Centre approves SGNP land for GMLR, project deadline is 2028

Mumbai: The Ministry of Environment, Forest and Climate Change has granted final approval for the "diversion" (as BMC terms it in a press release) of 19.43 hectares of forest land in Sanjay Gandhi National Park (SGNP) to the BMC for the construction of the Goregaon-Mulund Link Road (GMLR) underground tunnel.

Work on the 4.7-km-long and 45.7-metre-wide twin tunnels, part of Phase 3 of the GMLR project, is expected to accelerate now. The tunnels will pass beneath SGNP in Borivli, connecting the eastern and western suburbs, easing traffic.
Civic officials confirmed that shaft excavation for launching the tunnel boring machine (TBM) is underway at Dadasaheb Phalke Chitranagari in Goregaon. "Some TBM components have already arrived at the port.
It will take about six months to assemble and launch the machine, which will operate at depths ranging from 20 to 150 metres," an official said.
The twin tunnels will be connected at intervals of 300 metres. They will feature modern features including advanced lighting, ventilation, fire safety systems, CCTV surveillance, and control rooms at both ends. Provisions for stormwater drainage and potential water pipelines have also been incorporated.
According to BMC estimates, the project is slated for completion by Nov 2028. Once operational, it will reduce the travel time between the city's eastern and western suburbs from 75 minutes to just 25 minutes. Compared to the existing Jogeshwari-Vikhroli Link Road (JVLR), the new link will shorten the travel distance by around km. Additional commissioner (projects) Abhijit Bangar highlighted the project's role in decongesting northern Mumbai.

Because the tunnel route passes beneath SGNP, prior approval from the central government was required. After an in-depth review, the green ministry granted in-principle clearance in Jan 2024. Final approval was issued on Tuesday, allowing the formal transfer of forest land. The BMC has since begun implementing the stipulated conditions and compliance measures.
Although the land has been transferred under Section 2 of the Forest (Conservation) Act, 1980, its legal status remains classified as forest land.
Importantly, the tunnel will begin and end outside the boundaries of SGNP, ensuring no direct impact on the park's surface or trees. All environmental safeguards recommended by the state govt will be enforced, said an official.
To offset the diversion of forest land, an afforestation plan is underway. BMC will plant trees on 19.5 hectares of non-forest land in Chandrapur district -- 14.95 hectares in Vasanvihira village and 4.55 hectares in Gondmohadi village.

These farmers, who operate from a relatively informal setup at present, will get the benefits of various govt schemes. Importantly, SPCDF is being formed in the year which not only marks the International Year of Cooperatives, the fourth year of the formation of the union cooperation ministry, Ministry of Cooperation, but also the 150th birth anniversary year of Sardar Patel, who sowed the seeds of Amul. Gujarat is also the headquarters of the 1965-established National Dairy Development Board. Sources said the governing structure of the new federation will comprise multiple stakeholders, including a GCMMF representative (20% equity), representatives of 10 milk unions of Gujarat (60% equity), and three board members representing farmers from outside Gujarat (20% equity). Currently, Gujarat is home to 18 milk unions, which are members of GCMMF. Of these, 10 milk unions, including Banas Dairy, Sabar Dairy, Amul Dairy, and Mehsana's Dudhsagar Dairy, procure close to 100 LLPD milk from states like Uttar Pradesh, Maharashtra, Rajasthan, Haryana, Andhra Pradesh, Tamil Nadu, and Bihar, among others. "SPCDF will be formed and governed under the Multi-State Cooperative Societies (MSCS) Act. The members of these societies formed under the Amul model will get all the benefits, including government schemes. NEW DELHI: A Delhi court on Saturday declared arms dealer Sanjay Bhandari a fugitive economic offender, observing that failed extradition attempts does not make him an "angel or immune from the prosecution for the violation of Indian laws". The order, which was reserved by the court of Special Judge Sanjeev Aggarwal on May 24, was pronounced on Saturday. "Extradition attempt may have failed, but it will not make accused angel or immune from the prosecution for the violation of Indian laws. FEO proceedings are another way of making one come back to India to face trial by coercing him to return by attachment, confiscation of properties of such fugitive economic offender and proceeds of crime, and by disentitling the such fugitive economic offender from putting forward or defending any civil claim," the judge said in his 100-page judgment. "...this court is satisfied that Sanjay Bhandari is a fugitive economic offender under section 12(1) of the Fugitive Economic Offenders Act, 2018, and is declared as such under the above provision(s)" of the Act, he said. ED and I-T department had in the extradition proceedings claimed that Bhandari had undisclosed foreign income worth Rs 655 crore on which he evaded tax worth Rs 196 crore. Robert is also being probed for his links with Bhandari, who fled to London when multiple agencies started investigating him in 2016. The judgment came on the ED's application filed under the Act in 2019. The court said the "fugitive" tag is to an individual who has committed schedule offence or offences involving an amount of Rs 100 crore or more and who has absconded or refused to return to avoid criminal prosecution. This will allow ED to confiscate his properties anywhere in the world and bar Bhandari, who is wanted by Indian agencies in multiple cases, from filing or defending any civil proceedings in India. The judge dismissed Bhandari's counsel's argument that the UK high court's order disallowing ED's plea for his extradition makes him eligible to stay in London, and therefore, FEO won't apply to him. "The said argument is without any substance as the extradition failure will not make any difference as the extradition of the accused was one of the means to bring the accused to India to face trial in the said offence under Section 51 of the Black Money Act," the judge said. The court stressed Bhandari wilfully refused to return to face criminal prosecution, and said, "...this court is satisfied that the total value of the schedule offence is Rs 100 crore or more i.e. the schedule to the present FEO Act which is Section 51 of Black Money Act." The court also rejected Bhandari's contention that declaring him a fugitive economic offender entails very serious consequences, effectively amounting to economic death penalty. "Bhandari always has an option to return... when he chooses not to return to India, he cannot take the plea of avoiding all the legal consequences... In any case those who play with fire should be aware of its consequences," the court said.

