Maha legislative panel receives record 12k objections to Public Security Bill

MUMBAI: The controversial Special Public Security Bill, 2024, has received an unprecedented 12,750 suggestions and objections, the highest ever in the history of the state legislature. They were sought by a 25-member joint select committee (JSC) comprising members of both houses of the legislature. The panel will deliberate upon the objections and suggestions at a meeting on May 21.
The JSC is expected to invite representatives of more than 100 organisations that have flagged the bill as 'anti-democracy' and unconstitutional. More than 90% of the responses oppose the proposed legislation.
The bill, tabled in July, after the Lok Sabha elections last year, was later sent to the JSC, which has held two meetings so far. The number of suggestions and objections is the highest-ever for a draft bill in Maharashtra, topping the 700-odd suggestions and objections received by the Shakti Criminal Laws (Maharashtra Amendment Bill) tabled in 2020 for effective action in crimes against women.
The Special Public Security Bill, 2024, gives the state sweeping powers to act against 'urban naxals'. Justifying the bill, chief minister Devendra Fadnavis has claimed that Naxalism is no longer confined to remote areas and has reached the cities through frontal organisations.
The draft legislation has, however, been slammed by civil society, which has pointed to the potential for such a law to be misused by being invoked against individuals voicing dissent against the state. Many have called it a violation of human rights.
'We have bifurcated the suggestions and objections into different categories based on the nature of the objections. Over 90% of them object to the law and the objections have been raised, section-wise, with elaborative (sic) reasoning. We have put them under categories as per the nature of the objections raised,' said an official from the state legislature.
According to home department officials, the Mahayuti government hopes to get the bill passed during the monsoon session of the state legislature, starting on June 30. 'Most of the objections are similar to each other. The opposition is because of the misleading information spread about the bill. The JSC will try to weed out these misconceptions during the deliberations,' said the officer.
Ulka Mahajan, state convenor of the Bharat Jodo Andolan, said their opposition to the bill continues. 'After a huge response to our protests at 78 locations in 36 districts, there will be a huge march to the Vidhan Bhavan on June 30, the first day of the monsoon session. Organisations are of the opinion that it is not a Public Security Act but a bill drafted by the government to promote suppression and autocratic rule. The bill gives the government exhaustive powers to act against any organisation, for anything, and in fact it is aimed at suppressing dissident voices,' she said.

Mumbai: Maharashtra Chief Minister Devendra Fadnavis on Thursday said if a person belonging a religion other than Hinduism, Buddhism and Sikhism has obtained a Scheduled Caste certificate fraudulently, it will be cancelled. Action will be taken against such a person if he or she has secured reservation benefits such as government jobs. If such a person has won an election using a fraudulently obtained SC certificate, their election will be declared null and void, Mr Fadnavis said in the legislative council. Replying to a 'calling attention' motion, he also said the state government intends to bring in strong provisions to deal with cases of religious conversion through coercion and cheating. Amit Gorkhe (BJP) had claimed that freedom of religion was being misused by "crypto Christians", and some people benefit from reservations under the SC category while professing other religions. `Crypto Christians' was an apparent reference to people who discreetly follow Christianity while belonging to a different religion on paper. On the face of it, they belong to an SC community and get reservation benefits like government jobs, he had said. Mr Fadnavis said on November 26, 2024, the Supreme Court gave a verdict in which it made it clear that the Scheduled Castes category reservation can be availed only by Hindus, Buddhists and Sikhs, and not by those belonging to other religions. "If anyone from religions other than Hinduism, Buddhism and Sikhism has availed an SC certificate or reservation, their validity certificates and caste certificates will be cancelled with due procedure. If anyone has availed benefits like government jobs, action will be taken against them," he said. "Recovery (of monetary benefits) will be recommended from those who have availed benefits using fraudulently obtained caste certificates," he said. BJP leader Chitra Wagh said there have been cases where women were duped into marriage by hiding the husband's religion. She cited a case in Sangli where a woman married into a family which secretly professed Christianity. The woman suffered torture and was forced to change her religion, leading to her death while she was seven months pregnant, Wagh said. A person can follow any religion and convert another person with consent, but law does not permit the use of force, cheating or enticement for conversion, the chief minister said. "Complaints of coercion or inducement for conversion will lead to investigation and action against the concerned organisation," Mr Fadnavis added. The state government had formed a panel headed by the Director General of Police (DGP) for giving recommendations to deal with such cases, and it has submitted its report, he said. The government will study it and bring in new (legal) provisions so that conversions do not happen by force or cheating, he said. "Action can be taken under the Bharatiya Nyaya Sanhita (BNS) in such cases. But a panel was formed to suggest strict provisions. The state government has the intentions of bringing in strong provisions to deal with such cases, and we will take a decision on this soon," he said. On Monday, Pankaj Bhoyar, Minister of State for Home, had said the state will bring an anti-conversion law in the winter session of the legislature, and it will be more stringent than similar legislations in other states. Pravin Darekar (BJP) claimed a secret campaign to lure people into converting was being carried out in poor localities and slums. CM Fadnavis acknowledged that such things take place in slums. He, however, said the government has no intention to ban religious conversions that take place consensually.

Nagpur: Maharashtra is poised to become the most competitive state in terms of industrial power tariffs, with rates expected to drop to ₹7.38 per unit under the revised power policy, chief minister Devendra Fadnavis told the Legislative Council on Tuesday. "After the new tariff is implemented, Maharashtra will have the lowest industrial electricity cost in the country," the CM said, comparing the rates with Tamil Nadu (₹9.04), Gujarat (₹8.98), and Karnataka (₹7.75). He assured tariffs will remain stable in coming years and will not escalate due to the tariff true-up process. Responding to a query from Nagpur-based MLC Abhijit Wanjarri, and subsequent questions from Shashikant Shinde, Satej Patil, and Leader of Opposition Ambadas Danve, Fadnavis said the state has shifted to a Merit Order Dispatch system for power procurement. "This allows us to buy electricity from private players at lower rates. With long-term (25-year) contracts for solar, wind, and battery storage, we significantly reduced power purchase costs," he said. Fadnavis acknowledged that earlier tariff petitions placed a heavier burden on residential consumers to subsidise lower industrial and commercial rates. "That has now changed. The revised structure cuts tariffs across consumer categories," he noted. Around 70% residential users who consume under 100 units will see a 26% reduction in bills. Those exceeding 100 units will also benefit from price cuts. In the agriculture sector, the CM announced key changes to the solar pump distribution scheme, including a new booster pump initiative. "Farmers can now get a single-pole connection for ₹15,000, and 10 HP solar pumps will be made available as per demand," he said. "This will help measure consumption precisely and support future planning in agriculture power policy," he added.
