She also said that redressal for sexual harassment complaints need not only cater to women but should cover 'men and all persons with different sexual orientations, so there may be a need for change in the legislation over here'.
Justice Singh, the presiding officer of the seven-member committee of the HC's ICC, was speaking at the launch of an integrated online portal that allows for the filing of sexual harassment complaints. The portal not only includes the HC's ICC, but also integrates the ICCs for the Delhi High Court Bar Association (DHCBA) and the Bar Council of Delhi (BCD).
'The existing ICC of the HC primarily handles complaints against the staff and maybe sometimes against any other person. However, in the working of ICC, we realised there is a big gap that needs to be filled, and that's when we requested the DHCBA and the BCD… and now both have ICCs,' Justice Singh said.
'A collection of data would show that in the last 10 years, 17 complaints have been entertained by the Delhi HC ICC. In (Delhi's) district courts' ICC, there have been about 20-30 complaints… but it doesn't mean there are only that many complaints. There may have been many other women who have not been able to file complaints in a confidential manner. During our experience in the Delhi HC ICC, we realise there is a hesitation among women to physically go and file complaints, which this portal intends to solve,' she added.
Sharing patterns of the complaints received by Delhi HC's ICCs, Justice Singh further said, 'One of the biggest things we realised during ICC proceedings was that most of the complaints arise out of misunderstanding or a lack of sensitivity of the terminologies that can be used towards colleagues. Sometimes men or women may use language which may not be acceptable, but they don't know it is not acceptable language. So, sensitisation is one of the best ways this can be (remedied)… Most of the time, it is onlya misunderstanding…'
'The other challenge we faced was the quantum of time ICC had to spend on each of these complaints… Some of the challenges I personally felt… there is a huge amount of time that sitting judges has to spend on ICC complaints as trials take a long time, a large number of staff against whom complaints are filed are governed by CCS (CCA) Rules [Central Civil Services (Classification, Control & Appeal) Rules], and inquiries can be long drawn. We don't know how to solve this problem… we need to find a solution…'
'So, there was a need felt that we should have our own guidelines, which can also be adopted by DHCBA and BCD… A sub-committee was formed to draft those guidelines and they have been finalised,' she added.
Delhi HC Chief Justice D K Upadhyaya on Thursday said he has approved the guidelines and the same are expected to be made public soon.
Batting for mediation to also be made a part of the initiatives taken to deal with sexual harassment complaints, Justice Singh said, '…a lot of ego issues which colleagues may have with each other… which may have converted into sexual harassment complaints… can get sorted.'
Expanding on the ambit of sexual harassment complaints, she added, '…While we are focusing on women filing sexual harassment complaints, the other experience was, several men who face these complaints face it wrongfully… If we don't find anything in the complaint at the preliminary stage itself, we close several complaints… and there could be various extraneous conditions as well, which can lead to the filing of such complaints. The ICC is very conscious while dealing with such complaints… Some complaints are genuine and some are not, and I feel sexual harassment need not be constrained to women complainants but could also be extended to men and all persons with different sexual orientations, so there may be a need for change in the legislation over here.'
Justice Kotiswar Singh from the Supreme Court, who was present at the event, said, 'While the POSH Act (Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013) has been understood in most jurisdictions, yet the number of cases being handled varies from HC to HC. Even in SC – I won't go into details as some sensitive cases are being handled – but what I found was that this is particularly confined to the lawyers' community.'
'So, it is a big responsibility of the Delhi Bar Council and Association to see that the redressal mechanism is properly put in place and the mechanism is indeed functional… We also need to sensitise people that certain acts are prohibited, cannot be tolerated… and it is not an easy process,' he added.

MUMBAI: The Bombay high court on Monday refused to issue directions to the Bar Council of Maharashtra and Goa (BCMG) to constitute an internal complaints committee (ICC) to deal with complaints of sexual harassment under the Prevention of Sexual Harassment (PoSH) at Workplace Act, 2013 as lawyers are not employers of the bar council. The PoSH Act protects women from sexual harassment in the workplace and provides a mechanism for complaint redressal. It mandates the formation of ICCs in organizations with 10 or more employees to handle such complaints. Under the Act, the employer is responsible for creating a safe working environment, formulating a policy against sexual harassment and establishing an ICC. However, the court held that the provisions of the PoSH Act would not apply to the complaints of female lawyers of the Bar Council of India (BCI) and the BCMG as there was no 'employee-employer' relationship between the lawyers and the bar councils. 'The provisions of the Act of 2013 apply when there is an employee-employer relationship. But in the case of advocates and the BCI or the BCMG, there is no such relationship as neither the BCI nor the BCMG can be said to be employers of the advocates and, thus the provisions of the Act of 2013 will not apply to complaints filed by lady lawyers,' the court said while rejecting the relief. 'It is, however, made clear that the provisions will apply on complaints filed by any of the employees or the committee members of the BCI and BCMG,' the court observed. It added that Section 35 of the Advocates Act provides action against professional or other misconduct by the lawyers. 'This is a remedy available for lady lawyers, to file complaints against any kind of harassment which may amount to professional or other misconduct,' the bench added.

