
Developer in Parker Lands saga wants Supreme Court to decide whether city staff delayed project
In April, the Manitoba Court of Appeal overturned an order that the city pay the penalty due to a 2023 ruling that found two city employees deliberately stalled the Fulton Grove development.
On Monday, an application filed in court on developer Gem Equities' behalf asked for permission to appeal the matter to the Supreme Court.

Gem Equities proposed residential development on the Parker lands called The Fulton Grove project sought to create about 1,900 housing units on 47 acres of south Winnipeg land.
'The applicants ask that leave to appeal be granted with costs,' the document states.
The developer is seeking a new ruling to ensure damages and legal costs are paid.
It's expected to take months for the court to decide if it will consider the matter or not.
The original July 2023 judgment that sparked the municipal government's appeal found two city employees liable for 'misfeasance in public office.' In April 2025, the appeal judge rejected that conclusion and found the city should no longer be held 'vicariously liable' for the delay.
The 2023 ruling noted that 'misfeasance in public office' reflects a finding of deliberately disregarding public duties with knowledge 'misconduct was likely to harm the plaintiffs.'
In the latest legal document, the developer's lawyer argues determining where misfeasance applies is a matter of national importance.
'The tort of misfeasance in public office is founded on the fundamental rule of law principle that those who hold public office and exercise public functions are subject to the law and must not abuse their powers to the detriment of the ordinary citizen,' it states.
The Fulton Grove project aims to create about 1,900 housing units on 47 acres of south Winnipeg land surrounded by the CN Railway Rivers line and the southwest rapid transitway.
In a brief statement, a city spokesman said the municipal government is aware of the Supreme Court request.

Mayor Scott Gillingham declined comment, stating he was still reviewing the application.
Kevin Toyne, the developer's lawyer, also declined comment.

Hundreds of Palestinian families flee West Bank camp ahead of Israeli demolition orders
TULKAREM REFUGEE CAMP, West Bank (AP) — Hundreds of Palestinians have fled a section of the Tulkarem refugee camp in the occupied West Bank after receiving Israeli demolition orders — joining tens of thousands of people to be displaced by an open-ended military offensive in the area. The residents loaded all of their earthly possessions — mattresses, blankets, washing machines — onto vehicles on Wednesday before taking one last glimpse of their homes and speeding off. The new demolition order affects some 104 buildings, and at least 400 families now face homelessness, said Faisal Salama, a local official in the camp. Late Wednesday, Israel's Supreme Court temporarily froze the planned demolitions in response to a request from Adalah, a Palestinian human rights group in Israel. The order gave the army until Sept. 2 to respond. But as of late Thursday, none of the displaced residents had returned. The Israeli army declined comment on the order. The exodus on Wednesday is the latest triggered by Israeli operations to stamp out militancy in West Bank refugee camps in the wake of Hamas' Oct. 7, 2023 attack that ignited the war in Gaza. Tens of thousands of Palestinians have been driven out of their homes this year in the largest displacement in the West Bank since Israel captured the territory in the 1967 Mideast war. The Israeli military justified the planned demolitions in Tulkarem, saying it operates in areas 'with high level of terrorism.' It said the decision to demolish buildings in the camp were made based on 'operational necessity' to allow Israeli forces to operate freely and move in the area, and was made after other options were considered. Israel's raids have emptied out and largely destroyed several urban refugee camps in the northern West Bank, such as Tulkarem and nearby Nur Shams. Israel says troops will stay in some camps for a year. Salama said with the latest orders, a total of 1,000 families have been displaced by recent demolition orders. 'Where will these families live? Where will they go? Their fate is uncertain and unknown,' he said. Subhi Hamdan, 65, said he was given just one day to leave. He is worried he won't be able to afford an apartment despite having registered for assistance with the cash-strapped Palestinian Authority. 'Until now we haven't seen anything at all,' he said. 'Where can anyone go?'

WASHINGTON (AP) — The Supreme Court said Thursday it will not hear a case involving a push to revive a law that minors must have their parents' permission for an abortion in Montana, where voters have enshrined the right to abortion in the state's constitution. The justices rebuffed an appeal from the Republican-led state seeking to overturn a Montana Supreme Court ruling that struck down the law. The parental consent law passed in 2013 but was blocked in court and never took effect before it was invalidated last year. Montana state leaders say that decision violated parents' rights. 'The right that Montana seeks to vindicate here — parents' right to know about, and participate in, their child's medical decisions — falls well within the core of parents' fundamental rights,' state attorneys argued in court documents. Two conservative justices, Samuel Alito and Clarence Thomas, wrote separately to say the high court's denial to take up the case was about its technical legalities rather than rejection of the state's argument. Planned Parenthood argued that the Montana Supreme Court decision balanced the rights of parents and of minors in a state that has protected the right to abortion. Montana's highest recognized a right to abortion before the Supreme Court overturned it nationwide, and voters also enshrined it in the Montana Constitution last year. 'Petitioners seek to use the parental right as a cudgel against a minor's rights,' the group wrote. 'The broader interests of the child must be accounted for along with parental rights.' The law would require notarized, written consent for people younger than 18 to get an abortion. It would also allow minors to petition judges for permission, a process known as judicial bypass. Montana also has another law in place requiring parents be notified of minors' abortions. More than two dozen states require parents consent to abortions for minors, though the laws have also been blocked in California and New Mexico, according to data gathered by KFF, a nonprofit that researches health care issues. Twelve more states require parental notification, though three of those laws are also blocked in court.
