2008 Malegaon blast: NIA court acquits all 7 accused, gives them benefit of the doubt

Mumbai: The benefit of the doubt given to the seven acquitted accused in the 2008 Malegaon blast case is rooted in the Special NIA court's rejection of the prosecution theory that Lt Colonel Shrikant Purohit planted the bomb on a motorcycle and that the vehicle belonged to Sadhvi Pragya Singh Thakur.
Special National Investigation Agency (NIA) Judge A.K. Lahoti pulled up the prosecution for its failure to prove who manufactured or supplied the bomb and slammed the investigators for their inability to establish who planted the bomb on the motorcycle.
Giving the benefit of the doubt to the accused, the court dismissed the prosecution's charge that an explosive was fitted in the motorcycle by Lt Colonel Purohit, saying that the explosive could have been placed or hung on the vehicle.
Also, the chassis number of the motorcycle was never recovered, and it could not be established that Sadhvi Pragya was the owner of the vehicle, it noted.
No evidence was found linking Abhinav Bharat to the activity, and the entire case was based on an allegation, the court said.
Additionally, Judge Lahoti noted that there was no proof that RDX was stored at Lt Colonel Purohit's residence and took a serious view of allegations that explosives were planted at the residence of accused Sudhakar Chaturvedi.
The court has now directed the Additional Director General (ADG) of the Anti-Terrorism Squad (ATS) to initiate a probe into allegations that explosives were planted at the residence of accused Chaturvedi.
The acquittal is also a reflection of the shoddy probe conducted into the case. The court said that the 'panchnama' was not prepared properly after the blast, and no fingerprints were collected from the crime scene.
Experts failed to collect evidence properly after the incident, resulting in contamination of crucial proof, the NIA court said.
The seven individuals who were put on trial included Sadhvi Pragya Singh Thakur, former BJP MP from Bhopal; Lt Col Prasad Shrikant Purohit, then serving officer in Military Intelligence; Major (Retd) Ramesh Upadhyay; Ajay Rahirkar; Sudhakar Dwivedi; Sudhakar Chaturvedi and Sameer Kulkarni.
The explosion killed six people on September 29, 2008, and 101 were injured in Malegaon, a communally sensitive town in Maharashtra, when a bomb strapped to a motorcycle detonated near a mosque during the holy month of Ramzan.
Following the blast, riot-like conditions erupted at the site, with local residents attacking police, further complicating the investigation.
While acquitting the accused, the NIA court also directed the Maharashtra government to pay Rs 2 lakh compensation to the victim's families and Rs 50,000 to the injured.
Meanwhile, Advocate Shahid Nadeem, lawyer of one of the victims in the Malegaon blast case, said, "This is not a clear acquittal; an appeal will be filed in this matter.'
Earlier, accused Major Upadhyay said, 'I was physically tortured, mentally ruined, financially devastated and socially boycotted. My landlord threw me out with my belongings. I spent 9 years in jail, and my family suffered immensely…'
The hearing in the case concluded in April this year, and the court reserved its judgment on April 19.
Throughout the trial, the prosecution examined 323 witnesses, though 34 of them turned hostile, significantly weakening the prosecution's case.
Initially, the investigation was conducted by the Maharashtra Anti-Terrorism Squad (ATS), which arrested the accused and filed the first charge sheet. However, in 2011, the probe was transferred to the NIA.
In 2016, the NIA filed a supplementary charge sheet dropping charges against several accused, including Sadhvi Pragya, citing insufficient evidence to prosecute them under stringent anti-terror laws.
All accused were out on bail during the trial. They were facing serious charges, including conspiracy, murder, and use of explosives under UAPA and IPC provisions.

