Deposition of 12-year-old eyewitness key as court gives Noida man life term for wife's murder

Noida: A man facing trial for killing his wife in 2018 was convicted and sentenced to life imprisonment by an additional district and sessions judge, the clinching deposition coming from the victim's nephew, who was 12 years when the crime was committed.
The court, however, did not find this to be a case that could be considered 'rarest of rare', the judicial yardstick to decide whether a deaths sentence can be given, and awarded the life term under Section 302 of IPC, besides slapping a fine of Rs 10,000 on the convict.
Raju alias Abbas aka Aslam, a resident of Sector 5, was accused of stabbing his wife Rubi with a knife while she was accompanying other family members to her sister's tea stall near Noida Authority's office on Aug 4, 2018.
The FIR was based on a complaint filed by Rubi's brother Shahrukh Khan. Shahrukh wasn't an eyewitness. He was told about the incident by his mother Jamila Khatun and nephew Rajan. Rajan (12) was with Rubi.

Raju, who was arrested on Aug 9, denied the charges and said Rubi was killed by her previous husband, Rafiq. He also argued he was in Bandra (Mumbai) at the time of the killing. "On hearing about the murder, I returned to Noida on Aug 6 to lodge an FIR against Rafiq, but police arrested me instead," he told the court.
The prosecution presented the murder weapon, a kitchen knife, and the shirt worn by the assailant during the incident, which had blood spots, as evidence. Shahrukh informed the court his sister was indeed married to Rafiq in 2011 but had left him and married Raju in 2014. Raju and Rubi, he said, had a three-year-old son. "Raju would often quarrel with my sister, accusing her of continuing her relationship with her previous husband.
It was on this issue that he attacked her," he told the court.
Rajan's testimony became crucial because only he and Jamila were eyewitnesses in the case and Jamila died before she could testify. That made Rajan the star witness. He told the court he saw Raju attack his 'mausi (aunt)' with a knife, stabbing her in the chest and stomach. He said he tried to catch Rajan but was pushed back by him. "My grandmother (Jamila) fainted.
With the help of people on the street, my mausi was taken to hospital," he said.
The defence argued that police did not conduct a fingerprint examination on the knife and there were discrepancies in the timekeeping of the murder. "While the complainant has mentioned 2pm as the time of the incident, hospital records show that the body was brought for postmortem at 1.35pm," the defence counsel pointed out.
This was, however, rejected by the court on the ground that the complainant was not present on the spot. Citing rulings of various high courts, additional district and sessions judge Sanjay Kumar Singh Pratham said it was not mandatory on the part of the prosecution to conduct a fingerprint examination when the murder weapon was recovered from the accused and an eyewitness was available to testify.
The judge ruled that culpable homicide was proved beyond doubt by the prosecution, but the circumstances and the weapon used do not fall in the 'rarest of rare' category, warranting a life term, not capital punishment.

Lucknow: UP STF on Friday arrested three persons, including a B Pharma student, from Bhopal for a cyber scam in which they lured victims through social media platforms by promising handsome returns on completing fake "tasks. Initial earnings were credited into fake wallets to build trust, but as victims invested more, they were trapped in an endless cycle of deposits, losing lakhs in the process." Those arrested included the alleged mastermind and a B Pharma student at Bhabha University, Bhopal, Shivansh Mishra (22) of Shahdol (MP). His childhood friend Ravi Singh (23) also from Shahdol, and maternal uncle Umashankar Tiwari (43) of Bhopal were also arrested. Police also seized three mobiles, 16 debit cards, 15 cheque books, nine bank passbooks and 359 screenshots of incriminating WhatsApp conversations related to cyber fraud, one PAN card, one driving licence, and one IGT Solutions employee ID card. One of the complainants, Ashish Vikram Singh from Amethi, filed an FIR, detailing how he was targeted. Ashish received a Facebook link promoting a "work-from-home reward scheme." Upon clicking, he was added to a Telegram group where he was assigned digital tasks. After depositing Rs10,000, he received a bonus of Rs 2,512, giving the appearance of legitimacy. Encouraged, Ashish completed 28 rounds of "tasks". At one point, a balance of Rs 9.13 lakh appeared in the digital wallet, and he was promised he could withdraw it after completing a final task worth Rs 3.16 lakh. Tired of too many ads? go ad free now But when he attempted to withdraw, he was told to deposit additional "security amounts" — first Rs 2.25 lakh, then Rs3 lakh more, and finally Rs 6.3 lakh for "VIP access." Ultimately, he was defrauded of Rs13 lakh. The ASP said Shivansh and Ravi were briefly recruited at a Bhopal call centre operated by IGT Solutions. There, they met cyber fraud recruiters — Zubair Khan, Saif Khan, and Anil Nayar and Amit Nayar — who ran a parallel racket involving rented bank accounts. For every new bank account with full access kits (ATM card, cheque book, SIM card, login credentials), Shivansh and the team were paid Rs15,000 and a share in the illicit earnings. They created nearly 50 bank accounts over the last year, often using forged documents or by convincing acquaintances. These accounts served as primary money mules.

Lucknow: As part of its 'Operation Conviction' campaign, the Uttar Pradesh govt has secured four death penalties and fast-tracked 458 cases of heinous crimes under the new criminal laws since July 2024. These include death penalties for four criminals in Badaun, Hathras and Kanpur Dehat, life imprisonment for 10, over 20 years' jail for 19, and under 20 years' jail for 425 offenders. Total number of convictions secured in the last two years, since July 2023, has crossed 97,000, officials said. Union home minister Amit Shah hailed UP's legal efficiency at the Central Zonal Council meeting in Varanasi earlier this week and termed it as a model for the country. Director general, prosecution, Deepesh Juneja said swift trials, robust evidence presentation, and video testimony helped fast-track convictions and saved Rs 25 crore through reduced court appearances. "The transformation of UP under Chief Minister Yogi Adityanath is drawing national and international praise. Lucknow: Ten fresh FIRs were registered against Ansal API on Thursday and Friday at the Sushant Golf City police station, taking the total number of cases filed against the real estate giant in Lucknow to 224. The complaints allege fraud related to undelivered flats, villas and plots amounting to over Rs1.72 crore. Tanuja Krishna Dubey of Railway Officers' Colony, in her complaint said her late father booked a plot in 2011 and paid Rs 33.60 lakh by 2015. Despite multiple requests, the registry was never executed. After her father's death in 2022, Tanuja was allegedly threatened by company representatives when she asked for the registry to be transferred to her name. Dr Shachi Tripathi from Gurugram alleged that she paid Rs 25.32 lakh for a plot that was never transferred to her. Similarly, Amiyaket Singh from Gomtinagar accused the company of duping him of Rs 10.47 lakh for a plot.
