ED flags ₹131 crore sand mining scam to Bihar govt, seeks fresh FIR

The Enforcement Directorate has written to the Bihar government flagging an alleged over ₹131 crore worth sand mining scam in Banka district of the state that has potential links to certain politicians and their associates, official sources said.
The federal probe agency's communication was sent a few weeks back and it came in the backdrop of a 2023 'Lok Adalat' (alternate dispute redressal platform) proceeding during which the alleged criminal offence was "compounded" and the accused were let off with a monetary penalty, the sources told PTI.
The case began with the Banka police filing as many as seven criminal FIRs between 2017 and 2018 against a company named Mahadev Enclave and its promoters to probe the alleged illegal sand mining in the district.
The police had pressed multiple IPC sections related to cheating, forgery and theft apart from sections of the Mines and Minerals Development and Regulation Act, Bihar Minerals (Concession, Prevention of Illegal Mining, Transportation and Storage) Rules and Environment Protection Act in its complaint.
The company was the sole licence holder in the said district to excavate sand from 28 river banks between 2015 and 2021, according to mining department officials.
The police investigated the case, recorded statements of various persons and filed chargesheets in all the seven cases before a local court naming the company and its director Manoj Kumar Pachisia as accused, they said.
However, the sources said, as there was a delay in the court proceedings, the case was taken before the 'Lok Adalat' for compounding and the accused were let off after they were slapped with a penalty amount in February 2023, the sources said.
The company or its promoters could not be contacted for a comment on these charges made against them.
The ED had filed a case under the Prevention of Money Laundering Act (PMLA) on the basis of these police chargesheets and had collected some "evidence" and recorded statements of various persons under the PMLA, including that of the Banka mining development officer.
However, the compounding of the original criminal case tied the hands of the ED as under the anti-money laundering law, the agency requires a predicate offence to prosecute the accused.
Sources privy to the development said the ED recently wrote to the Mines and Geology department of the Bihar government under section 66(2) of the PMLA that allows it to share information and evidence with a law enforcement agency regarding violation of a criminal law.
The agency, in the communication, is understood to have furnished a geospatial report prepared by the Indian Institute of Technology (IIT) Patna (undertaken on ED's request) to the Bihar government which found that 11.99 crore cubic metres of the sand was "illegally" excavated from the district by the accused company between 2016 and 2021.
Experts of the IIT used remote sensing and similar techniques to prepare the report in about two months time and it was also reported that alleged illegal sand mining was done beyond the lease areas, according to the sources.
The ED has said in its letter that as per mining department's rates, this alleged illegal excavation of sand led to the loss of about Rs 131,43,20,058 in revenue to the state government, the sources said.
The agency has sought filing of a fresh FIR by the state police under various sections of the IPC/BNS related to cheating, forgery, criminal conspiracy and relevant mining and environment laws so that the accused could be prosecuted under the relevant criminal laws.
Sources said a money trail analysis of the accused and others linked to them indicate potential involvement of certain politicians.

