‘Don't see why not…': Delhi HC on plea seeking rights for same-sex couples to make medical decisions for each other
The Delhi High Court on Thursday asked the central government to respond to a plea by a woman, who sought that non-heterosexual couples get the right to make medical decisions for each other. The high court sought responses from the Union ministries of health, law, and social justice and empowerment, as well as the National Medical Commission (NMC), orally remarking that it does not see a reason why such a provision should not exist. Arshiya Takkar, a leadership coach and family business consultant who got married to her long-term partner, advocate Chand Chopra, in New Zealand in December 2023, has moved the Delhi High Court, highlighting that there exists 'no framework which grants or recognizes the rights of non-heterosexual couples to act as a medical representative of their respective partners during medical treatment/emergencies'. Senior advocate Saurabh Kirpal, appearing for Takkar, highlighted that the lack of guidelines in this regard leaves a 'big lacuna in case of queer couples and public at large'. Takkar underscored the 'critical need for recognition of their union in medical contexts,' as Chopra's immediate family members reside in different states or countries, making them potentially inaccessible during a medical emergency, and highlighted her 'indispensable role as her partner's decision-maker'. Takkar's petition submits that the Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulations, 2002 mandate consent for medical procedures/treatment from a 'husband or wife, parent or guardian in the case of minor, or the patient himself', thus lacking 'explicit recognition of partners in a union', effectively making her 'powerless to make critical medical decisions' for her partner. Takkar has cited that this is arbitrary, a breach of her fundamental right of expression, and discrimination on the grounds of sex. 'The prevailing legal framework and practices, by effectively restricting medical decision-making rights to heterosexual couples or normative family members, are inconsistent with this evolving constitutional understanding and violate constitutional morality, which mandates respect for diversity and individual dignity. The absence of legal recognition for same-sex partners in medical decision-making also contravenes India's international obligations,' Takkar has submitted. Takkar has sought the court's direction to frame guidelines directing hospitals/physicians to recognise non-heterosexual partners as medical representatives and grant them access during medical treatment. She is also seeking a declaration that a medical power of attorney given in advance by a patient to their non-heterosexual partner shall be sufficient for such partner to act as the duly constituted medical representative. Taken up before Justice Sachin Datta, the court orally remarked that it can consider the latter request, on declaring that a medical power of attorney given in advance to their partner shall suffice for consideration as being their medical representative. Kirpal further added that in the interim, the Centre too can consider framing guidelines. Meanwhile, the central government's standing counsel, Monika Arora, opposed the plea, orally submitting that while the Supreme Court has laid down 'that there should not be discrimination in goods and services available to the public', such a provision is not available for unmarried heterosexual couples, say for example a man and a woman in a live-in relationship, and thus the question of discrimination does not arise. 'Here, if someone is in a live-in relationship, a boy and girl, this (provision to authorise their partner as their medical representative) is not available,' Arora submitted. Responding to the Centre's assertion, Kirpal responded, 'I am sure the Union (government) won't be so inhuman…I am surprised. An unmarried man and woman are allowed to get married (but queer couples are not in India).' Justice Datta also orally inquired from the Centre, 'Let us take the case of a heterosexual situation, I don't see why this regime shouldn't be there. Suppose there is someone living all by himself or herself, what then?…or they are estranged from their family?' Issuing notice, the court sought the responses of the government ministries and NMC, and has now kept the matter for consideration next on October 27.

