New housing law could see people lose emergency accommodation if offers are repeatedly refused

The Government is to give local authorities new powers to strip offers of emergency accommodation from people if they repeatedly refuse offers of social housing.
It will also require those on waiting lists to demonstrate their commitment to staying in Ireland long-term.
The proposed changes to the law come amid a significant increase in the number of people entering into emergency accommodation in recent years.
Under current rules, anyone is able to present to a local authority and seek emergency accommodation supports.
However, concerns have been raised about the lack of pathways to exit migrants from emergency accommodation, given many do not qualify for social housing supports. Over 5,000 people who had leave to remain in Ireland did not have their own accommodation and were in International Protection Accommodation Services (IPAS) housing across the country according to the most recent figures.
The department of housing previously established a working group to examine changes to homelessness legislation, after concerns were raised by the County and City Managers Association. The group itself called for the introduction of specific powers to allow local councils to withdraw offers of emergency accommodation, in specific cases.
These cases include where an individual or household has repeatedly rejected offers of housing, or if their presence in emergency accommodation is threatening the safety of staff or other individuals.
The group called for the introduction of specific eligibility criteria to access emergency accommodation. This means if a household or individual is not eligible for social housing supports, a council does not need to provide them with emergency accommodation.
The Government is also expected to progress legislation around social housing eligibility which would require any individual applying for social housing to be resident here and have a long-term intention to remain.
Progress began on these laws last year as the Housing (Miscellaneous Provisions) Bill 2024. It progressed through pre-legislative scrutiny in the Oireachtas housing committee. The two elements are expected to be progressed side-by-side.
In a separate memo, housing minister James Browne told Cabinet last week that an independent appeals mechanism will be needed in legislation designed to update social housing rules. This is seen as a move that would improve "transparency and consistency" in the allocation of social housing system. He is to return to Cabinet in the coming weeks with more detailed proposals.
His housing bill also aims to add provisions which would mean that any non-national must have deep ties to the State, making habitual residency a condition of accessing public housing. It is understood that ministers have been told that the State must make efforts to ensure that applicants are "demonstrably residing in Ireland", a move which is seen as "consistent" with arrangements in social protection.
It is understood that time spent in temporary protection would not count towards the time that a person was considered habitually living in Ireland.
The general scheme of the bill had made it as far as pre-legislative scrutiny last summer before the plans were shelved. The current version has undergone extensive legal advice. In its pre-legislative scrutiny of the bill last year, the Oireachtas Housing Committee recommended "further clarity be provided in the legislation as to whether residency and the Habitual Residency Condition (HRC) are to be an additional eligibility criterion, or form a precursor to an eligibility assessment".
It said if they were to be used as a separate prerequisite assessment, then "due consideration must be given in legislation to ensure that it meets the requirements of fair procedure and natural justice".

Mr Harris said organisations that want to 'show their Christianity' must step up to the plate and bankroll what is likely to be the largest and most expensive redress scheme in the history of the State. There are serious concerns within the Government about the costs of and demand for a redress scheme for survivors of sexual abuse in schools. Asked if the State could afford such a scheme, Mr Harris said the Government will return to the issue of redress 'at a future point'. But, he said, 'should we arrive at a point of a redress scheme', the people who should be paying for it 'are the people who allowed the abuse to be carried out'. Mr Harris said he was 'with the survivors,' who 'rightly want to see the perpetrators pay'. 'I'll endeavour to be diplomatic, but I think it's highly questionable some of these organisations who play the poor mouth when many of these are very, very well resourced organisations. Very well resourced,' Mr Harris. The Tánaiste declined to say if he felt such religious organisations should have to contribute even if it made them insolvent, saying: 'I don't want to get into that language.' 'But I think they have to make a very significant, a very, very significant contribution. In fact, to be honest, I think the word 'contribution' is wrong. The buck stops with them,' he said. 'I think if people accept accountability, if people want to show their Christianity, I think they have to really step up to the plate here.' Analysis by officials from the departments of Education, Justice, Children, an Taoiseach and Public Expenditure and Reform found that a redress scheme for survivors of sexual abuse in schools would be at a 'far greater scale' than any other scheme in the history of the State, and could have 'far-reaching implications.' Setting up such a redress scheme was a recommendation of a Scoping Inquiry into historic abuse in schools. The same inquiry also recommended setting up a Commission of Investigation. While the Government last week agreed to set up such a commission , it has not yet committed to a redress scheme. It is understood that more information about how many people would be likely to apply for such a scheme and how much it would ultimately cost is needed. The Government is also understood to be examining international examples of redress schemes where liable third parties were responsible for payments. This includes a scheme in Australia which succeeded in getting religious organisations to pay for redress by threatening to withdraw charitable status or state funding.

EU leaders prepare response to Trump's 30% tariff threat as trade war fears grow

European trade ministers will gather in Brussels on Monday to try to formulate a response to Donald Trump's imposition of a 30% tariff on the EU, which threatens to spark a trade war. Negotiations on tariffs were upended on Saturday when US president Donald Trump warned that if a deal is not struck by the August 1 deadline, the rate on goods coming from the EU would be 30%. Across Europe, there is some difference about how to respond to Mr Trump's weekend letter, with French president Emmanuel Macron urging the EU to 'defend European interests resolutely', be ready for a trade war, and to stand up to the US president. Leaders in Ireland, Italy, the Netherlands, and Germany called for calm. Irish leaders have appealed for calm with three weeks to go until the latest deadline. On Sunday, EU Commission president Ursula von der Leyen said she would seek a negotiated settlement. "We have always been very clear that we prefer a negotiated solution. This remains the case and we will use the time that we have now until August 1,' said Ms von der Leyen. Ms von der Leyen added that a suite of retaliatory EU measures due to kick in on Monday would be delayed pending the outcome of talks with the US. Those measures would hit US goods to the tune of €21bn. At the National Day of Commemoration in Dublin, Taoiseach Micheál Martin said Mr Trump's letter had been "worrying" and that a trade war would have damaging effects. "Clearly, 30% is not sustainable or tenable," he said. However, he said it is important that Europe not "overreact to every statement" and that Europe has countermeasures available should it choose to use them. He said that scenario would not be bad for consumers and businesses. It would damage everybody, and the world would suffer because of the enormous trading relationship between the EU and US. So, it would be a very significant deterioration. Speaking at the same event, Tánaiste and minister for trade Simon Harris said that the letter sent by Mr Trump was "unhelpful, because it's escalatory, but I think it also doesn't change anything in the here and now". He said the deadline was always August 1 and "remains the first of August and looks to me like a negotiating tactic by Donald Trump". "We prefer to do our negotiations around the table. He tends to do his negotiations on Truth Social and he can do it however he wishes, [but] from a European perspective and an Irish perspective, we're continuing to intensively engage. "I was in contact overnight with the EU trade commissioner Maroš Šefčovič speaking to him on a very regular basis," Mr Harris said. Mr Harris said that the Government had not yet released models on the impact of a 30% tariff but that the 10% scenario, which he said was now "baked in", saw a 25,000 fewer jobs created than the 100,000 added in a no-tariff scenario and the rate of economic growth slowing.
