Thane court convicts three in 2017 theft case, acquits them of MCOCA charges
Thane, Jul 22 (PTI) A special court in Thane district convicted three persons in a 2017 theft case while acquitting them of charges under the stringent Maharashtra Control of Organised Crime Act (MCOCA).
Special Judge (MCOCA) V. G. Mohite sentenced Rahul Machhindra Shinde (44) and Datta Umrao Shinde (35) to five years of rigorous imprisonment after finding them guilty of charges under section 380 (theft in a dwelling house) of the Indian Penal Code (IPC).
The other accused, Amit alias Pravin Premchand Bagrecha (44), was convicted under section 411 (dishonestly receiving stolen property) of the IPC, and sentenced to 25 days of rigorous imprisonment.
A copy of the order dated July 18 was made available on Tuesday.
The court acquitted the three accused of charges under the MCOCA. Rahul and Datta Shinde were also acquitted of charges under Sections 395 (dacoity) and 397 (dacoity with attempt to cause death or grievous hurt) of the IPC.
Judge Mohite observed that the prosecution failed to prove the mandatory requirement of 'use of violence or threat of violence or intimidation or coercion" essential for an offence to qualify as 'organised crime" under Section 2(1)(e) of the MCOCA.
According to the prosecution, on March 3, 2017, a police team were on night patrolling duty when they received a call about thieves in the Chandresh Park area in Dombivli town. Police chased five men, apprehending Datta Shinde, who was found with a stolen TV and a weapon. The remaining four managed to escape.
The police later apprehended the other two accused and recovered the stolen golden ornaments.
While the accused were initially charged with dacoity and dacoity with attempt to cause grievous hurt, the court found that the ingredients for these offences were not met.
The judge observed, 'None of the accused voluntarily caused or attempted to cause hurt or wrongful restraint or fear of instant death or instant hurt to anybody while committing said theft in the house." PTI COR ARU

Pak court sends woman to police custody in honour killing case
Agency: PTI Karachi, Jul 24 (PTI) A Pakistani court on Thursday remanded a woman to police custody for two days in connection with the alleged honour killing of her daughter and a man in Balochistan province. The incident took place some days ago at the Sanjidi Degari area near Quetta. The woman, identified as Gul Jan Bibi, was arrested after a video surfaced on social media in which she justified the killings, citing adherence to Baloch tribal customs. She was presented before the Anti-Terrorism Court (ATC) in Quetta, which sent her on a two-day police remand. In the video, Gul is seen holding the Holy Quran and stating that the act was not a crime but aligned with traditional values. 'My daughter who was married with five children was killed because of her relations with a Baloch youngster who used to post objectionable videos on Tik Tok despite several warnings given to him by our family. 'In Balochi culture, having illicit relations is a crime and punishable by death. The decision to shoot them was taken by a Jirga (tribal council)," she said in the video message. According to the Human Rights Commission of Pakistan, there were at least 405 victims of honour killings in 2024 across various parts of the country. Explosion damages coach of Quetta-bound train in Pakistans Balochistan province
Last Updated: Peshawar, Jul 24 (PTI) A coach of a Quetta-bound passenger train was partially damaged in an explosion on Thursday in Balochistan province of Pakistan, the third such attack since March. No passenger was harmed due to the explosion, railway officials said. 'Railway track between Bakhtiarabad and Damboli areas in Sibi district of the province was blown up with explosives, resulting in the Bolan Mail heading from Karachi to Quetta being hit," station master Murtaza Khan told reporters in Sibi and termed it as an act of terrorism. Coach No 7 of the train was 'partially damaged" in the incident, he said, adding, the train reached the Sibi railway station safely. Train operations have been suspended in the area in the aftermath of the blast even as the security forces have cordoned off the site, and a railway technical team has been dispatched to the scene. Train services will be resumed once the track has been cleared and declared safe, railway officials added. Following the incident, the Jaffer Express that had started from Punjab was halted at Dera Murad Jamali, while an earlier day Jaffer Express nearer to Quetta was stopped at Sibi station, officials confirmed. Over the past few years, Balochistan has seen a series of terror incidents where train tracks are blown up, targetting the province's transport infrastructure. Earlier, the Peshawar-bound Jaffar Express, travelling from Quetta to Peshawar and carrying 440 passengers, was hijacked near Balochistan's Sibi area on March 11, resulting in the deaths of 21 passengers and four security personnel. 'All 33 terrorists" were neutralised during the two-day clearance operation. Train services between Quetta and the rest of the country were restored on March 27. Tamil reel star Abirami sentenced to life for killing her two children
Chennai: In a landmark verdict, the Kancheepuram Principal Sessions Court on Thursday sentenced Abirami (32) and her lover Meenatchisundaram (35) to rigorous life imprisonment until death for the brutal murders of Abirami's two young children in 2018. The court also imposed fines on both convicts and came down heavily on the police for lapses during the trial. Principal Sessions Judge Beeju Chemmal found the duo guilty on multiple counts for the killings of Abirami's daughter Karnika (4) and son Ajay (6), rejecting Abirami's plea for leniency on grounds of her prolonged incarceration and responsibility toward her elderly parents. 'The crime is grave and cold-blooded. Life imprisonment alone is insufficient. They must remain behind bars for their natural lives,' the judge stated in the order. Both Abirami and Meenatchisundaram were awarded three consecutive life sentences under various sections of the IPC and fined Rs 15,000 each. Failure to pay the fine would result in an additional three-year imprisonment. Abirami, who gained online popularity as a local social media 'reels star' nicknamed 'Biryani Abirami' due to her food-related content, began an extramarital affair with Meenatchisundaram, a biryani delivery agent from a shop frequently visited by her family. When the affair was exposed, Meenatchisundaram allegedly pressured her to eliminate her family. In September 2018, Abirami mixed sleeping pills into the family's milk. Her daughter Karnika died after consuming the drugged milk, while her husband Vijay (30) and son Ajay survived. The following morning, Abirami smothered the drowsy Ajay with a pillow. She hid the children's bodies, intending to kill Vijay upon his return from work. However, when Vijay came home late, she abandoned the plan and fled with Meenatchisundaram to Kanyakumari after pawning her wedding chain. The next day, Vijay discovered the bodies of his children and alerted the police, triggering the investigation. Judge Chemmal also strongly criticised the Kundrathur police inspector for delaying the court production of the accused, dismissing the officer's justification, citing his child's illness as unacceptable. The judge further reprimanded the police for allowing Abirami to appear in court with her face covered by a shawl, noting that it posed a suicide risk and must not be repeated. The sensational case, which began with biryani deliveries and spiralled into a double murder driven by an illicit affair, drew a large crowd to the Kancheepuram court as the verdict was pronounced.