Continue Operation Sindoor till Pahalgam terror attack perpetrators are apprehended or killed: AIMIM chief Owaisi
All India Majlis-e-Ittehadul Muslimeen (AIMIM) president and Hyderabad parliamentarian Asaduddin Owaisi on Wednesday (July 16, 2025) night demanded that the Centre continue Operation Sindoor until the perpetrators of the Pahalgam terrorist attack are apprehended or killed. Addressing a public meeting in Bodhan protesting the new waqf legislation, Mr. Owaisi described the terror attack as a glaring example of the Narendra Modi government's security lapse. Owaisi Demands Revenge for Pahalgam Attack, Slams Modi Govt 'Pahalgam must be avenged. Continue Operation Sindoor. Till the time those four terrorists are caught and killed, we will keep asking you these questions,' he said. Mr. Owaisi criticised Jammu & Kashmir Lieutenant Governor Manoj Sinha for his recent remarks in which he took 'full responsibility' for the attack. 'If you are responsible, then resign. Resign and leave,' the AIMIM president said. 'How did those terrorists reach Pahalgam? Tell us.' Seeking to link claims of information being available of Nepalese, Myanmarese and Bangladeshis residing in Bihar, Mr. Owaisi wondered when this was the case, how the Modi-led government could not have information on how the terrorists entered Pahalgam. 'In Bihar, you say there are Bangladeshis and Rohingyas. Then tell me, how did those four terrorists reach Pahalgam? You talk of Nepalis in electoral rolls. But how did the terrorists get into Pahalgam? Was your administration asleep? Did your administration have their eyes closed ?' he asked.

Those who target Indians will face tough consequences, warns Amit Shah
Union Home Minister Amit Shah on Thursday said a strong message has gone out to the world that no one should mess with India's citizens, its borders or its defence forces, and those who do so will have to face consequences. Referring to Operation Sindoor carried out to destroy terrorist camps in Pakistan after the Pahalgam terrorist attack, Shah said Prime Minister Narendra Modi has done the biggest job of securing the country. During Congress rule, the country had to face terror attacks almost every day. "When the Uri attack occurred, Modi took decisive action and a surgical strike was carried out. Following the Pulwama attack, an airstrike was done. And when an attack took place in Pahalgam, Operation Sindoor was launched, targeting terrorists within Pakistan and eliminating them," he said. Shah, who is also minister for cooperation, was here to attend an event on the occasion of International Cooperatives Year-2025. "Modi's actions sent a strong message globally. Through them, Modi conveyed a powerful message to the world that India's citizens, armed forces, and borders should not be messed with. Anyone who dares to do so has to face consequences," he said. Modi, he added, has turned the vision of a prosperous, secure and developed India into reality. Under Modi's leadership, the country has become fourth largest economy in the world and 22 crore people were lifted above the poverty line, the Union minister told the gathering. Praising Chief Minister Bhajanlal Sharma, he said the BJP government in Rajasthan had done remarkable work in a short period of time. "Rajasthan was suffering due to paper leaks. By forming an SIT, the Bhajanlal government has sent a strong message to the paper leak mafia," he said. Under Sharma's leadership, Rajasthan signed MoUs worth Rs 35 lakh crore during an investment summit and work has already commenced on MoUs worth Rs 3 lakh crore, Shah said. The BJP government in the state decreased VAT on petrol and diesel and several other initiatives were taken, he went on to say. He also praised the state government for effectively implementing schemes and programmes of the central government. Shah lauded the contributions made by the cooperative sector in the country's development over the last century and said that the next 100 years are the years of cooperatives. "With the vision of reaching every corner of the nation, Modi established a Ministry of Cooperation at the central level. Today, cooperatives play an active role in 98 per cent of rural areas," he said. Highlighting the sector's contribution to the economy, he said the ministry launched 61 initiatives in the last four years to strengthen the sector. "The creation of two lakh new PACS (primary agricultural credit societies) has already started with 40,000 PACS already set up. We have completed the computerization of PACS and all states have accepted the new model bylaws for PACS," he said. He also spoke of Rajasthan's agricultural contributions. The minister said the government has initiated research on camel breed preservation and medicinal qualities of camel milk. "This will ensure the long-term survival of camels in the coming years," he said. Chief Minister Sharma also highlighted the works and achievements of his government. "We are working to ensure that the benefits of cooperatives reach our people. Under Modi's leadership, we have a plan that every beneficiary, whether it is the Centre or the State, should get its benefits," he said. During his visit, Shah inaugurated 24 food grain storage warehouses and 64 millet outlets virtually and also visited an exhibition of cooperative products. Among those present at the event were Union minister Gajendra Singh Shekhawat, Deputy Chief Ministers Prem Chand Bairwa and Diya Kumari, and former chief minister Vasundhara Raje.