Accepting an application moved by the Enforcement Directorate, a Delhi Court on Saturday declared UK-based arms consultant Sanjay Bhandari a fugitive economic offender. With this, the Central agency can confiscate the assets of Bhandari worth crores of rupees. This order comes as a shot in the arm for the ED after a UK court had recently ruled against Bhandari's extradition to India. '…the ED has been able to make out a case under Sections 2(f) and 2(m) of the FEO (Fugitive Economic Offenders) Act…this Court is satisfied that the individual Sh. Sanjay Bhandari, against whom an warrant of arrest i.e. NBW (non bailable warrant) has been issued…has left India so as to avoid criminal prosecution…despite knowing the pendency of the NBWs against him,' said Judge Sanjeev Aggarwal in the order. After the Income Tax department raided him in 2016, Bhandari, now 63, fled to London. A year later, the ED filed a criminal case against him under the anti-black money law of 2015. The agency is also probing Bhandari's links with businessman Robert Vadra, the husband of Congress MP Priyanka Gandhi Vadra. 'Further, this court is satisfied that the total value of the schedule offence is `100 crore or more…,' the court said. The principal allegation against Bhandari was that he owned certain assets worth Rs 100 crores abroad which he did not disclose to the I-T authorities. The ED had argued that Bhandari consistently chose not to return to India. The ED also submitted that the UK court's decision to disallow Bhandari's extradition would not be binding on the proceedings in the Delhi court. Bhandari's legal team, while opposing the ED's move to get him declared a fugitive offender, claimed that its 'client's stay could not be called illegal in the UK as he has a legal right to reside in the UK and the GOI is bound by the judgment of the UK court…. Bhandari is legally living there, and declaring him a 'fugitive' in that scenario is legally wrong'. The court said the 'extradition attempt may have failed, but it will not make the accused an angel or immune to prosecution for the violation of Indian laws'. Bhandari had alleged that he was subjected to undue harassment and pressure from various enforcement agencies to 'compel him to give false statements against the political opponents of the government' and that it was because of this harassment that he was forced to leave India. 'In any case, those who play with fire should be known to be aware of its consequences,' it said. The court held that the undisclosed foreign income or assets of Bhandari were worth Rs 655 crore and the total tax evaded by him, including penalty and interest, was Rs 196 crore. The ED filed its first chargesheet against him in 2020. The ED filed a supplementary chargesheet in the case in 2023, alleging that Bhandari 'acquired' the 12, Bryanston Square house located in London in 2009 and got it renovated 'as per the directions of Robert Vadra and the funds for renovation were provided by Robert Vadra'. Vadra has denied owning any London property directly or indirectly. He has termed these charges a political witch-hunt against him and claimed that he is being 'hounded and harassed' to subserve political ends. With this order, a total of 16 people, including liquor baron Vijay Mallya and diamond trader Nirav Modi, have been declared fugitive economic offenders by different courts. Bhandari's assets worth about Rs 21 crore have been attached by the ED under the PMLA.
