Man, 25, settles €4.75m action after being struck by steel jack at road works
Karam Ali, his counsel Edward Walsh SC, instructed by Connellan Solicitors, told the High Court, was a general operative and was working laying ducts on Shantalla Road, Galway city, when the accident happened five years ago.
Counsel said a car struck a steel jack which then collided with Mr Ali. Liability, counsel said, was conceded last year and the case was before the court for assessment of damages only. The settlement was reached after mediation.
He said Mr Ali suffered an acquired brain injury and now has difficulty with concentration and excess fatigue and other issues. He had been in this country for eight months when the accident happened.
Karam Ali, 25, with an address in Bradford, England, had sued car driver Mohamed El Helali of Barnacranny, Bushy Park, Galway, as a result of the accident on May 1, 2020.
It was claimed that the car suddenly and without warning struck a steel jack which in turn hit Mr Ali and he suffered catastrophic injuries. Mr Ali was wearing a safety helmet which it was claimed was knocked off in the accident.

It was claimed there was a failure to appreciate the presence of Mr Ali on the roadway and a failure to appreciate that works were ongoing. It was further claimed that the driver allegedly neglected to look where he was driving and allegedly failed to drive with due care and attention and to proceed cautiously past the works where Mr Ali was working.
There was also, it was contended, a failure to take account of the roadworks and traffic conditions pertaining at the time and to take heed of Mr Ali on the public road.
Mr Ali, who sustained a head injury, including fractures to the skull, was taken to hospital in Galway and later transferred to Dublin, where he had to have an operation to remove part of his skull to manage brain swelling due to severe traumatic brain injury.
His family travelled to Ireland to be at his bedside and he was later transferred to a UK hospital.
Approving the settlement, Mr Justice Paul Coffey said it was fair and reasonable.

Conor McGregor appeal: Court to ask DPP to consider possible perjury concerning fresh evidence

Ms Hand described the evidence as 'lies' and said Mr Redmond never assaulted her during their relationship. Mr McGregor denied raping Ms Hand and claimed they had consensual and 'vigorous' sex. Ms Hand's senior counsel, John Gordon, asked the court to refer the fresh evidence matter to the DPP for consideration of possible perjury, including possible inducement by Mr McGregor of perjury. After considering material in chambers, Ms Justice Isobel Kennedy said the court intended to refer the matter to the DPP and would inform the parties what materials would be forwarded.

Appeal court defers judgment on Conor McGregor's appeal over High Court jury finding in civil rape case
The Court of Appeal has said it will give judgment 'in due course' on Conor McGregor 's appeal against a civil jury finding in favour of Nikita Hand , who sued him over alleged rape in a Dublin hotel. Mr McGregor, who denied rape and claimed he had consensual and 'vigorous' sex with Ms Hand in the Beacon hotel on December 9th, 2018, advanced grounds of appeal. They included that the trial judge erred in directing that the High Court civil jury should be asked to decide whether Mr McGregor assaulted, rather than sexually assaulted, Ms Hand. Another ground included that the trial judge, Mr Justice Alexander Owens, erred in permitting a line of questioning concerning Mr McGregor's 'no comment' responses to investigating gardaí after providing them with a pre-prepared statement in response to Ms Hand's rape claim. READ MORE Lawyers for Ms Hand opposed the appeal and urged the court to allow the jury decision to stand. An order requiring Mr McGregor to pay Ms Hand's estimated €1.3 million legal costs has been stayed pending the outcome of the appeal. Mr McGregor had sought to introduce fresh evidence for his appeal which he said bolstered his insistence he was not responsible for bruising on the body of Ms Hand noted by a doctor who examined her on December 10th, 2018. The evidence included affidavits from Samantha O'Reilly and Steven Cummins, who lived across the road from Ms Hand in Drimnagh in late 2018. In an affidavit sworn last January, Ms O'Reilly claimed she had witnessed, from her home, a physical altercation between Ms Hand and her then partner Stephen Redmond in their home on the night of December 9th/10th, 2018. In an affidavit, Ms Hand described her neighbours' claims as lies and said Mr Redmond never assaulted her that night or at any time during their relationship. After an application to admit the neighbours' evidence was dramatically withdrawn by Mr McGregor's side at the outset of the appeal on Tuesday, Ms Hand's lawyers applied on Wednesday to have the matter referred to the Director of Public Prosecutions (DPP) for consideration of possible perjury, including possible induced perjury by Mr McGregor. The fresh evidence application was not just to adduce further evidence but to undermine Ms Hand's reputation pending the hearing of the appeal, he said. Having viewed materials in chambers, the court agreed to refer the matter to the DPP and said it would inform the parties of the materials it proposed to refer. The court reserved judgment on a linked appeal by James Lawrence (36), Rafter's Road, Drimnagh, against Mr Justice Owens's refusal to award him costs against Ms Hand after the jury found he had not assaulted her in the hotel after Mr McGregor had left. During the civil trial, it was confirmed that Mr McGregor, who said Mr Lawrence was his friend, was paying his legal costs for the civil case. Senior counsel John Fitzgerald, for Mr Lawrence, argued on Wednesday that his client was entitled to his costs against Ms Hand on grounds including the normal costs rule that they go to the winning party. Ray Boland SC, for Ms Hand, submitted that the trial judge had discretion to make the order he had. When counsel said an order for costs against Ms Hand would wipe out her damages award, Ms Justice Kennedy said wanting the court to take cognisance of possible consequences of its orders was a 'difficult' argument to make.

