Patna: The allegations against Mukesh Sahni, son of former minister Ramashray Sahni, took a dramatic turn on Monday as the 17-year-old minor at the centre of the case continued to alter her statements.
What began as a case of kidnapping and rape has now shifted to charges of molestation. The matter drew widespread attention when the girl went missing on Friday night and was located by police on Saturday evening. Her statement was recorded in a Samastipur court under Section 164 on Monday and her medical examination was conducted at sadar hospital, police said.
According to the FIR, the victim claimed she was forcibly taken by Mukesh and his driver, Raghubir, while stepping out of her home.
She alleged that they took her to several places and harassed her before leaving her at an isolated spot. An audio clip later surfaced in which she apologised to her parents, saying she was running away because Mukesh had allegedly filmed and sexually assaulted her. However, she later altered her statement to allegations of molestation.
Samastipur ASP Sanjay Pandey said it was essential to record the girl's statement under Section 164 before a magistrate. The police are still awaiting the court-issued copy. An FIR under the
POCSO Act
has been filed against Mukesh and Raghubir.
The driver has already been arrested and sent to jail, he said.
"The former minister has denied the allegations, claiming his son is being framed in a political conspiracy. According to him, his driver saw the girl in a suspicious situation with another boy named Anshu and recorded a video. He maintained his son's innocence and cooperated with the police investigation," the ASP said.

Judge Lal Babu Gupta heard testimony from five witnesses, including the girl's father, and rejected the defence's argument about the FIR being filed late. The court concluded that since the provision for the quantum of sentence under section 376(AB) IPC was more than what is entailed in section 5/6 of the Pocso Act at the time of the commission of the crime, the convict was sentenced under IPC for 20 years. The court did not find the case to qualify for the rarest of rare categories and refrained from awarding capital punishment. Special public prosecutor Satish Sharma said the complainant informed the court that he was not aware of the incident until his wife informed him about it on March 4, following which he lodged an FIR. After registering the case, police recorded the girl's statement under CrPC 164 on March 7, 2019, and pursued the culprit's arrest. The magistrate court took cognizance on May 2, 2019, and charges were framed by Jan 2020. Rejecting the charges, the defence counsel said that there was a substantial gap between the date of occurrence of the alleged crime and the filing of the FIR. The accused denied the charges, claiming the delayed FIR suggested mala fide intent and extortion by the complainant. The prosecution examined the girl, her parents, the FIR scribe, and the investigator. The court relied on the girl's statement before the magistrate and her court deposition as key evidence supporting prosecution's case. Having heard both sides, the court awarded 20 years of RI and a fine of Rs 25,000, directing the convict to pay the entire amount of the fine for the rehabilitation of the girl.

Ranchi: Special POCSO judge B K Srivastava on Monday sentenced four persons to life imprisonment for gang-raping a minor girl in Ranchi in April this year. The court sentenced Bipin Munda, Uttam Munda, Sanju Munda and Sonu Lohra to life imprisonment under section 6 of POCSO Act and imposed a fine of Rs 50,000 each on them. The four convicts were also sentenced to 10 years of rigorous imprisonment under section 366 of IPC and slapped a fine of Rs 25,000 each. One of the accused in the case has been declared juvenile and his trial is underway in juvenile justice court. According to the FIR, on April 12 the minor accused and Bipin had asked two minor girls to visit the local fair with them. While the girls were travelling with them on their two-wheelers, the accused took them to a mud house where Uttam, Sonu and Sanju were waiting. When the five persons tried to force themselves on the girls, the latter resisted following which the accused threatened to kill them. During the struggle, one of the girls managed to escape from the spot. The prosecution had produced eight witnesses to establish the argument. The court has sentenced the accused on June 26. During the argument on sentencing, the prosecution pleaded for death sentence to the convicts while the defence prayed for leniency. The court ordered life sentence as it did not consider the case as rarest of rare ones.

Agra: A special Pocso court in Agra on Monday sentenced a 27-year-old ice cream vendor to 20 years of rigorous imprisonment for sexually assaulting a 6-year-old boy in 2022. During the trial proceedings, the vendor denied the charges, but the court took cognisance of the child's testimony to nail him. On July 23, that year, the accused, known to the boy playing near his father's shop, lured him away with the promise of playing with him. He then took him to a secluded spot where he violated the child. Hearing the boy's cries, locals ran to the spot and the accused fled. An FIR was registered the next day under IPC sections 363 (kidnapping), 377 (crime linked to same sex) and the Pocso Act following a complaint by the boy's father. The ice cream vendor was subsequently arrested. A chargesheet was submitted on Aug 5, 2022, by the investigating officer before the court. Special prosecuting officer Madhav Sharma said the incident took place on the afternoon of July 23 when the accused, who used to operate his ice cream cart in a locality in Agra, took the boy with him. In his statement before the court, the accused denied all allegations against him, maintaining "he was not present at the time of crime". He claimed that a dispute between him and the boy's father over the placement of the ice-cream cart motivated the complainant to hatch a plan to implicate him in a false case. During sentencing, the defence also argued that the accused was a young man with no criminal antecedents and requested leniency, added Sharma. Additional district and sessions judge Shiv Kumar dismissed the plea and pronounced the accused guilty. A fine of Rs 30,000 was also imposed on the convict, and the court directed that half of the amount be given to the boy's family for rehabilitation.
