
‘Fake' certicate for job: Surat court rejects anticipatory bail application of dismissed cop
B M Chaudhary was dismissed from service as per an order by the state home department, dated May 20. A week later, on May 25, he was booked under Section 12(1)(A), 12(1)(B) of the Gujarat Scheduled Castes, Scheduled Tribes and Other Backward Classes (Regulation of Issuance and Verification of Caste Certificate) Act, 2018.
Chaudhary then filed an anticipatory bail application with Surat District Court of 14th Additional Session Judge B M Govani a few days ago.
The order passed by the court on Wednesday stated: 'Investigating Officer is hereby directed to strictly comply with the provisions of Section 35(2) of BNSS (the arrest of a person without a warrant when a complaint, credible information, or reasonable suspicion exists that they are involved in a non-cognizable offense) and the ratio laid down by Supreme Court in the case of Arneshkumar Vs. State of Bihar in their true letter and spirit.'
As per the details of the case, Chaduhary's late father Motiram Chaudhary had allegedly obtained a fake ST certificate, issued to him on July 19, 1990. Chaudhary then allegedly landed a job using the certificate. He was recruited as a sub-inspector in 1990, and later was promoted to the posts of a police inspector and then an assistant commissioner of police. Chaudhary had been posted as the ACP, K division, Surat city police, since 2022.
The case was filed against Chaudhary based on a letter by Praveen Parghi, president of Adijati Vikas Trust, Godhra, on October 7 last year. Parghi claimed that Chaudhary had used a fake ST certificate to get his job and promotions. The State Vigilance Department ordered the Gujarat Police's vigilance cell to launch a probe.
According to the FIR, the commission had written to Chaudhary '15 times' in 2024 seeking documents, but he delayed the process, seeking more time. The State Vigilance Department subsequently ordered registration of an offence against him, it stated.
Additional Public Prosecutor Dighant Tevar said, 'The accused police officer had obtained a tribal certificate to get a job in the police department. The investigation agency had reminded him 15 times to appear for statements, but he failed to turn up.' Defence lawyer M A Patel did not respond to calls till the press time.

Interpretation of law, Constitution must suit society's needs: CJI Gavai
Chief Justice of India Bhushan Ramkrishna Gavai on Saturday said the interpretation of law or the Constitution has to be "pragmatic" and in a way that suits the needs of society. Speaking at a felicitation organised for him by the Bombay High Court here, he also mentioned that recently he had received complaints about the rude behaviour of "some of the colleagues", and urged the judges to protect the reputation of the institution. Citing a past Supreme Court judgement, Gavai said any law or the Constitution has to be interpreted in the context of "problems faced by the present generation." "The interpretation has to be pragmatic. It has to be one that suits the needs of society," he added. Judges are expected to work as per their conscience, the oath of office and law, but "should never be perturbed once the matter is decided", he said. A judge should cut off his mind from the matter and forget what happens to it thereafter, he added. Talking about the appointment of judges, the CJI asserted that "at no cost the independence of judiciary shall be compromised". While making appointments either to the Supreme court or high courts, the collegium ensures that merit is maintained while there is diversity and inclusiveness, Gavai said. He complimented the Bombay High Court -- where he once practiced as a lawyer and served as a judge -- for its work, and said he feels proud when people appreciate its judgements. The CJI also said that lately he has been "receiving a lot of complaints about the rude behaviour of some of the colleagues." "Being a judge is not a 10 to 5 job, it's an opportunity to serve society. It is an opportunity to serve the nation," he stressed, and urged the judges to be "true to their oath and commitment." Dalit man ‘dies by suicide' in Faridabad; in FIR, son blames neighbour's ‘failure to control pet dogs'
A case was registered after a Dalit sanitation worker allegedly died by suicide at his house in Faridabad Friday morning, the police said. The deceased was identified as Jagan, 50, from Kalyanpuri. Officers said his son, Kapil, 27, filed a complaint alleging that their neighbour Khushiram's failure to control his five pet dogs caused distress to Jagan. Following Jagan's death, a First Information Report (FIR) was filed against the neighbour at SGM Nagar police station, invoking the offence of abetment to suicide and sections of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. Kapil's complaint stated that the incident took place around 5.30 am on Friday. He alleged that Khushiram's dogs roamed freely, damaging Jagan's motorcycle and scooter seats and scattering garbage. Despite Jagan's repeated requests to Khushiram to restrain the dogs, the issue persisted, with the latter allegedly arguing and misbehaving. Kapil noted that Jagan had reported the matter to the NH3 NIT police post and the Faridabad Municipal Corporation, but no action was taken, adding to his distress. The police were informed of Jagan's death at 7.20 am, and the body was sent to Badshah Khan Civil Hospital for autopsy. Inspector Ranbir Singh, Station House Officer (SHO), SGM Nagar police station, told The Indian Express, 'The neighbour had a habit of regularly feeding many stray dogs, and they would gather around his house often for the same.
