KOTA KINABALU: A bank's bid to recover RM3.5mil from two guarantors of a loan facility was dismissed by the High Court of Labuan after it was found that the notices of demand were not served to the correct addresses.
Justice Alexander Siew, sitting in Kota Kinabalu on Friday (July 11), dismissed the claim by the bank against two personal guarantors of a bai bithaman ajil (BBA) Islamic facility worth RM2.8mil granted to a company to finance the purchase of land in Kampung Ganggarak, Labuan.
The bank sued both the company and its guarantors on Nov 9, 2018, seeking full repayment, interest and costs after claiming the company allegedly defaulted in repayment.
Justice Siew, in his judgment, found that the bank's notices of demand had been addressed to the wrong addresses and, as such, the bank failed to make a demand on the defendants for repayment.
"As the guarantees were on-demand in nature, the failure to serve valid demand notices was fatal to the bank's case," he said in dismissing the claim against the guarantors, awarding RM10,000 in costs to each.
The guarantors' counsel Datuk Seri K. Rakhbir Singh had submitted to the court that the bank's notices of demand were fundamentally defective.
'The plaintiff (bank) keeps repeating that it had issued the notices. However, this is not the point of contention. The point of contention is that the notices were all sent to the wrong addresses," he argued.
The court, however, allowed the bank's claim against the company with costs on separate grounds, in line with the position that the writ itself could constitute sufficient demand against a principal borrower.
Rakbhir later said the ruling reaffirms that strict compliance with procedural requirements is not a mere technicality, but a fundamental element in the enforcement of guarantees.
"The case stands as a timely reminder to lenders that shortcuts in service and notice can prove costly, even in claims worth millions," he added.

JOHOR BARU: The state is seeking to position itself as a regional halal hub through its Johor Halal Development Plan (PKHNJ) by forging strategic partnerships with national agencies. Its Islamic religious affairs committee chairman, Mohd Fared Mohd Khalid, said the state government is committed to setting the benchmark in halal certification, starting with state and federal government facilities. 'We have gained strong support from state health and environment committee chairman Ling Tian Soon and state women, family and community development committee chairman Khairin Nisa Ismail to collaborate on halal-related efforts. 'With this cooperation, we aim to ensure that all kitchens in government hospitals and welfare institutions under state supervision are halal-certified,' he added. Mohd Fared added that cafeteria operators and food providers in these agencies would be encouraged to apply for halal certification. He said the state wants government departments and agencies to lead by example in halal compliance, particularly in food and beverage preparation, before encouraging entrepreneurs and traders to follow suit. Mohd Fared said that as part of this broader strategy, the state government is also working closely with Majlis Amanah Rakyat (Mara) to streamline the halal ecosystem, from education to entrepreneurship and business management. He said he met Mara chairman Datuk Dr Asyraf Wajdi Dusuki recently and agreed to form a collaboration. 'Mara has confirmed that Johor is the first state to officially express its intention to collaborate on halal development. 'They have also agreed to look into supporting its entrepreneurs in the state, especially in encouraging them to pursue halal certification,' he added. Mohd Fared also said a joint workshop would be organised soon to develop a streamlined framework that simplifies the halal application process, ensuring it is efficient and not burdensome to business owners. 'We also see potential for collaboration with Mara-owned educational institutions, including a proposal to establish dialysis centres to support the welfare of asnaf (eligible zakat recipients), with the Johor Islamic Religious Council ready to assist,' he said. On another matter, Mohd Fared said Johor has received full backing from the Rubber Industry Smallholders Development Authority (Risda) to push the PKHNJ forward. He highlighted Risda's expertise in halal Technical and Vocational Education and Training (TVET) as a key area of collaboration. 'The halal industry offers vast job opportunities for the Johor people, with graduates from halal-related institutions benefiting from better career pathways through the implementation of PKHNJ,' he said.

IIUM gets new president

INTERNATIONAL Islamic University Malaysia (IIUM) has appointed Tan Sri Abdul Rashid Hussain (pic) as its 10th president. He takes over from Tan Sri Samsudin Osman, whose term ended on June 30. Abdul Rashid's appointment for a three-year term started on July 1. The term, which will end on June 30, 2028, was made with the consent of IIUM constitutional head Tengku Ampuan Pahang Tunku Azizah Aminah Maimunah Iskandariah Almarhum Sultan Iskandar. Abdul Rashid was appointed in recognition of his distinguished leadership and reputation in the Malaysian corporate sector, particularly in Islamic finance. The founder of Rashid Hussain Berhad (RHB) banking group has been serving as Tabung Haji's chairman of the board of directors since 2023. He also served as a member of the IIUM board of governors since 2018, and was appointed as Universiti Teknikal Malaysia Melaka (UTeM) pro-chancellor in 2024. The Higher Education Ministry, in a statement dated July 1, expressed confidence that Abdul Rashid's appointment would further strengthen IIUM's role as a centre of excellence rooted in Islamic values, while enhancing its visibility and competitiveness both nationally and internationally.
