Kota Kinabalu: A 42-year-old man escaped a hangman's noose after the Court of Appeal Tuesday commuted his death sentence to 30 years in jail and 12 strokes of the cane for trafficking 1,746.8gm of syabu seven years ago. A panel of three judges consisting of Datuk Azman Abdullah, Datuk Azhahari Kamal Ramli and Datuk Noorin Badaruddin allowed Ang Eng Khong's appeal and set aside his death sentence and substituted it with life imprisonment of 30 years' jail and 12 lashes of the cane after hearing his appeal against death sentence.

The charge under Section 39B(1)(a) of the Dangerous Drugs Act, carries the death sentence or imprisonment for life and whipping of not less than 15 strokes if not sentenced to death, on conviction. Earlier, counsel Hamid Ismail, who represented Ang, informed the court that the prosecution had accepted the appellant's representation letter dated 30 April this year, to substitute the death penalty to life imprisonment pursuant to the Abolition of Mandatory Death Penalty 2023 on the condition that the appellant withdraws his appeal against conviction. Hamid then applied to the court to strike out the appeal against the conviction and allow the appeal against the sentence, and substituted it with the sentence of life imprisonment of 30 years' from the date of arrest on Oct 31, 2018 , along with 12 strokes of the cane. Hamid also informed the court that Ang wished the sentence of whipping not to be imposed on him because he had a car accident in 2017, which caused steel to be inserted in both his thighs. 'Whipping will affect the screw of the steel and this will definitely affect his health,' said Hamid. Deputy Public Prosecutor (DPP) Nik Mohd Fadli Nik Azlan appeared for the prosecution as the respondent. In another case, a 31-year-old barber was fined a total of RM10,000 by the Magistrate's Court on two counts of cheating a woman of RM11,400. Sheryn Yong pleaded guilty before Magistrate Marilyn Kelvin to both charges under Section 417 of the Penal Code which carries a jail term of up to five years, or a fine, or both, on conviction. On the first count, Yong was ordered to pay a fine of RM5,000 or seven months in jail for deceiving Ooi Jin Xuan into making a payment of RM7,400 into her (Yong's) bank account, under the false pretence of managing the appointment of a lawyer for Ooi, between June 9, 2024 and June 30, the same year, at a unit, at Dah Yeh Villa, here. Yong, on the second count, was fined another RM5,000 or seven months' jail also for deceiving Ooi into making a payment of RM4,000 into her (Yong's) bank account, under the false pretence of managing the appointment of a lawyer for Ooi, between July 4, 2024 and July 14, same year, at a unit, at Dah Yeh Villa, here. Shop assistant charged with CBT involving RM114,000
KOTA BHARU: A shop assistant was today charged with 10 counts of criminal breach of trust for allegedly failing to hand over RM114,630.80 to a company 10 years ago, when she was a clerk there. Bibi Kasiran Mohamad, 50, claimed trial for all 10 charges allegedly committed between January and October 2015 at a ticket counter at the Lembah Sireh Bus Terminal, before Sessions Court judge Zulkifli Abllah. She was charged under Section 408 of the Penal Code, which carries a jail term of between one and 14 years, whipping and a fine, upon conviction. Deputy public prosecutor Ahmad Faiz Fitri Mohamad suggested the court impose a bail of RM5,000 for each charge. However, the accused's lawyer, Muhammad Khairul Azwan Azhan, sought the court to impose a bail amount of RM15,000. He reasoned that his client, the accused, was currently employed as a pastry shop assistant and is a widower after her husband's death last year. "My client is only paid RM45 a day, besides taking care of her elderly parents and has no previous criminal record," he said. The court set RM18,000 for bail with one surety.

Op Adun: Two Sabah assemblymen, businessman to be charged tomorrow
KOTA KINABALU: Two state assemblymen and a businessman, hauled up by the Malaysian Anti-Corruption Commission (MACC) under Op Adun, are scheduled to be charged tomorrow. In a media invitation, the Sabah MACC said the trio are expected to be charged at the Special Corruption Court here at about 9am. They will face a total of four charges under the MACC Act 2009. Two of the charges will be brought under Section 16(b)(A) of the Act for offering bribes, while the other two will be under Section 16(a)(A) for accepting bribes. Op Adun is an investigation into the involvement of Sabah assemblymen in the issuance of mining licences. Authorities began their probe following the publication of a series of edited videos by a news portal in November last year. It was reported earlier this week that the MACC had arrested another Sabah assemblyman on suspicion of soliciting and receiving bribes amounting to about RM150,000 in connection with mining licences in the state. The suspect, who serves as an assistant to a minister, was detained when he turned up to provide his statement at the Sabah MACC office at 9.30am on June 23. The man, in his 40s, is the third state assemblyman arrested by the MACC to date in connection with the corruption investigation. MACC Chief Commissioner Tan Sri Azam Baki had previously said that the commission is expected to charge three individuals under the ongoing Op Adun probe. He was reported as saying that the trio, comprising two assemblymen and a civilian, were expected to be charged by the end of this month.

Former bus ticketing clerk claims trial to CBT charges involving RM114,630
KOTA BHARU: A former bus ticketing clerk pleaded not guilty today to 10 charges of criminal breach of trust (CBT) involving RM114,630.80 in unremitted ticket sales from 2015. Bibi Kasiran Mohamad, 50, was accused of failing to hand over proceeds ranging from RM7,000 to over RM18,000 per transaction while working at Lembah Sireh Bus Terminal. The charges were read before Sessions Court Judge Zulkifli Abdullah. The case falls under Section 408 of the Penal Code, which carries a potential prison sentence of one to 14 years, caning, and a fine if convicted. Deputy Public Prosecutor Ahmad Faiz Fitri Mohamad did not offer bail but suggested RM5,000 per charge if considered. Defence counsel Muhammad Khairul Azwan Azhan requested lower bail, citing his client's financial struggles, health issues, and family responsibilities. 'My client earns RM45 daily at a kuih stall and cares for elderly parents. This is her first offence,' he said. The court set bail at RM18,000 with one surety and scheduled the next mention for August 28.
