Delhi HC upholds Medha Patkars conviction in defamation case by LG Saxena

New Delhi, Jul 29 (PTI) The Delhi High Court on Tuesday upheld the conviction and punishment awarded to activist Medha Patkar in a defamation case filed by Delhi LG V K Saxena in 2000.
Justice Shalinder Kaur said the trial court order, against which Patkar had approached the high court, did not require any interference.
'Upon perusal this court finds no illegality in the order (by trial court) and requires no interference, and (appeal) accordingly dismissed," Justice Kaur said.
Saxena filed the case 23 years ago when he was heading an NGO in Gujarat.
The high court said there was illegality or material irregularity in the findings of the trial court and added that the order of conviction was passed after due consideration of evidence and the applicable law.
It said that Patkar failed to demonstrate any defects in the procedure which was followed or any error in the law which resulted in the miscarriage of justice.
The judge also upheld the order on sentence, where Patkar was released on 'probation of good conduct", and said it did not require any interference.
Probation is a method of non-institutional treatment of offenders and a conditional suspension of sentence in which the offender, after conviction, is released on bond of good behaviour instead of being sent to prison.
The high court, however, modified the condition of probation imposed by the trial court, requiring Patkar to appear before the trial court once in every three months, and allowed her to either appear physically or through VC or be represented through the lawyer during the appearances.
The court also dismissed Patkar's plea against dismissal of her application to introduce and examine an additional witness to prove her defamation case lodged against Saxena.
While 70-year-old Patkar was represented by senior advocate Sanjay Parikh, advocate Gajinder Kumar argued on behalf of Saxena.
The Narmada Bachao Andolan leader challenged the April 2 sessions court order upholding her conviction handed out by a magisterial court in the case.
The sessions court, which upheld Patkar's conviction in the case, released her on 'probation of good conduct"on furnishing a probation bond of Rs 25,000 on April 8 and imposed a precondition on her of depositing Rs 1 lakh as fine.
The magisterial court on July 1, 2024 sentenced Patkar to five months of simple imprisonment and slapped a Rs 10 lakh fine after finding her guilty under Section 500 (defamation) of the IPC.
Saxena filed the case as president of the National Council of Civil Liberties against Patkar for her defamatory press release against Saxena issued on November 24, 2000.
On May 24, 2024, the magisterial court held that that Patkar's statements were not only per se defamatory but also 'crafted to incite negative perceptions" about him.
The accusation that the complainant was 'mortgaging" the people of Gujarat and their resources to foreign interests was a direct attack on his integrity and public service, it had said.
On April 2, the sessions court had dismissed a challenge to the order and held Patkar was 'rightly convicted" and there was 'no substance" in the appeal against the verdict of her conviction in the defamation case. PTI UK ZMN

Rapper Vedan moves Kerala HC seeking anticipatory bail in rape case

KOCHI: Malayalam rapper Hirandas Murali, popularly known as Vedan, approached the Kerala High Court on Friday seeking anticipatory bail in the rape case registered against him based on a complaint filed by a young doctor. In his petition, Vedan claimed that the relationship with the complainant was consensual and voluntary. Vedan submitted that the complaint was a result of personal issues between him and the complainant. He argued that even if the allegations are taken at face value, they do not constitute the legal ingredients of the offence of rape under Sections 376 and 376(2)(n) of the Indian Penal Code (IPC). According to the petition, a broken promise of marriage in a consensual relationship does not amount to rape unless it can be proved that the promise was false from the beginning. The rapper further alleged that a group of individuals, led by a woman, are conspiring against him with the intention of extorting money and damaging his reputation.

Vijayawada: A special Anti-Corruption Bureau (ACB) court here on Friday extended the judicial remand of 12 liquor scam case accused, including YSRCP MP P V Midhun Reddy, till August 13. The Special Investigation Team (SIT) officials produced the accused before the court upon completion of their previous remand period. Nine accused were brought from the district jail in Vijayawada, while two were brought from Guntur jail. Midhun Reddy was brought to the court from Rajahmundry jail. Midhun Reddy, the Lok Sabha member from Rajampet, was arrested in the case on July 19. The court had sent him to judicial custody till August 1. The custody of 11 accused was also extended till August 1 during the previous hearing on July 22. The accused include Kasireddy Rajasekhar Reddy, former IT adviser to former chief minister Y S Jagan Mohan Reddy; K Dhanunjaya Reddy, secretary in the Chief Minister's Office; Krishna Mohan Reddy, officer on special duty (OSD) to then chief minister; Bharati Cements director Balaji Govindappa, former MLA Chevireddy Bhaskar Reddy, Rajashekar Reddy's personal assistant Dilip Kumar, B Chanikya, Venkatesh Naidu, and Sajjala Sridhar Reddy. After the court extended their custody, they were sent back to jail. The scam had occurred during the YSRCP rule between 2019 and 2024. Investigators reportedly uncovered a kickback network involving nearly Rs 3,500 crore siphoned off over five years.

Visakhapatnam: YSRCP MLC Botcha Satyanarayana pointed out that anarchy prevails in the state with the coalition's inefficient governance. Speaking to the media in Visakhapatnam on Friday, he said that the state suffers from lack of law and order and the ruling party resorts to making derogatory remarks against women. 'The crime rate has gone up in the state after the coalition government came to power. Rapes and assaults against women and minors have increased in an alarming manner. Also, ganja peddlers are getting the support of the government,' the MLC criticised. During YS Jagan Mohan Reddy's Nellore, Botcha Satyanarayana recalled, police imposed unwarranted restrictions and dug up roads to prevent people from gathering. 'It clearly indicates that the government is scared of YS Jagan Mohan Reddy and there is growing intolerance among people,' he stated. The language being used by TDP leaders against women leaders including RK Roja and ZP chairperson U Haritha shows their audacity and respect for women, the MLC mentioned. Vizag has been gravely exploited by Chief Minister N Chandrababu Naidu and his coterie by allotting prime lands at low prices. 'Lands worth Rs 1,500 crore are being given on long lease to Lulu Group. Former Chief Minister YS Rajasekhara Reddy promoted IT in Vizag while the coalition is merely exploiting the resources,' he said. Students did not get fee reimbursement, farmers are not getting MSP and there is no crop insurance or input subsidy, while women are cheated by false promises, the MLC added.
