Bung Moktar, wife fail to halt RM2.8m graft defence case

PUTRAJAYA: Kinabatangan Member of Parliament Datuk Seri Bung Moktar Radin and his wife Datin Seri Zizie Izette Abdul Samad failed in their final attempt to challenge the Court of Appeal's decision ordering them to enter their defence on three corruption charges involving RM2.8 million.
This followed a decision by a three-member panel of the Court of Appeal, led by Justice Datuk Che Mohd Ruzima Ghazali, which unanimously dismissed the couple's application for leave to review the decision.
Justice Che Mohd Ruzima, who sat with Court of Appeal judges Datuk Azizul Azmi Adnan and Datuk Ahmad Kamal Md Shahid, said the couple failed to demonstrate exceptional circumstances or a miscarriage of justice that would justify a review of the ruling.
On Nov 18 last year, a Court of Appeal panel led by Justice Datuk Ahmad Zaidi Ibrahim allowed the prosecution's appeal and overturned the High Court's decision to acquit Bung Moktar and Zizie Izette, ordering both to enter their defence.
The couple filed the leave applications in March this year under Rule 105 of the Rules of the Court of Appeal 1994, contending that the previous Court of Appeal panel lacked jurisdiction to hear the prosecution's appeal and wanted the review panel to reinstate the High Court ruling.
In delivering the court's decision, Justice Che Mohd Ruzima said the Court of Appeal had always exercised caution when invoking its power to review earlier decisions, as such a review, on the face of it, runs contrary to the principle of finality.
The judge said that when counsel for Bung Moktar and Zizie Izette submitted that there had been an injustice in the case, the court observed that the couple were not without an alternative remedy.
'The point raised before us can be canvassed in an appeal from the Sessions Court, should a conviction subsequently be recorded. We are of the view that the threshold requirements for leave to review the prior decision of this court have not been met.
'We are also of the view that this is a point that may validly be raised at the end of the defence case. For these reasons, we find that the threshold requirement for leave to review this court's previous decision has not been fulfilled. Therefore, this application is dismissed,' he said.
In today's proceedings, the prosecution was represented by deputy public prosecutors Law Chin How, Mohd Fadhly Mohd Zamry and Maziah Mohaide, while lawyers Datuk Seri K. Kumaraendran and M. Athimulan appeared for Bung Moktar and Zizie Izette, respectively.
Following this ruling today, Bung Moktar and Zizie Izette are scheduled to enter their defence on corruption charges before Sessions Court Judge Rosli Ahmad on Aug 18.
In September 2022, the Sessions Court ordered the couple to enter their defence. The couple succeeded in overturning the ruling through revision applications they had filed at the High Court. This prompted the prosecution to appeal to the Court of Appeal.
Bung Moktar, 65, who was then the non-executive chairman of Felcra Berhad, was charged on May 3, 2019, with two charges of accepting bribes of RM2.2 million and RM262,500 as an inducement to obtain Felcra's approval to invest RM150 million in Public Mutual unit trusts.
He was alleged to have accepted the bribes from Public Mutual Berhad's investment agent Madhi Abdul Hamid through Zizie Izette, 46, at Public Bank Taman Melawati Branch, Kuala Lumpur between 12.30 pm and 5 pm on June 12, 2015.
Bung Moktar was also charged with receiving RM337,500 in cash from Unit Amanah consultant, Norhaili Ahmad Mokhtar, under the name of Zizie Izette for the same reason and place on June 19, 2015, while Zizie Izette was charged with three counts of abetting her husband over the matter at the same place, date and time.
On April 9, this year, the Sessions Court allowed the couple's application to stay the defence proceeding pending the outcome of the review application.

