Supreme Court flags misunderstanding around mediation in matrimonial cases

The Supreme Court on Thursday said there was a "misunderstanding" about the concept of mediation in matrimonial case and it was often thought mediation means parties have to be together. Justices K V Viswanathan and N Kotiswar Singh made the observation in a transfer petition.
"In matrimonial matters, we find there is a misunderstanding on the concept of mediation," Justice Viswanathan said.
He continued, "The moment we say mediation, they think we are asking them to be together. We are not interested whether they are together or separate. We just want a solution to the matter. We will prefer if they are together..."
The apex court referred to the Commercial Courts Act, 2015 which talks about pre-institution mediation and settlement.
"In Commercial Courts Act also, you have to go through this process," the bench observed.

Bar council of India issues advisory against unapproved online LLM programmes
Bar council of India (Image credits: ANI) NEW DELHI: In a decisive step toward preserving the credibility of legal education in India, the bar council of India (BCI) has issued a formal advisory against the proliferation of unapproved LLM (master of laws) programmes offered in online, distance or hybrid formats. This advisory reinforces the exclusive regulatory role of the BCI and emphasis es compliance with existing legal and academic frameworks. The letter, authored by Justice Rajendra Menon, former chief justice of the Delhi High Court and co-chairman of the standing committee on legal education, was addressed to the registrar generals of all High Courts as well as the Supreme Court of India . Copies of the letter were also circulated to universities and state bar councils to ensure compliance and initiate appropriate action. The advisory reiterates the binding authority of Supreme Court rulings, the UGC (open and distance learning) regulations, 2020, and BCI's own Legal education rules (2008 and 2020), under which LLM programmes must secure prior approval before being conducted via non-traditional methods. Such practices, it stated, not only violate Supreme Court directives but also mislead students and degrade academic quality. The bar council clarified that under the Advocates Act, 1961, it is the only statutory authority empowered to regulate both undergraduate and postgraduate law programmes. No other entity, including UGC or autonomous universities, can validate LLM courses independently. The council emphasized that an LLM degree is the minimum qualification required for teaching law, and therefore any relaxation in quality or regulatory compliance directly affects the legal profession. In light of these violations, the BCI has urged High Courts take judicial notice of the BCI's exclusive authority in legal education, Reject qualifications obtained from unapproved LLM programmes for appointments or promotions and Require institutions and individuals to submit compliance verification from the BCI where necessary. To protect students and uphold public trust, the bar council plans to release a public advisory cautioning against enrollment in such unauthorized programmes. It is also preparing to initiate contempt proceedings and other legal measures against institutions found violating these guidelines.

Inaugurating the six-lane PJR flyover in Kondapur, spanning 1.2 km, he said, "We will establish IT companies on the land and generate lakhs of jobs. The Financial District has already created nearly 10 lakh jobs, while the Knowledge Park near Durgam Cheruvu has generated an additional five lakh jobs. We planned to create five lakh more jobs with Rs 1 lakh crore investment across 400 acres near Gachibowli stadium, but faced hurdles from certain quarters. " He added the land had been wrongly allocated to private parties in 2002-03. Congress will pay price for neglecting SES-2015, claims Union Minister Bhupender Yadav
BENGALURU: Union Minister for Environment, Forest and Climate Change Bhupender Yadav on Saturday predicted that the Congress in Karnataka will meet the same fate as its national counterpart as it has ignored the Socio-Economic Educational Survey-2015 (caste census report). Delivering the keynote address at the seminar 'Caste Census: Retrospective-Prospective' organised by the Social Justice Awareness Forum at Bharatiya Vidya Bhavan, Yadav said that Karnataka Chief Minister Siddaramaiah and his government and LoP in Lok Sabha Rahul Gandhi were anti-backward classes. The Karnataka government had recently shelved the caste census of 2015 and opted for a fresh survey. Yadav said that the Congress lost power at the Centre because it ignored the Kaka Kalelkar Commission report recommending the upliftment of backward classes socially and educationally. He expressed confidence that when the backward classes become aware that the Congress is averse to their upliftment in Karnataka, it will not be able to return to power. 'Why did those who (Rahul Gandhi) keep the Constitution in their pockets not implement the Kaka Kalelkar Commission report? After the country became independent from the Emergency and from family rule, the Janata Party came to power at the Centre. It also formed the Mandal Commission. The Congress was out of power when the issue of justice for OBCs came to the fore. But when it came to power a few years later, it had ignored the Mandal Commission report as it did it with the Kaka Kalelkar report,' Yadav said, adding that the BJP-backed VP Singh government implemented the Mandal Commission report and got reservation for OBCs.