Man who dragged visually impaired child from mother walks free
A man who dragged a visually impaired child away from her mother has been given a suspended sentence. Dublin Circuit Criminal Court heard that Stephan Obelngoa (24) of Deerpark Road, Tallaght, Dublin 24, pleaded guilty to assault causing harm, assault of a peace officer and resisting arrest at The Square, Tallaght. Dublin, on October 2, 2023. He has six previous convictions and was on bail at the time of this offence. Judge Sinead Ni Chulachain handed down an 18 month prison sentence but suspended it in full on strict conditions. Garda Sergeant Gemma Collins told Shaun Smyth, BL, prosecuting, that an 11-year-old girl, her mother and little brother were leaving the shopping centre on the day in question when they noticed a man later identified as Obelngoa. He was topless, and the mother described his movements as 'unnerving' and said he seemed 'aggressive'. The court heard the mother intended to walk on and avoid Obelngoa, but she suddenly noticed that her daughter had disappeared from her peripheral vision. The woman turned around and saw her visually impaired daughter being dragged away by Obelngoa. The little girl was screaming, crying and struggling to get away. The mother described her daughter as 'bouncing off the ground'. Obelngoa then threw the girl into a concession stand. Gda Sgt Collins said two security guards immediately subdued Obelngoa. When gardai arrived, they found Obelngoa was shouting, roaring and aggressive as he was being restrained. He then spat a mixture of blood and saliva into the face of one of the gardai. As gardai were trying to place handcuffs on Obelngoa, he tried to bite them. Specialist gardai interviewed the young girl, and she described to them 'being dragged like a doll and being dragged on the floor'. She said, 'I thought he was going to drag me away forever and would kidnap me'. The girl was examined the following day by a doctor, and a medical report stated she suffered minor spinal soft tissue tenderness and abrasions. The court heard the young girl had trouble sleeping and was extremely anxious in public places like shopping centres afterwards. Gda Sgt Collins agreed with Ciara Ní Ghabhann BL, defending, that gardaí were unable to interview her client after he was arrested, as he was made an involuntary patient in Tallaght Hospital, where he remained for a period of time. The garda agreed with counsel that CCTV footage obtained by the gardai shows that the incident lasted a matter of seconds. Ms Ní Ghabhann said her client suffers from schizophrenia and is given antipsychotic medication every three months. She said at the time of this incident, Obelngoa had been off his medications for six months and was self-medicating with cannabis. Counsel said her client is currently under the supervision of the Probation Services and has undertaken community response programmes. The Probation Services have said he is at low risk of reoffending. She said Obelngoa has written letters of apology to both the garda and the young girl in this case, outlining his sincere remorse. He does not have a clear memory of the incident, but when shown the CCTV footage, he was embarrassed. She asked the court to take into account that her client was quite young and had an acute mental health issue when this offence was committed. She said her client has taken steps to ensure that nothing like this will ever happen again. At a hearing last month Judge Ni Chulachain said, 'these are very serious offences,' and adjourned the case for two weeks to consider her sentences and read all documents handed into court. In sentencing the judge noted that the injured party was walking past him with her mother when he threw her into a concession stand and had to be pepper sprayed. The judge asked Sgt Collins to explain to the injured party 'that we can't punish people for things that aren't their own fault' and that 'if he takes his medication - he's never going to come near her again.' 'It must be very strange to her that he is not going into prison,' the judge added. She said the onus was on the defence to establish their client was suffering from a mental illness and that she was satisfied they had done so. She noted he was unmedicated for six months and was displaying his genitalia in public while in hospital. Judge Ni Chulachain noted his mental state at the time but said it 'does not reduce all your culpability,' she said. She said the appropriate sentence was 18 months but she had to take account of his guilty plea which saved the injured party giving evidence at her young age. The judge noted he was 24 and was in college but dropped out and was on bail for six offences but there was a 'positive' probation report and he was at low risk of reoffending if he continued on the same path. She imposed one-year imprisonment term to run concurrently on each of the assault charges but in view of the effect prison would have on him, she suspended it for two years on strict conditions.
