
Government proposal on triple Lock gives an Irish solution to an Irish problem
It's time to unlock the triple lock.
The rejection by the Irish people of the Nice referendum on the June 7, 2001, was a uniquely Irish generated crisis.
The treaty was aimed at preparing the then 15-member state union for its biggest enlargement to 27 member states by 2007.
Crucially, it had to be ratified by all member states but only Ireland was obliged to conduct a referendum.
In effect, the failed referendum had blocked — or at least threatened to seriously derail — one of the most ambitious projects of the European Union.
The news was most keenly felt by the 8,000 Irish citizens living and working in Brussels, particularly the approximately 100 Irish diplomats and civil servants attached to the Irish Permanent Representation to the EU.
After almost 30 years of hard work, Ireland's reputation as a model EU member state had evaporated overnight.
From model state to pariah state, Ireland was seen to have benefitted greatly from EU handouts and then stabbed the union in the back.
The international media feasted with a frenzy on the carcass of Ireland's EU reputation. Those of us Irish working in the Brussels bubble were detached from the reality of politics at home.
It was realised in Dublin that if we continued to block the expansion, the EU would do us no favours
There was still time to run another referendum, but new parameters had to be included to mollify the ideologues of neutrality.
Taking inspiration from former health minister Charles Haughey's solution to the problem of legalising contraceptives in 1979, the Nice Treaty required 'an Irish solution to an Irish problem'.
In the end, however, instead of a doctor's prescription, all we needed was UN approval.
The triple lock was born. It was rushed from the Rotunda to Leinster House, quickly baptised, and greeted by the people.
Within a year, the bonny baby triple lock, a child genius at age one, secured the second Nice referendum.
The day was saved. Ireland was saved. Former states that had emerged from communism were able to join the EU.
Peacekeeping missions
For the first few years, the child grew and was doted on by everyone. Its tantrums were gently tolerated, even when it insisted that any one of the five permanent members of the UN Security Council — China, France, Russia, US, and Britain — can effectively withhold UN approval on Irish participation in overseas peacekeeping missions.
One of the unintended possible consequences of retaining the triple lock limits the State's capability to rescue Irish citizens in trouble abroad.
The obvious example is in crisis-prone countries, such as countries in Africa, where thousands of Irish missionaries and NGO staff are working.
The competition among UN permanent members is such that, in almost every conflict in Africa, they are pitted against each other to the extent that security council approval is very difficult or impossible.
In the event of the EU mounting an armed rescue mission, where UN approval could not be achieved, the triple lock would block Irish troops' participation in missions aimed at saving the lives of our own people.
The triple lock undermines Irish sovereignty and should have been constitutionally challenged years ago.
Why should we be subservient to any foreign power when it is not even reciprocated?
It was a self-imposed straitjacket.
Another restriction was that the maximum number of armed Irish troops that could be sent abroad without Dáil approval was set at 12. Why 12?
Was somebody over influenced by that Second World War action film The Dirty Dozen?
The one where tough guy, cigar-chomping Telly Savalas toured military prisons to recruit 12 military psychopaths for a special operation.
Recently, in the Letters to the Editor column of the Irish Examiner,fellow veteran Tim O'Connell explained why 50 was the right number for small unit operations abroad.
Based on the infantry platoon of 34, the remaining 16 would be specialist support elements selected for the specific mission.
Even Luxembourg has sent more troops abroad than that without external approval. Irish neutrality was never dependent on the triple lock.
The neutrality policy preceded the triple lock by 60 years. In reality, the triple lock undermines Irish neutrality by empowering five foreign powers to veto the sovereign will of our Government and the Dáil.
At last, Houdini himself has come back from the dead to unravel the straitjacket.
The Government's proposed legislation has realistically broadened its application to most of the situations we can foresee at this stage.
In practice, the changes effectively decouple future governments neatly from the permanent members' veto.
Times have changed.
The blissfully unaware Irish public should no longer be kept in the dark on security and defence matters.
A properly informed public in 2001, would most probably have passed the first Nice referendum and avoided the need for the triple lock in the first place.

Cork TDs clash over emigration figures as housing crisis forces more young people abroad
A war of words has erupted between two Cork TDs over the number of people emigrating as the housing crisis continues to take its toll. Colm Burke took exception to a speech made by Sinn Féin TD Thomas Gould at a housing rally in Cork where he told the crowd that "Fianna Fáil and Fine Gael have driven over 150,000 young people" out of the country. The Fine Gael TD responded with CSO figures which show that since 2020, 143,900 Irish citizens have left the country compared to 147,600 citizens who have returned. Looking solely at the number of people leaving the country and not acknowledging those who are returning does not give an accurate portrayal of the situation, Mr Burke said. There is also a need to look beyond the figures at the people included in them such as non-Irish citizens who arrived to study or work in Ireland on a temporary basis and are now returning home, he noted. In any country, you will have young people who move abroad to experience other cultures and those - for example, doctors and nurses - who get work experience abroad for a period of time before coming home, Mr Burke added. However, Mr Gould has said he stands over the figure he quoted at the rally saying he believes it was actually a conservative estimate. He cites data from the Australian Bureau of Statistics which showed over 103,000 Irish-born people were living there in June 2024. That figure does not take into account the number of Irish people who have moved to other countries around the world nor those who have moved to Australia over the past year. Mr Gould said he has young people in his constituency that are coming to him every week telling him that they are leaving the country because they cannot afford a home. One young working couple, for example, came to his office as they had received a notice to quit and are earning too much to go on the social housing list. Thomas Gould cites data from the Australian Bureau of Statistics which showed over 103,000 Irish-born people were living there in June 2024. "They have applied for affordable housing but there are so many people applying so they are going into a lottery and if they don't come out of the lottery, they are going to be homeless," Mr Gould said. Mr Burke said there is no question there are challenges in relation to housing that need to be resolved. "I have a very strong view that we should bring in tax incentives again to get money back into investment in housing," he said, although he would not like to see a re-introduction of incentives seen around 2008.