However, his wife, Ismanira Abdul Manaf, also 30, was ordered to enter her defence after Syahliza ruled that the prosecution had established a prima facie case against her. Speaking outside the courtroom, Zaim said he was disappointed with the police, despite the full cooperation he and Ismanira had given throughout the investigation. "I cooperated fully and placed my trust in the police to find and arrest my son's killer, who is still out there, free. "But this is the result of it (wife told to enter defence)? I am extremely disappointed. "There should have been no charges. This is all ridiculous," he said. Ismanira took the stand as the first witness today after Syahliza ordered her to enter her defence for the charge under Section 31(1)(a) of the Child Act. She is accused of committing the offence between 12pm on Dec 5 and about 9.55pm on Dec 6, 2023, around Block R, Apartment Idaman, Damansara Damai, up to a nearby stream. Zayn Rayyan was reported missing from Block R of the apartment on Dec 5, 2023, after Ismanira fetched him from school at 12.30pm. His body was found a day later in the stream, about 200m from his home. Lawyers Haresh Mahadevan, Ramzani Idris, and Lavanesh Haresh acted for the couple. The prosecution is represented by deputy public prosecutors Raja Zaizul Faridah Raja Zaharudin, Aqharie Durranie Aziz, and Nur Sabrina Zubairi.

PETALING JAYA: The mother of Zayn Rayyan Abdul Matin told the Sessions Court here on Monday (July 21) that she had never neglected her autistic son, specifically on Dec 5, 2023 as stated in the charges she faces. Ismanira Abdul Manaf, 30, made the assertion during the examination-in-chief by her lawyer Haresh Mahadevan on the first day of her defence proceeding, as she shared with the court details of the day her son disappeared after she picked him up from school. "I picked Zayn up five minutes late, because I stopped at a supermarket to buy ingredients to cook Zayn's lunch, spaghetti bolognese, which he loves. After coming back, I park my motorcycle at Block C and take Zayn to the playground, where he loves to swing; that's our daily routine. "Halfway as I went up the stairs to my home, I realised that I couldn't hear the sound of his (Zayn's) shoes. I then went upstairs because I suspected Zayn had gone up, before me. When I arrived home, Zayn wasn't there. I didn't hear him running, because if he had, I would have immediately chased after him," she related. She also shared that she left both the grille door and front door open in hopes that Zayn could come in when he returned. "At that time, I called out Zayn, sometimes I call him abang because he is the eldest. I tried and called out where are you, but there was no reply," she said when recounting her movements when Zayn went missing at Block R of Idaman Apartment, Damansara Damai on Dec 5, 2023. When asked by her lawyer whether she had asked the police about what happened to her son after his body was discovered at a stream near her home the night of Dec 6, 2023, Ismanira replied that the police stated there were criminal elements, based on the injuries suffered by her son, police suspected a pedophile or a drug addict. The mother chose to provide sworn evidence from the witness box after Judge Dr Syahliza Warnoh ruled earlier today that the prosecution successfully proved a prima facie case against her, while her husband, Zaim Ikhwan Zahari, 30, was acquitted of a similar charge. Ismanira faces a maximum jail sentence of 20 years or a fine of RM50,000 or both if found guilty of the charge under Section 31(1)(a) of the Child Act 2001. She then took him to the playground near their home at Block C of Idaman Apartment, Damansara Damai, as part of their daily routine. 'Halfway up the stairs, I realised I didn't hear the sound of his shoes. I thought he might have gone ahead, but when I reached home, he wasn't there,' she said. She left both the grille and front doors open, hoping he would return. Desperate, she called out for him, using both his name and the affectionate term 'abang' (elder brother). 'I shouted 'abang... Zayn... where are you?' but there was no reply,' she told the court. When questioned about the police investigation, Ismanira said officers suspected criminal involvement due to injuries found on Zayn's body after his discovery near a stream on Dec 6, 2023. Authorities speculated the perpetrator could be a pedophile or drug addict. Ismanira faces charges under Section 31(1)(a) of the Child Act 2001, which carries a maximum penalty of 20 years' jail, a RM50,000 fine, or both.
