj police station area on Monday when some anti-social elements vandalised an Ambedkar statue, to pacify locals. In Azamgarh, where SP leaders are busy preparing for grand opening of the new residence of party chief Akhilesh Yadav , many groups reached district headquarters demanding action against those making derogatory remarks against Brahmins, especially women. On Tuesday, office-bearers and workers of Akhil Bharatvarshiya Brahmin Mahasabha reached district headquarters with their demand for immediate arrest of four accused of provoking emotions on caste lines and targeting Brahmins and their women. The organisation's national vice president Subhash Chandra Tiwari, district president Abhishek Pandey and other office-bearers said the Etawah incident was a matter of concern and though administration was taking action, the issue had been politicised. They said neither all Brahmins, nor all Yadavs indulged in disturbing harmony, hence all responsible leaders and persons should ensure that social unity was not disturbed. They submitted a memorandum demanding strict action against those trying to create disharmony on caste lines.