Irish troop missions 'held hostage' by UN veto, says former army colonel
The requirement that any Irish international peacekeeping deployment must have the authorisation of the UN Security Council means Ireland can be 'effectively held hostage' by any of its five members, a senior retired army officer has said. Former Colonel Colm Doyle – who has also served at UN HQ – told the Oireachtas Defence Committee that claims that the removal of the UN authorisation obligation would threaten Ireland's military neutrality were 'greatly misjudged'. The committee is continuing hearings on the Defence Bill 2025 which proposes to scrap the requirement for UN approval to send Defence Forces abroad. The 'Triple Lock' refers to three hurdles – Government, Dáil, and UN – that must be cleared before troops, beyond 12 personnel, can be deployed overseas. The bill authorises Irish troops to take part in an 'International Force' for the purposes of peacekeeping, conflict prevention, and international security 'consistent with the principles of the United Nations Charter'. It also plans to increase the number of personnel that can be sent overseas – from 12 to 50 – without the Government needing Dáil approval. Col Doyle told the committee: 'On the subject of the triple lock and its retention or amendment which has become politically emotive, I find myself very surprised. That this is in some way being described as a threat to our military neutrality is, in my view greatly misjudged and I do not support those opposing the measure. He said the UN veto system reflects the 'realities' of global power dynamics, but said it also leads to 'deadlock' where the permanent five members' interests conflict. 'This illustrates one of the main flaws of the UN Security Council - that Ireland's involvement in international peacekeeping can effectively be held hostage by any one of the permanent five members' use of, or threat of the use of a veto,' he said. "Surely we have the confidence, maturity, and political experience to make our own decisions for Ireland's overseas policy to evolve in response.' Former Army Ranger Cathal Berry said the original purpose of the Triple Lock was 'to give Dublin a veto' over any Security Council order for overseas deployment, not to give "New York a veto over Dublin". He said 'no other country, whether neutral or otherwise' require UN authorisation. But he said many parliaments have regard to it. He suggested the Oireachtas Defence Committee and the Attorney General could have a role in examining any proposed deployment. Major General Kieran Brennan, retired, said the committee members faced a dilemma: 'Do we stand on principle and say no to overseas deployments unless there is an UN Security Resolution because of its supposed impacts on our neutral status or should the saving and enhancements of people's lives trump all else? 'With a dysfunctional UN Security Council are we destined to remain on the sidelines expecting others to intervene on our behalf? Accordingly, I support the proposals.' Tánaiste says student fees will be reduced in 2025 despite coalition tension
The Tánaiste has insisted the Government is united on the issue of student fees, which he has indicated will be reduced early next year. Simon Harris moved to stress that the coalition remains committed to lowering the cost of third-level education, but said any reductions would be implemented next year, when a second instalment is due. It comes after Higher Education Minister James Lawless said student fees — which were reduced by €1,000 over the past three years — will return to €3,000, as Budget 2026 will not include the cost-of-living measures that previously enabled the cut. Asked about differences between Fianna Fáil and Fine Gael on third-level fees, Mr Harris emphasised that a programme for government had been signed off by both parties. "This idea that a bill is going to fall due of €3,000 in September isn't actually what happens. Most people don't have three grand under the mattress, or six grand if the two kids come to college — people pay in instalments, often two or three instalments, one before Christmas, maybe one in the new year, one after. So actually, the time any reduction comes in at isn't the most pertinent point." He added: "As everybody knows, these announcements are made on budget day, but what I would say to people is, the programme for government is clear, and the direction of travel government wants to go in terms of reducing the cost of college, and we're also clear in terms of how the actual process of paying fees works. "So it's not a question of fees going up in September, it's a question of the Government's decisions that we make in a budget will then obviously be reflected from the new calendar year and that's normal budgeting." Instead of introducing a temporary cost-of-living package, Mr Harris said the Government's focus must now shift to "proper, structural, permanent changes". He highlighted supports aimed at reducing costs for small businesses, childcare, schools, and third-level education. "We're not going to have a specific kind of package of measures between now and the Christmas period; we're going to get back into regular budgeting. We both in Fianna Fáil and Fine Gael said that very honestly in the general election campaign, and the programme for government says that as well," said Mr Harris.