Sinking of MSC Elsa 3: Kerala seeks Rs 9,531 crore compensation
KOCHI: The state government on Monday moved the High Court seeking a compensation of Rs 9,531 crore for the losses suffered in connection with the sinking of container vessel MSC Elsa 3 off Kerala coast on May 25. The government filed an admiralty suit against MSC Akiteta II, a Liberian-flagged sister vessel of Elsa 3, to secure the compensation amount for the damage caused to the economy, environment and the livelihood of fishermen following the sinking of the vessel owned by Mediterranean Shipping Company. Considering the plea, the court ordered the arrest of Akiteta II, currently docked at Vizhinjam port, until the shipping firm deposits Rs 9,531 crore in the court. The HC will consider the case on July 10. The state argued that Elsa 3 was carrying over 643 containers, which included hazardous cargo and plastic pellets known as 'nurdles'. 'Incident affected coastal economy' The subsequent oil slick and floating cargo are serious threats not only to coastal fisheries but also to public health. As of June 30, a total of 61 containers washed ashore, and about 60 tonnes of plastic nurdles alone were collected as part of the clean-up operations by over 600 government personnel and 300 volunteers, the government stated. The fish market has suffered a severe crash due to the fear of contamination, while six carcasses, including dolphins and a whale that are suspected to have died due to exposure to microplastic and toxic substances from the vessel, were found washed ashore. This has in turn affected the coastal economy and public confidence, says the admiralty suit, while claiming Rs 8626.12 crore as the damage due to pollution, Rs 378.48 crore to restore the environment, and Rs 526.51 crore for economic loss to fishers.

Bot bazaar busted: Crackdown restricts online operations of Tatkal e-ticketing racket
The online network of Tatkal ticketing agents, employing bots to grab tickets before genuine travellers, appears alarmed following India Today's exposure of their operations, tactics, and investigation into the racket found that agents were using unauthorised platforms to book Tatkal tickets in under 60 seconds. These platforms relied on bots and stolen Aadhaar-verified IRCTC accounts, putting user data at agents, accompanied by techies who developed the bots, and fake service providers, exploited loopholes in the IRCTC booking system and used Telegram and WhatsApp accounts for their operations. India Today identified over 40 active groups on Telegram and WhatsApp. Some dissolved after the report, while others shifted to more closed and covert channels of communication. Many also wiped their message history to erase traces of their operations.A WhatsApp group named 'Jai Shree Ram Bhai Tatkal Materials' changed its name to 'Jai Shree Ram Bhakton Ka Parivaar' in an attempt to avoid suspicion. Shortly after, the group admin informed members to join a secret backup group, admitting that their details had been exposed in news reports. Telegram and WhatsApp channels began sharing booking details using the view-once feature to avoid group with 851 members, named 'Ocean Extension', was deleted by its admin. The group not only sold Tatkal tickets to users but also offered Tatkal booking software to agents. Its website, which sold bots designed to steal data and speed up bookings — effectively overwhelming the system for genuine users — also disappeared.A WhatsApp group named 'IRCTC Tatkal Update 2.0', which had 194 members and was engaged in the same business, was also deleted. LIMITED IMPACTBut the job is far from done. While groups with traceable digital footprints were swiftly taken down, many others continue to operate with full force, using virtual private servers (VPS) to mask their IP group, with at least 900 members, continues to openly sell the 'Ezyride Tatkal Service' bot to agents. A related website, also offers VPS services and proxy IPs to mask users' identities. Notably, the site was created just three months and agents are now using international phone numbers to mask their identities.'The reality is there will be no lasting impact on the ground,' Triveni Singh, former IPS Officer, Cybercrime told India Today. 'Within minutes, new channels will be set up, new IDs will be used, and the racket will continue. This is part of a massive operation spanning every state in the country, with countless agents using cheaply available bots. At best, they may shift to private Telegram groups or the darknet — but it's not going to stop.'According to Singh, the only way to curb this is through an AI-powered platform developed by the government that would use multiple parameters like geo-fencing, where only a person with a UP Aadhaar number can book tickets for someone else within UP, and AI-based profiling to track the number of times each ID is used. 'Only then can the racket be effectively restricted,' he said.- Ends