Bengaluru: The Lokayukta officials on Friday raided the residence of a former clerk at the Karnataka Rural Infrastructure Development Limited (KRIDL) and found unaccounted assets worth over Rs 30 crore. The officials found out that Kalakappa Nidagundi, who worked in Koppal and had a monthly salary of Rs 15,000, owned twenty-four houses, four plots, and 40 acres of farmland. Four vehicles, 350 grams of gold, and 1.5 kg of silver were also recovered during the raids. The properties were in his name, his wife's, and her brother's. Nidagundi and an ex-KRIDL engineer, ZM Chincholkar, allegedly siphoned off over Rs 72 crore by faking documents for 96 incomplete projects. Lokayukta Raids The Lokayukta sleuths have been raiding government officials accused of amassing wealth disproportionate to their known sources of income. On Tuesday, they conducted searches at places linked to five government officials in Hassan, Chikkabalapura, Chitradurga and Bengaluru. The officers who came under Lokayukta's radar were Jayanna R, Executive Engineer, NHAI Division, Hassan; Anjaneya Murthy M Junior Englneer, Rural Drinking Water and Sanitisation Department Chikkabalapura; Dr Venkatesh, Taluk Health officer, Hiriyur, Chitradurga; N Venkatesh, Revenue Officer, BBMP Dasarahalli sub-division, Shettihalli in Bengaluru; and K Om Prakash Senior, Assistant Horticultue Director, BDA Head Office in Bengaluru. On July 23, they carried out searches in premises linked to eight officials, including an IAS officer, in a disproportionate assets case and recovered wealth worth Rs 37.42 crore. The raids were conducted at 41 locations linked to the officers posted in Bengaluru Urban, Mysuru, Tumakuru, Kalaburagi, Koppal and Kodagu districts. Among those raided was IAS officer Vasanthi Amar B V, who serves as Special Deputy Commissioner at the Railway Infrastructure Development Company, Karnataka (K-RIDE). She was also responsible for the land acquisition for the Bengaluru Sub-urban Railway Project (BSRP). During searches at five places linked to Vasanthi, officials recovered assets worth Rs 9.03 crore, including three sites, four houses, three acres of agricultural land to the tune of Rs 7.4 crore, ornaments worth Rs 12 lakh, and vehicles worth Rs 90 lakh.

The Enforcement Directorate (ED) has called Anil Ambani, chairman and managing director of Reliance Group, to appear for questioning on August 5. This is part of an investigation into an alleged Rs 17,000 crore loan fraud, according to a report by The Economic case relates to money laundering under the Prevention of Money Laundering Act (PMLA). Last week, ED officials searched 35 locations in Mumbai. These searches covered 50 companies and 25 individuals connected to Reliance the ED's probe, the Securities and Exchange Board of India (Sebi) has submitted findings of a separate report, as accessed by The Economic Times, alleged that Reliance Infrastructure (R Infra) diverted around Rs 10,000 crore. This money was moved through inter-corporate deposits (ICDs) to other Reliance Group companies. The route taken was via a private company called CLE Pvt Ltd, which was not earlier disclosed as a related an engineering and construction firm based in Santacruz East, Mumbai, came under the scanner during the investigation. Sebi found that R Infra transferred funds to CLE over many years. According to its report, this was done without informing shareholders or audit committees, which is required under current laws.A person familiar with the group told ET that the figures shared in the Sebi report are incorrect. According to this person, Reliance Infra had already disclosed this matter on February 9. 'Sebi has not made any independent discovery,' the person said. 'Reliance Infra's total exposure was Rs 6,500 crore, so how could the diversion be Rs 10,000 crore?'The same person added that the company had followed legal processes to recover the amount. Reliance Infra reportedly reached a settlement to recover the full Rs 6,500 crore through mediation led by a retired Supreme Court judge. The case was filed with the Bombay High also said that the recovery from Odisha's distribution companies, part of the settlement deal, is still pending in court. 'This amount is fully recoverable,' he said, and denied receiving any notice from Sebi on the May, Sebi wrote to three agencies: ED, the National Financial Reporting Authority (NFRA) and the Insolvency and Bankruptcy Board of India (IBBI), asking them to investigate the matter on their to Sebi, the transactions between R Infra and CLE were not just business dealings. The market regulator said the company showed these as normal business activities, which helped hide the fact that funds were being moved to another group report added that R Infra did not disclose these connections in its financial reports. Sebi claimed this misled investors and regulators. 'By considering CLE as a third-party company, R Infra avoided accurate and meaningful disclosures,' said the report. It added that these misstatements 'continue till date.'Sebi found that R Infra had moved funds to CLE in different forms. These included loans, investments in shares and giving corporate guarantees. As of March 31, 2022, the total exposure was Rs 8,302 crore. The regulator's probe covers financial years from 2016 to 2017 and 2021, R Infra wrote off Rs 10,110 crore because of provisions, fair value adjustments and impairments. Sebi said that even after CLE showed signs of not being able to repay loans, R Infra kept sending more also found that CLE's annual transactions made up a significant portion of R Infra's total assets. From 2013 to 2023, this ranged from 25% to 90% each further claimed that R Infra did not name CLE as a related party to avoid mandatory clearances and checks. This included approvals from shareholders and audit report pointed to documents that showed the link between CLE and Reliance Group. These included submissions by CLE to Yes Bank, where CLE named R Infra as its promoter. Audit committee meeting notes also mentioned CLE as a group company. In addition, all email addresses linked to CLE's bank accounts ended with @ by key people during the Sebi probe and internal company records supported these findings. Several directors and top managers of CLE were also part of Reliance Group's leadership, further suggesting a close report said Anil Ambani held over 40% stake in Reliance Infrastructure until March 2019. He was also non-executive chairman and a director of the company till March 25, 2022.
