PM chooses key people in govt, not the royals

PM pushes back against lobby to extend CJ's term, calls it politicisation
GP20257: Prime Minister Anwar Ibrahim, if you haven't figured it out yet, let me spell it out. The issue isn't that every retiring civil servant should have his/her tenure extended, but the excellent ones should, especially when there's a vacuum in key positions.
There was no lack of candidates for the MACC chief or IGP posts, but they were duly filled, not according to normal promotion procedures.
In Chief Justice Tengku Maimun Tuan Mat's case, it's very clear that a very good CJ is being bypassed, even according to normal procedures.
It's not just ordinary people who are asking for her extension, but the Malaysian Bar, respected leaders, and other professionals.
To us, it means;
1) Your judgment is flawed and unreliable;
2) You don't understand your role, or you don't have the courage to advise the king on your choice.
It's the prime minister who chooses the key people in his or her government, not the royals, as the royals in this country, according to the Federal Constitution, do not govern.
Top appointments to the government are the PM's choices. As long as the choices are made according to the constitution, the king makes the PM's choices official. That's the meaning of the king acting on the advice of the PM.
It takes a PM with a backbone, not a glib mouth, to advise the king on his role. Apparently, Anwar can't do the job. Just resign and spare us this misgovernance.
BobbyO: What a lame excuse. Anwar, do you think the people are fools, or do you think that power is in your hands and you will decide according to your own selfish agenda, just as you did in extending MACC Azam Baki's tenure not once but thrice?
Remember, even the toughest and cruellest dictator has fallen, as they think that power is theirs to wield as they like.
Remember Umno and jailed former prime minister Najib Abdul Razak. They thought that they were unbeatable as they had the finance, resources, and manpower. Look at where they stand today.
Such a lame excuse, and Malaysians can very clearly see through you and your motive if you do not want to extend Tengku Maimun's tenure.
Why then did you extend Azam's tenure? Is it because it worked in your favour? Was it not a political move?
Why were the others due for promotion made to wait? What about the inspector-general of police and his deputy? Why was the deputy not promoted to the next level?
It is so clear to see that you are frightened of promoting decent and honest civil servants.
Seriously, Anwar, stop taking the people for granted. Umno did, and they lost big - four states to the opposition.
What will be PKR's position at the next election? Reduced to the level below MIC and MCA?
Half full Cup: Let's face it, our PM does not welcome most of the people's opinions, especially the professional group and his supporters, because he feels he is now the maharaja of the day.
In fact, he has even forgotten or refused to recognise who his supporters are for the past 20 over years.
The fault lies in his supporters (especially the urban citizens). If we look at what he did when he was in Umno, he was a very racist leader, hence his meteoric rise to be the deputy president of Umno. He was almost on the verge of becoming the president (prime minister).
Most of his reforms at the time were very much at the expense of a certain group of people. We have been badly mistaken, or maybe we have fooled ourselves.
Has DAP also taken advantage of the people's foolishness to gain power and enjoys that power now?
BetterMY: Thank you for shooting yourself in the foot once again! The rakyat is fully aware of your administration's tactics of only retaining those subservient to you.
Where you should have retained talent, you let them go, and where you should have dispensed with them, you gleefully retained.
We will keep this in mind when voting in the 16th general election. Mind you, we're not racist to completely dispel of BN and PN, there are good administrators there too. It's just a matter of ridding BN and PN of the extremist and corrupt voices.
Once that is done, we'll have a credible alternative to your incompetent administration. We have given you an opportunity, and you squandered it.
We have given you that opportunity despite your entitled attitude towards the top post since 1998. Your days at the administration are numbered, and you will soon join the one-term PM list.
And before any ardent and blind supporters of Pakatan Harapan jump on this, please be known that I have voted for Harapan since GE10. So my thinking is both reflective of the groundswell against Harapan and also the maturing of our electorate.