The Gujarat High Court has dismissed the petition of journalist Mahesh Langa seeking bail in the November 2024 case filed against him by the Enforcement Directorate (ED) under the Prevention of Money Laundering Act (PMLA), 2002, considering the arguments put forth by Gujarat Advocate General Kamal Trivedi that if enlarged on bail, Langa could 'cause prejudice' to the case of the prosecution. Justice MR Mengdey of the Gujarat High Court on Thursday dismissed Langa's petition stating that the court was 'not inclined to exercise its judicial discretion in favour of the applicant'. The oral order of the court stated, 'Having regard to the facts and material available on record, it would be difficult for this court to record a finding to the effect that the applicant is not guilty of the present offence. Moreover, as stated herein above, the applicant is having number of antecedents and therefore, it is also difficult for this Court to come to the conclusion that the applicant will not commit any offence while on bail. There are all chances that if the applicant is ordered to be enlarged on bail, he may cause prejudice to the case of the prosecution.' The case of the ED is based on two FIRs filed against Langa at the Detection of Crime Branch, Ahmedabad, on October 10, 2024, for alleged criminal breach of trust and cheating as well as a second FIR lodged on January 21, 2025, at Satellite Police station in Ahmedabad for alleged extortion. Senior Advocate SN Soparkar and Advocate Anand Yagnik, appearing for Langa, submitted to the court that he had been granted anticipatory bail in DCB Ahmedabad case by the City Civil and Sessions Court, Ahmedabad, on November 25, 2024, and also in the case at Satellite police station by the District and Sessions Court of Ahmedabad on February 11, 2025. 'Initially, the FIR at DCB police station was taken as base to register the impugned ECIR (Enforcement Case Information Report) and thereafter, FIR lodged with Satellite police station was merged into the ECIR,' Langa's advocate informed the HC. Langa's advocates further informed the court that he has been granted anticipatory or regular bail in all six cases against him, including the three offences under the GST Act. The court order noted AG Trivedi's submission that Langa, while being behind the bars, 'is tutoring the witnesses'. The AG cited the example of witness Naina Langa — Langa's sister-in-law — who retracted from her statement recorded by the ED on June 18, 2025. AG Trivedi told the court, 'The applicant has an audacity to file an affidavit under the signature of his advocate on July 7, 2025, producing the affidavit of Ms Naina Langa wherein she has retracted from her statement… The applicant appears to be on a driver's seat regulating everything, his father's account, his wife's account, his sister-in-law's account, his brother's account and has the audacity to say that it may be unaccounted money…' Arguing about the contentious Rs 20 lakh seized from Langa's residence and a subsequent transaction of Rs 30 lakh in connection with a property that was under consideration for purchase in the name of Langa's wife, Kavita, his advocates submitted that 'no predicate offence has been registered in those regards and therefore, these amounts cannot be said to be the proceeds of crime as defined under… PML Act and therefore, the applicant cannot be said to have committed an offence of money laundering as defined in the Act.' The advocates submitted that the amount, which can be alleged to be proceeds of crime, does not exceed Rs 1 crore and therefore, the rigours of the twin conditions of the Act would not come into play, making Langa eligible for bail under the PML Act. Langa's counsel also argued that the precedents relied upon by the state to object to the bail plea were cases related to offences involving crores of rupees or drug peddlers and other illegal activities — none of which is involved in Langa's case. AG Trivedi submitted before the court that the offence has crossed the threshold limit of Rs 1 crore and 'mere grant of anticipatory bail in the predicate offence does not entitle the applicant to be enlarged on bail as a matter of right.' AG Trivedi submitted to the court that the PMLA leaves 'free room for the investigating authority as a complaint can be filed with regard to anything, which is related to proceeds of crime and comes to be noticed during the course of investigation.' He further also submitted that there is 'huge discrepancy in the Cash balance and Annual Income of the present applicant and his wife and his father and Agricultural Income of the father of the applicant of the last six years'.

Kanpur: Additional sessions judge, Kanpur Nagar, Sudama Prasad on Thursday convicted accused Rupali Kapoor to 8 years rigorous imprisonment along with a fine of Rs 20,000 for burning her father-in-law. The prosecution had charged her under section 304 IPC (culpable homicide not amounting to murder) and section 326 (voluntarily causing grievous hurt). The court punished her with 8 years rigorous imprisonment along with a fine of Rs 10,000 in each charge. If she fails to pay the fine, the convict has to suffer another jail term of two months, the court observed. According to ADGC Pradeep Kumar Sahu, one Rishi Kapoor lodged a report at Bidhnu police station on October 20, 2021 stating therein that on October 19 last around 6 pm, his wife Rupali Kapoor had a fight with his father and she tried to oust him from home. When Rupali failed in her attempt she poured kerosene oil on father and burnt him with an intention to kill him. Rishi further stated that he got his father admitted to the UHM hospital with 80 percent burn injuries. Kapoor later succumbed to burn injuries. A magistrate had recorded his dying declaration before his death. On the basis of the dying declaration Rupali was held guilty and convicted accordingly, the ADGC said.

Ranchi: A division bench of the Supreme Court on Friday granted bail to Kolkata-based businessman Amit Agrawal in a land scam and money laundering case in Jharkhand, which was being investigated by the Enforcement Directorate (ED). During the bail hearing, Agarwal's advocates pleaded that the trial in the case is underway and it would take a long time to complete. They also informed that Agrawal has been in jail for over two years. ED had arrested Agrawal on June 7, 2023. His bail plea was rejected by the Jharkhand high court in April this year, after which he moved the SC. Suspended senior IAS officer Chhavi Ranjan, who allegedly facilitated the fraudulent transfer of land belonging to the Army to Agrawal, is also an accused in the case. Other accused included then sub-inspector of Bargai circle, Bhanu Pratap Prasad, Pradeep Bagchi, who impersonated himself as raiyyat, land brokers Afsar Ali, Imtiyaz Ahmad, Mohammad Saddam Hussain, Talha Khan, Faiyyaz Ahmad and Dilip Ghosh and three companies.
