New Delhi, Jul 26 (PTI) The Delhi High Court has set aside a decision of sentence review board denying premature release to a man, convicted for hijacking an Indian Airlines flight with 192 passengers in 1993.
The court noted that convict Hari Singh's conduct in jail indicated elements of reformation.
Singh was convicted and sentenced to life imprisonment for the offences under Section 4 of the Anti-Hijacking Act and Sections 353, 365 and 506(II) of the Indian Penal Code.
He was convicted by the trial court in 2001. His appeal was rejected by the high court in 2011, and the special leave petition was withdrawn from the Supreme Court.
It was his case that his name was periodically taken up for consideration of premature release by the SRB but it was consistently rejected on the ground of gravity of the offence.
As of May 12, Singh had undergone 17 years, 11 months and six days of actual imprisonment and 22 years, six months and 20 days of total imprisonment, including remission.
Granting relief to Singh, the court said the reasoning provided by the SRB while rejecting Singh's application was inadequate and did not meet the requisite standards of reasonable justification necessary for an order passed by an executive authority under administrative mandate.
'Petitioner's conduct in jail does indicate elements of reformation, as even over a long period of incarceration (almost 18 years of actual imprisonment), there is no record of any untoward incident which would indicate that the petitioner still harbours elements of criminality,' the court said.
It set aside the latest minutes of the SRB meeting of April 24 this year and asked the board to reconsider the case. PTI SKV RHL

Abuzair Safi and his accomplice Aman Sukhla have been arrested for attempting to kill the woman on Wednesday. The arrests were made on Thursday and Friday. According to the police, two men on a black motorcycle fired at the woman on Wednesday. Safi, who had been granted bail for a rape case the woman filed last year, allegedly fired at her. Police arrived at the scene and found an abandoned auto-rickshaw. Agency: PTI Last Updated: Bareilly (UP), Aug 3 (PTI) A Nepalese woman, who had come to Bareilly in search of a job, was allegedly beaten by a mob on suspicion of theft, police said on Sunday. The woman, identified as Sushmita Saru Magar alias Kajal, hailing from the Pokhara district in Nepal, was admitted to the hospital in serious condition, they added. According to police, the incident occurred on Saturday night when the woman was staying at the house of an acquaintance, Vinay Gangwar, in Baradari. She had stepped onto the terrace around 1 am while on a phone call when some residents mistook her for a thief. Quila police station officials said the residents raised an alarm, shone torchlights toward her, and chased her. Frightened, she tried to open the terrace door. Failing to do so, she jumped off the roof in panic and fell to the ground. She was then beaten with sticks by the mob. A video of the incident surfaced on social media, showing the woman pleading with folded hands, repeatedly saying, 'I am not a thief," but the mob continued to assault her. Senior Superintendent of Police (City) Manush Pareek said that based on the video evidence and the victim's complaint, a case has been registered, and four accused — Gaurav Saxena, Shivam Saxena, Aman Saxena, and Arun Saini, all residents of Baradari — have been arrested. Efforts are on to identify and arrest the remaining accused, he said. The victim told police she used to work in Noida but had lost her job and had come to Bareilly through a known contact to look for work.