Mention of MACC's Ilham Tower forfeiture application set for Aug 6
KUALA LUMPUR: The mention of the Malaysian Anti-Corruption Commission's (MACC) forfeiture application for Ilham Tower, owned by the family of the late Tun Daim Zainuddin, has been fixed for Aug 6 at the Kuala Lumpur High Court. In a statement, the MACC said the application was filed on May 25 under Section 56 of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act. The statement further noted that the MACC will engage with enforcement authorities in the United States to obtain legal assistance in initiating proceedings against assets linked to Daim, his wife, Toh Puan Nai'mah Abdul Khalid, and their proxies within that jurisdiction. On June 25, MACC Chief Commissioner Tan Sri Azam Baki confirmed that the Commission had filed a forfeiture application in respect of the 60-storey building, which forms part of the latest series of assets identified for forfeiture proceedings involving the former finance minister, Nai'mah, and several of their proxies in Malaysia.

No reason to charge organisers who fail to give notice on assemblies, say lawyers
KUALA LUMPUR: There is no reason to haul people to court for failing to provide prior notification for assemblies, legal experts have said. After the Federal Court declared that Section 9(5) of the Peaceful Assemblies Act 2012 was unconstitutional, the police must abide by this ruling, said former co-chair of the Bar Council Human Rights Committee and Constitutional Law Committee Andrew Khoo. "The problem is that in the past, there have been occasions where law enforcement agencies have ignored court orders with can never and no longer be the case. "What this decision affirms is the constitutional right to freedom of peaceful assembly," he said. Constitutional lawyer Joshua Wu said that there were conflicting decisions prior to the Federal Court's ruling yesterday. "The cases of Nik Nazmi Nik Ahmad v PP and PP v Yuneswaran Ramaraj (at the Court of Appeal) – Section 9(5) of the PAA 2012 was held to be unconstitutional in Nik Nazmi's case, but was held to be constitutional in Yuneswaran's case," he said. Consequently, the police continued to use Section 9(5) against organisers of public assemblies who did not give the police the five days notice required under Section 9(1) of the Act, he said. "There will no longer be criminal sanctions or prosecutions for non-compliance with Section 9(1) of the Act. This will consequently open the doors for more public assemblies to be organised, particularly on short notice," he said. He explained the Federal Constitution only allowed for parliament to introduce "restrictions" and not "prohibitions", which was why Section 9(5) of the PAA 2012 was deemed unconstitutional. International Islamic University Malaysia (IIUM) constitutional expert Associate Professor Datuk Dr Wan Ahmad Fauzi Wan Husain, however, said local authorities must provide a space to assemble under Section 9(2) of the Act to allow operating Section 9(5). "Article 10 already imposes a limitation to a public assembly besides other constitutional restrictions. "That is why curtailing the freedom to a peaceful assembly without providing or stipulating a place can be an unproportionate balance of restrictions under Article 10. The question here is, does Section 9 provide such reasonable restrictions?" he asked. He added that subsection (5) must be read with subsection (2) of the provision. "Reading the above sections, the right approach is that the local authority must provide an assembly place under Section 9(2) before enforcing Section 9(5). "Therefore, the issue is whether Section 9(5) can be enforced by the authorities in the case before the court. In my opinion, a constitutionality issue does not arise," he said. Yesterday, the Federal Court declared it unconstitutional to criminalise the failure to notify the police five days in advance before holding a peaceful assembly. Delivering the unanimous decision by a five-member bench, Chief Justice Tengku Maimun Tuan Mat said Section 9(5) of the Peaceful Assembly Act 2012 imposed a penalty that went beyond what was allowed under Article 10(1)(b) of the Federal Constitution, which guaranteed the freedom of speech, assembly and association.

Jeffrey to lodge police report over reports linking him to Sabah graft scandal
KOTA KINABALU: Sabah Deputy Chief Minister Datuk Seri Jeffrey Kitingan will lodge a police report over a media report linking him to the graft scandal involving the issuance of mining prospecting licences in the state. Apart from Jeffrey, an online portal had also alleged that several other prominent Sabah politicians were involved in the scandal. "To me, it looks like entrapment. Why is it that we are the last group to be involved in the scandal? Why don't we do it all at once? "I can see that there is a hidden hand moving around and planning all this behind the scenes.
