Return to sender: Court throws out bank's RM3.5mil claim on loan guarantors over wrong addresses
KOTA KINABALU: A bank's bid to recover RM3.5mil from two guarantors of a loan facility was dismissed by the High Court of Labuan after it was found that the notices of demand were not served to the correct addresses. Justice Alexander Siew, sitting in Kota Kinabalu on Friday (July 11), dismissed the claim by the bank against two personal guarantors of a bai bithaman ajil (BBA) Islamic facility worth RM2.8mil granted to a company to finance the purchase of land in Kampung Ganggarak, Labuan. The bank sued both the company and its guarantors on Nov 9, 2018, seeking full repayment, interest and costs after claiming the company allegedly defaulted in repayment. Justice Siew, in his judgment, found that the bank's notices of demand had been addressed to the wrong addresses and, as such, the bank failed to make a demand on the defendants for repayment. "As the guarantees were on-demand in nature, the failure to serve valid demand notices was fatal to the bank's case," he said in dismissing the claim against the guarantors, awarding RM10,000 in costs to each. The guarantors' counsel Datuk Seri K. Rakhbir Singh had submitted to the court that the bank's notices of demand were fundamentally defective. 'The plaintiff (bank) keeps repeating that it had issued the notices. However, this is not the point of contention. The point of contention is that the notices were all sent to the wrong addresses," he argued. The court, however, allowed the bank's claim against the company with costs on separate grounds, in line with the position that the writ itself could constitute sufficient demand against a principal borrower. Rakbhir later said the ruling reaffirms that strict compliance with procedural requirements is not a mere technicality, but a fundamental element in the enforcement of guarantees. "The case stands as a timely reminder to lenders that shortcuts in service and notice can prove costly, even in claims worth millions," he added.

YIM targets more Sabah grassroots social innovations

YIM Chief Executive Officer Dr Sharmila Mohamed Salleh said the innovation foundation, established under the Ministry of Science, Technology and Innovation (Mosti), serves as a platform to discover, develop and match grassroots innovations with development funding. 'Our mandate is to find innovations with social, economic and environmental impact, and then support their growth through targeted funding,' she said. She said YIM differs from other organisations in its focus on applying technology to social innovation models that deliver tangible benefits to communities. 'Any business or model that incorporates innovation and contributes meaningfully to society falls within our scope,' she added. YIM recently partnered with the Ministry of Economy to pilot a project aimed at helping grassroots innovators commercialise their products and build more sustainable ventures. Eleven innovators were selected nationwide, including four from Sabah, each receiving RM80,000 for project implementation over 12 months. 'The pilot began in June last year and concluded last month. The outcomes so far are promising. YIM provided support ranging from equipment and training to sustainable product development,' she said. The foundation will conduct a six-month impact review covering business growth, profitability and contributions to local economies. Among the Sabah-based innovators supported is Anne Antah, founder of Chanteek Borneo, which produces ethnic-inspired accessories and apparel suitable for both formal and everyday wear. Other recipients include Joardy Mardeko, who created the Coconut Patty Burger made from high-fibre coconut pulp, as well as Sariyaman Sabur, developer of cassava-based nuggets rich in complex carbohydrates and fibre as a healthy alternative. YIM also helped revive an aquafarm in Kundasang that was affected by the 2015 earthquake, redeveloping it using modern aquaculture and hydroponic systems. 'We're also collaborating with universities to develop innovations that don't yet exist in Malaysia, from the research phase through to commercialisation with real social impact,' Sharmila said. IIUM gets new president
INTERNATIONAL Islamic University Malaysia (IIUM) has appointed Tan Sri Abdul Rashid Hussain (pic) as its 10th president. He takes over from Tan Sri Samsudin Osman, whose term ended on June 30. Abdul Rashid's appointment for a three-year term started on July 1. The term, which will end on June 30, 2028, was made with the consent of IIUM constitutional head Tengku Ampuan Pahang Tunku Azizah Aminah Maimunah Iskandariah Almarhum Sultan Iskandar. Abdul Rashid was appointed in recognition of his distinguished leadership and reputation in the Malaysian corporate sector, particularly in Islamic finance. The founder of Rashid Hussain Berhad (RHB) banking group has been serving as Tabung Haji's chairman of the board of directors since 2023. He also served as a member of the IIUM board of governors since 2018, and was appointed as Universiti Teknikal Malaysia Melaka (UTeM) pro-chancellor in 2024. The Higher Education Ministry, in a statement dated July 1, expressed confidence that Abdul Rashid's appointment would further strengthen IIUM's role as a centre of excellence rooted in Islamic values, while enhancing its visibility and competitiveness both nationally and internationally.
